Magnone, Regulatory Co-ordinator, 905-874-2415 Brenda Campbell, Director of Building and CBO, 905-874-2440 OVERVIEW: With the passing of By-law 203-99, a demolition control by-law, the issuance of a permit to demolish a residential property must be authorized by Council. An application to demolish the existing vacant dwelling unit at 8212 Chinguacousy Road has been submitted by the agent for the owners, Prabhjot and Kiran Dhanoa. The agent for the owners has submitted a site plan application, SP08-053, to redevelop the lands for a commercial plaza. The Heritage Co ordinator has determined that the building is not of heritage interest. Although the application to redevelop the lands has not yet received final site plan approval, Fire and Emergency Services and Peel Regional Police have expressed concern and are required to attend at vacant buildings on a regular basis as a result of vandalism and illegal activities notwithstanding the efforts of owners to secure the buildings. To avoid the potential of a serious fire or injury, it is recommended that Council approve the recommendation that a demolition permit be issued for the property.
RECOMMENDATIONS: 1. THAT the Recommendation Report dated April 1, 2009, from Anthony Magnone, Regulatory Co-ordinator,, Planning, Design and Development Department, re: Application for a Permit to Demolish a Residential Property - 8212 Chinguacousy Road, BE RECEIVED; 2. THAT the application for a permit to demolish the residential property located at 8212 Chinguacousy Road BE APPROVED; and 3. THAT Peel Regional Police be advised of the issuance of a demolition permit for the property. BACKGROUND: 1. DEMOLITION CONTROL BY-LAW 203-99 The Council of the City of Brampton passed a demolition control by-law, 203-99, on September 27,1999. By-law The purpose of a demolition control by-law is to preserve housing stock in a municipality. The effect of the by-law is that no person can demolish the whole or part of any residential property unless a demolition permit is issued by Council. Demolition permits for residential properties (dwelling units) are no longer regulated by the Building Code Act. The Council of the municipality, not the Chief Building Official, must authorize the issuance of the demolition permit. 2. CONDITIONS FOR STAFF RECOMMENDATION FOR APPROVAL Council subsequently approved a demolition control by-law process. In accordance with the policy a recommendation to issue a permit to demolish a dwelling unit will be made if one or more of the following conditions exists: 1. An unsafe condition exists. A building is unsafe if the building is structurally inadequate or faulty for the purpose for which it is used or in a condition which could be hazardous to the health or safety of persons in the normal use of the building, persons outside the building or persons whose access to the building has not been reasonably prevented. 2. An application has been submitted to the Building Department for a permit to construct a replacement dwelling unit. 3. The land on which the dwelling unit is situated is part of a draft-approved plan of subdivision for which a pre-servicing agreement has been executed.
4. The land on which the dwelling unit is situated is the subject of a rezoning and/or site plan agreement and the zoning by-law is approved and/or site plan approval has been obtained. CURRENT SITUATION: 1. 8212 Chinguacousy Road is a one-storey single detached building of wood framing and brick that was constructed in the 1960's. The dwelling is located on the northwest corner of Chinguacousy Road and Charolais Boulevard. 2. The application for the demolition permit was forwarded to the Heritage Co ordinator. The dwelling has been determined not to be of heritage interest. 3. Although the application to redevelop the lands has not received final site plan approval, vacant houses in developing areas are presenting a problem for police and emergency services agencies personnel with respect to illegal possession and uses. Recently, vacant houses have become a target for arson. It is, therefore, recommended that Council approve the issuance of a demolition permit for the subject property.
