Exemption Certificates Of land zoned for residential use or a mixture of residential and other uses, up 20 per cent may be designated for social and affordable housing under Part V of the Planning and Development Act 2000 (as amended). A certificate exempting a proposed development from the provisions of Part V may be sought under Section 97 of the 2000 Act (as amended). The certificate will be granted where land is zoned for residential use or a mixture of residential and other uses, but comprises less than four units or is for housing on 0.1 hectares or less. An applicant (or person with whom the applicant is acting in concert) will not be granted an exemption certificate except in certain very limited circumstances (set out in Section 97 Part 12 of the 2000 Act (as amended)) where they have already received an exemption certificate within the previous five years or have already benefited from an exemption certificate.
