Zoning Conditions 1. The subdivision shall consist of a maximum of 218 lots (109 currently in Whispering Creeks, adding 56 lots; adding 53 lots on Maddox Road section). 2. A mandatory homeowners' association (HOA) shall be provided and be responsible for maintenance of common grounds, water quality/ detention facilities and open space. 3. The open space shall consist of 56.01 acres and the HOA shall maintain ownership and maintenance with right of entry for the City pursuant to declaration of covenants, restrictions, and easements for the property and as approved by the City. 4. The minimum lot area shall be 7,500 square feet and the minimum lot width shall be 75 feet. 5. The front and rear setbacks shall be 20 feet. The side yard setback shall be 15 feet between structures on all lots with a minimum of 5 feet from the property line. 6. All one-story homes shall have a minimum gross heated floor area of 2,400 square feet, which shall exclude the basement, both finished and unfinished. All two-story homes shall have a minimum gross heated floor area of 2,600 square feet, which shall exclude the basement, both finished and unfinished. 7. All homes shall be constructed with three sides brick, stucco or rock with architectural accent not to exceed 20% per elevation. 8. Proposed driveway must be a minimum of 20 feet in width. Garage doors shall be 18 feet in width (double) or 9 feet x 7 feet (singles). Minimum two car garages required. 9. There shall be a minimum of 30 of the 218 total lots that shall have three car garages. 10. All newly constructed public streets shall have a minimum 50 foot right-of-way with a 28 foot street from back of curb to back or curb. All streets shall be built to the City of Buford Development Regulations and specifications. 11. The existing infrastructure in the Maddox Road development shall be inspected by a City approved engineer certifying code compliance prior to any public dedication. 12. All streets in the subdivision shall have a four foot sidewalk with a 2 foot landscape strip on both sides of the street. 13. Street lights shall be provided throughout the project as approved by the City. All utilities shall be located underground. 14. All yards shall be sodded with one (1 ), 2-inch caliper tree in each front and rear yards. 15. Walking trails shall be provided and constructed by the developer and maintained by the HOA per the declaration of covenants, restrictions, and easements for the property as approved by the City. 16. Rental of housing units shall be restricted in the Declaration of covenants, restrictions, and easements as approved by the City. 17. No certificates of occupancy prior to January 2020. 18. The road and right-of-way shall be per City code and regulations.
