Under the Amendment Act, licensed housing developers are required to provide information on their building projects and sale of units to the Controller of Housing (referred to as Controller ) in the form and manner and by such means and within such time or at such regular intervals as the Controller may specify. The Developer Survey System (DSS) is officially launched today, 25 May 2015. From today onwards, the weekly submission of data to the Controller will be compulsory as required under Section 11 of the Act. Please refer to Appendix 1 for details of the submission requirements as well as actions to be taken. 3. Licensed housing developers who have erected, set up and made available their show units for viewing by any purchaser or prospective purchaser before 20 Jul 2015 may be exempted from the show unit requirements under the HD(SU)R provided that the stipulated conditions are met. The conditions include developers lodging a declaration with the Controller. The declaration to be submitted to the Controller shall be in the form as set out in Appendix 2 and must be lodged with the Controller between 25 May and 23 July 2015. APPENDIX 1 OFFICIAL LAUNCH OF THE DEVELOPER SURVEY SYSTEM (DSS) 1. The Developer Survey System (DSS) is officially launched today. We had earlier soft launched the DSS on 18 Oct 2013, and requested all licensed housing developers to submit information on their building projects to the Controller of Housing (referred to as Controller ) on a weekly basis. We thank you for your participation in the soft launch. 2. From today onwards, the weekly submission of data to the Controller will be compulsory as required under Section 11 of the Housing Developers (Control & Licensing) Act ( the Act ). The key dates relating to the submission of information for the official launch of the DSS are set out in Annex 1. Actions required 3. We would require you to do the following: a b Provide the list of authorised officers: Please send us the list of officers authorised by your company to submit data in the DSS using the template in Annex 2 via email at ura_pricedata@ura.gov.sg by 29 May 2015, Friday, 5.00pm. This applies even if you had earlier provided us with the list of officers during the soft launch. Resubmit summary data for projects: If you had earlier submitted data for your respective projects, you will be required to resubmit the summary data, correct as at 31 May 2015, to the Controller. You are required to resubmit the data via DSS by 5 Jun 2015, Friday, 10.00am. Refer to Annex 3 for the procedures. 4. With the official launch of the DSS, the first compulsory submission of information via the DSS will be for units launched for sale, units sold, and units whose sale have been aborted during the period from 25 May to 31 May 2015. The deadline for this first compulsory submission will be on 5 Jun 2015, Friday, 10.00 am. Refer to Annex 4 for the details of the information that must be submitted to the Controller. Other key information 5. We would also like to inform you of the following: a Data must be accurate and timely: Licensed housing developers are required to ensure that all information submitted to the Controller via the DSS as required under Section 11 of the Act is correct and accurate, and submitted within the specified timelines. The Controller may take action against the developer, e.g. suspension or revocation of licence issued, for failure to comply with the requirements.
b c Information on individual units sold will be published: Information on individual units sold by developers (e.g. addresses, purchase prices, and net prices) will be released by the Controller to the public every Friday afternoon on URA s website. The first weekly release of such data on URA s website will be in the afternoon of 5 Jun 2015, Friday, for units sold during the period from 25 May to 31 May 2015. Aggregated monthly statistics will continue to be published: Aggregated monthly statistics on the units launched for sale, units sold, and their prices will continue to be released on the URA s website on the 15 th of each month, or the next working day if the 15 th falls on a Saturday, Sunday, or public holiday. 6. Annex 3 Steps to resubmit summary data for projects 1. Authorised officers to log in to their DSS accounts to check the summary data displayed for each project. 2. If the summary data for the project is accurate and correct as at 31 May 2015, please resubmit the data by clicking the button provided in the system (example as shown below). The summary data for the project, as at 31 May 2015, shown in DSS is accurate. The summary data is hereby resubmitted as required by the Controller under Section 11 of the Housing Developers (Control & Licensing) Act. 3. If the summary data for the project is inaccurate, please make the necessary amendments to the project in the system to ensure that the summary data is correct and click on the button mentioned above to resubmit the data.
