On September 25, 2012 the County executed an agreement with Quincy Engineering Inc., of Sacramento, CA, for the development of contract plans, specifications, and estimate (PS&E) required to construct the Midway Bridge across Butte Creek at a cost not to exceed $1,677,999.12. In addition to the development of PS&E for the project, a contract amendment was necessary for Quincy Engineering to perform additional project management work related to coordinating right of way appraisal and acquisition. This amendment will provide amount of $62,271.79 and extends to the completion date from June 30, 2017 to June 30, 2018. Fiscal Impact: This project is funded through the Federal Highway Bridge Program, which provides 88.53% reimbursement to the Road Fund 0030. Road Fund contingency budget will cover the contract increase. Personnel Impact: Does not apply. Action Requested: 1. Approve agreement amendment and authorize the Director of Public Works to sign subject to review by County Counsel and Auditor-Controller. 2. Approve budget adjustment. AMENDMENT TO CONTRACT This Amendment to the Contract identified below, between the County of Butte and the Contractor identified below, reflects the mutual agreement between the parties to amend this Contract in consideration for the mutual promises contained herein. Amendment 1 2/13/2014 Amendment 1 Scope of Work Midway over Butte Creek Task 2.1 Project Management Additional project management as related to coordination of rightt of way appraisal and acquisition services. Task 8.1 Geotechnical Investigations Task 8.1.1 Initial Site Assessment (ISA) Additional investigation for asbestos containing materials is required. Taber will provide a certified asbestos consultant that will visit the project site, perform reconnaissance of the existing structures and collect samples, as necessary, for evaluation of asbestos content. A short summary report of findings and analytical results will be presented. This report will be appendedd to the final Initial Site Assessment. TASK 10 Right of Way Engineering Bender Rosenthal (BRI) will complete the appraisal, review the appraisal, make the first written offer, acquire the property, and provide the ROW certification for the following parcels: 038 160 006 (Sohnrey) Permanent R/W and TCE 038 160 022 (Gorrill) Permanent R/W and TCE 039 160 023 (Gorrill) Permanent R/W and TCE 038 160 031 (Gorrill) Permanent R/W and TCE 038 180 032 (Randall) Permanent R/W and TCE 038 200 009 (Gorrill) Access Easement Task 10.1 APPRAISAL SERVICES: BRI will complete the appraisal that will state the estimated fair market value of o the fee simple interest in the referenced property. The summaryy appraisal reports will be prepared in conformance with and subject to the requirements of the Code of Professional Ethics and the Standards of Professional Practice of o the Appraisal Institute, which fully incorporate the Uniform Standards of Professional Appraisal Practice (USPAP) of o the Appraisal Foundation. Jurisdictional exceptions may apply in some cases. Plats and legal description for the properties to be appraised will be provided to BRI by others. Some of the items that may affect the appraisal process include: Complexity of the valuation; Impact of the interests to be acquired (e.g. Temporary Construction Easements, and Public Utility easements). Damage Analysis (Severance Damage, Cost to Cure, etc.) The primary steps in completion of fair market value appraisals of the property rights to be acquired include but are not limited to the following: Onsite physical inspection of the subject property with the owner. Visual inspection of the comparable market data. Study of community and neighborhood in which the subject is located. Collection of data from appropriate governmental agencies. Market investigation of vacant and improved comparablee data. Verification of market data with sources knowledgeable with the pertinent details of the transaction. Analysis of all appropriate dataa in the beforee and after condition to arrive at an opinion of value. Preparation of report. ACQUISITION SERVICES: BRI will develop all necessary contracts, conveyance documents and escroww instructions necessary to make offers based on the Client s process. We will meet with the owner, and conveyy documents until acceptance or impasse is reached. Steps within the acquisition process are outlined below: 1. Review of the project concept and design with staff and other consultants. 2. Review of appraisals, title reports, maps and descriptionss of the required parcels. 3. Field review the project with the Project Manager or otherr designated person. 4. Preparation of right of way contracts and other acquisition documents. 5. Meet with the property owners to discuss the project in general; review of maps and legall descriptions; confirm information about occupants/owners and makee the official First Written Offer to owner. Acquire tenant consent if required. 6. Acquisition activities are based on settlement by the third contactt either in person or by telephone. A recommendation to the Client for an alternative course off action will be made if an impasse is reached and the property cannot be acquired. Deliverables: Acquisition of permanent ROW and TCEs from five parcels and an access easement from one parcel. Assumptions: Negotiations will occur with up to three property owners. Title services to be handled by others. TASK 10.4 ROW CERTIFICATION and ROW MANAGEMENT: Upon completion of the ROW acquisition, BRI willl prepare thee ROW Certification per Chapter 14 of the Caltrans ROW Manual. BRI will provide coordination services with Caltrans District 3 and the three property owners. No significant severance damage analysis required for the appraisals. The fee also assumes that no significant structures or improvements will be acquired, other than those listed in the scope. 6. No changes to design are made after property inspection that would require reinspection. 7. No changes are made to property rights being acquired after appraisal completion. 8. Appraisal is for real property only. 9. Appraisal cannot be used for condemnation. 10. Scope excludes rights of entry and condemnation support. If either is needed, this will require an addendum to scope, schedule, and budget.

Currently, our scope of services includes an Initial Site Assessment and an Aerially Deposited Lead Study for hazardous materials evaluations. Our supplemental services will include evaluation of the bridge and utilities associated with the bridge for the presence of asbestos containing materials. For these services, a certified asbestos consultant will visit the project site, perform reconnaissance of the existing structures and collect samples, as necessary, for evaluation of asbestos content. A short summary report of findings and analytical results will be presented. This report will be appended to the final Initial Site Assessment.