Annex 4 Requirements for weekly submission of data by licensed housing developers Information to be submitted by licensed housing developers 1. The information, which must be submitted to the Controller on a weekly basis via the format specified in the Developer Survey System (DSS), 1 includes: Number of units that have been launched for sale (i.e. made available for sale and for which an Option to Purchase may be issued to a prospective purchaser); Date of launch of sale of units (see below for definition of launched for sale ); Number of units that have been sold (including units which have been resold after the earlier sale of the units had been aborted); Number of units whose sale have been aborted; Details of units that have been sold and units whose sale have been aborted, including unit address and such other particulars as may be specified in the DSS user guide 2 ; Description of benefits (see below); Purchase and net prices (after deducting amount or value of any benefit or benefits given or agreed to be given) of units sold. For the purpose of the submission, the date of launch of sale of units refers to the day on which units in a building project are first made available for sale, whether in a private preview to selected individuals or public launch, and for which an Option to Purchase may be issued to a prospective purchaser. The definition and examples of benefits given or agreed to be given to purchasers are provided below for your reference: Benefits refer to any rebate, reimbursement, allowance, discount, payment, voucher or other benefit (whether monetary or otherwise) that the licensed housing developer agrees to directly or indirectly give to a purchaser or an intending purchaser in relation to or conditional upon the sale and purchase of a unit in the building project. The value of such benefits is more than $1,000 and not deducted upfront from the purchase price. Examples of benefits include cash rebates, absorption of legal fees or stamp fees, furniture vouchers and rental guarantees 3 that may be given or agreed to be given to a purchaser upon the exercise of an Option to Purchase, or at a specified time after the exercise of the Option or upon the issue of Temporary Occupation Permit (TOP) for the unit. 1 Please note that data must be submitted in the format specified in the DSS User guide using the standard Excel template provided in the DSS. Other formats will not be accepted by the system. 2 The DSS user guide is available at: https://www.ura.gov.sg/dss/dls/login/logincontroller.jpf. 3 For example, rental guarantee may be in the form of monetary payment which a developer has committed to pay to a buyer once a building project has been completed (i.e. obtained TOP).
If there are non-monetary benefits (e.g. discounts for the purchase of cars, country club membership or household appliances such as coffee maker, refrigerator and microwave oven) given or agreed to be given to a purchaser and the total monetary value of such items is estimated to be more than $1,000, the licensed housing developer shall also be required to submit information on the monetary value of such benefits, which will then be deducted against the purchase price to derive the net price of the unit. 2. If no unit is launched for sale or sold 4 or if there is no unit whose sale is aborted in a certain week, then the licensed housing developer will not be required to submit any information for that project for that week. Timeline for submission of information 3. Licensed housing developers are required to submit the information within 5 calendar days from the end of each preceding week (i.e. every Friday 5, 10.00 am). Information submitted after the deadline will be considered late and the Controller may take action against the developer, e.g. suspension or revocation of licence issued. For the purpose of the submission, a week shall be defined as a 7-day period from Monday to Sunday (both days inclusive). 4. For example, licensed housing developers will be required to submit information of units sold in the week of 8 Jun 2015 (Mon) to 14 Jun 2015 (Sun) by 10.00 am on 19 Jun 2015 (Fri). Please note that the DSS will allow submissions starting from 15 Jun 2015 (Mon) at 12.00 am and will close at 10.00 am, 19 Jun 2015 (Fri). Information submitted after 10.00 am on 19 Jun 2015 will be considered late. As developers will still be able to make amendments to the data submitted before the submission deadline, developers are encouraged to start submitting their sales information on Monday once the submission period opens. Can he submit the soft copy of the requisite documents via email instead? Q2 After a licensed housing developer has sent the declaration and detailed list of the differences between the show unit and the depicted unit as in the approved building plan to the Controller, will the Controller inform the licensed housing developer in writing that the show unit requirements in Part 2 of the HD(SU)R will not apply to the show unit? Besides submitting the requisite documents to the Controller as set out in rules 14(1)(c) and 14(1)(f), the licensed housing developer still has to fulfill other conditions as stated in rule 14 of the HD(SU)R to qualify the show unit for the exemption, e.g. issue a copy of the detailed list of differences to an intending purchaser and obtain the written acknowledgement of receipt from the intending purchaser before accepting the booking fee. Hence, the Controller would not be able to confirm that the show unit requirements will not apply to the show unit. The licensed housing developer must ensure that he complies fully with the requirements as set out in rule 14 of the HD(SU)R to ensure that the show unit qualifies for the exemption.
Q3 What if a licensed housing developer inadvertently makes a mistake in filling up the declaration or omits to submit some of the required information? The licensed housing developer will only be deemed to have fulfilled the requirements under rules 14(1)(c) and 14(1)(f) if the requisite documents are submitted on or before 23 Jul 2015. It is the licensed housing developer s responsibility to ensure that the documents are complete, true and correct and in compliance fully with rules 14(1)(c) and 14(1)(f) at the point of submission. Please note that no amendment or alteration is allowed to the declaration and information submitted. The licensed housing developer will have to submit a fresh set of declaration and information should there be a need to make any amendment or alteration to the submitted declaration Q4 For the detailed list of the differences between the show unit and the depicted unit as shown in the approved building plan, will the Controller ask the licensed housing developer to make any amendments? If the description in the list is not clear, the Controller may ask the licensed housing developer to make the necessary amendments to comply with the requirements under rules 14(1)(c) and 14(1)(f) in order for the show unit to qualify for the exemption. A fresh declaration, containing all the required information,including the amended list of the differences, must be submitted by 23 Jul 2015 to qualify for the exemption. Notwithstanding, it is the licensed housing developer s responsibility to ensure that the documents submitted are complete, true and correct and comply with the requirements under rule 14 in order for the show unit to qualify for exemption.
