Department of Planning Briefing Paper June 25, 2015 Open Session Issue: Discussion/Deliberations 2015 Spring Amendment to the 2014 Water and Sewer Master Plan Background: A public hearing was held on June 11 th for the 2015 Spring Amendment to the 2014 Water and Sewer Master Plan. As part of this process, the Board of County Commissioners is being asked to approve a resolution to Adopt these Amendments so the plan can be forwarded to the Maryland Department of the Environment for their Approval. Department of Planning Briefing Paper June 25, 2014 Open Session Issue: Westminster Annexation No. 61 - K & G Properties, LLC. Background: The City of Westminster is currently processing annexation request No. 61 - K & G Properties, LLC. This annexation is for 4.98 acres of the K & G property located east of the City s municipal limits with frontage on eastbound MD Route 140, located about 410 feet east of Hemlock Lane. The annexation also encompasses the right-of-way of MD Route 140 extending +/-890 feet east from the existing City limits at Hemlock Lane. The annexation area is in the County s General Business Zoning District and has a land use designation in both the 2009 City of Westminster Comprehensive Plan and the County s 2007 Westminster Environs Community Comprehensive Plan as Commercial. The City has indicated its intent to place the annexation area in the B Business zoning district. Going from one business category to a similar commercial category will not increase the density by more than 50%, so a zoning waiver is not required. A full staff report was presented to the Planning and Zoning Commission on June 16, 2015. Following their review, the Planning and Zoning Commission is forwarding this report to the Board of County Commissioners for their review and concurrence. A comment letter with the Board s signatures will be sent to the City. The City of Westminster has scheduled their public hearing on July 13, 2015. Department of Permits and Inspections Briefing Paper Public hearing Issue: Public hearing regarding the update of Chapter 170 Construction Codes as required by COMAR 05.02.07 Background: On February 26, 2015 and May 7, 2015 I was before the Board to discuss the proposed changes in updating Chapter 170 Construction Codes as required by COMAR 05.02.07. Based on information and direction provided by the Board, minor changes were made which included removing proposed language regarding additional inspections and removing the word exceptional from the floodplain variance process. Those updates have been completed and the ordinance is ready for adoption. Note: The additional proposed floodplain language has been withdrawn at this time due to State review and will be brought forth later this year. Requested Action: Adoption of proposed changes to Chapter 170 Construction Codes. Effective date July 1, 2015

Recreation and Parks Briefing Paper Discussion/Decision OPEN SESSION Issue: FY 2016 Program Open Space Allocation to Municipalities Background: Since 1977, the County has had an agreement with the municipalities to allocate 25% of its annual Program Open Space apportionment to the towns for municipal park projects. For FY 2016, their allocation is $144,856. Each year, the municipalities recommend how these funds will be spent and their recommendation is included below. Approval of their recommendations by the County Commissioners is required. Department of Recreation & Parks Summary: The Department of Recreation & Parks is requesting permission to apply for Recreational Trails Program grant from the Maryland Department of Transportation/State Highway Administration for FY 2016 to provide to purchase a gator to assist with the management and maintenance of 13.5 miles of trails at the Hashawha Environmental Center and adjoining Union Mills reservoir area. The projected cost for this equipment is $18,725 and if successful, the State Highway Administration grant will reimburse $14,980 (80%) of the funds to necessary for this project. The $3,745 in required matching funding will be supported by Park Legacy Fund donations that have been earmarked for the Hashawha Environmental Center and no general fund dollars are needed. Recommendation: Request approval to submit Recreational Trails Program grant application to Maryland Department of Transportation/State Highway Administration with the understanding that if awarded, we will return to request permission to accept grant award.

DEPARTMENT OF CITIZEN SERVICES BUREAU OF HOUSING AND COMMUNITY DEVELOPMENT STAFF TIME WITH BOARD OF COUNTY COMMISSIONERS July 2, 2015 EXECUTIVE SUMMARY Issue to be Addressed: Approval and signing of documents related to the Maryland Department of Housing and Community Development (DHCD) 2015 On-Behalf-Of Local Governments Housing Program. Background of the Issue: The On-Behalf-Of initiative is an annual State bond issue used to promote home ownership. The program offers local governments opportunities to partner with the State to either: (1) provide mortgage financing for first-time home buyers (primarily), or (2) assist with Multifamily Rental Housing Development programs. By agreeing to have the State administer funds designated for Carroll County, the following process occurs: DHCD issues bonds; the allocation is held 60 days for Carroll County s exclusive use; bond proceeds not used within the 60 days revert to a Statewide pool of funds available to eligible applicants, including Carroll Countians, on a first-come, first-served basis. The amount available to Carroll County in this action is $5,911,819. It is recommended that the full amount be authorized to the State to be used in the Maryland Mortgage Program. This truck will be purchased off a competitive sealed bid conducted by the Maryland State Highway Administration (SHA). After delivery of the chassis, it will be outfitted with a dump body, plow and spreader and used by the Bureau of Roads Operations for road maintenance and snow removal. This amount is within the project budget and no additional funds will be needed. The State of Maryland supports this mandate with an annual grant through the Administrative Office of the Court. Program: A division of the Circuit Court for Carroll County, the Family Law Administration provides services to the Courts, litigants and attorneys in matters related to families and children. Services coordinated or administered by this office include Mediation, Visitation Services, Custody Evaluation, assistance for domestic violence victims, and a Family Law Clinic. The FY16 award represents a 5% increase over the FY15 award; however, funding was not provides for the new position requested - a Domestic Case Navigator. This position would have provided direct service to self-represented litigants. Dusty Hilbert, Bureau Chief Ext. 2520 Department of Public Works Briefing, Discussion, & Decision Paper Issue: Briefing & Discussion and Possible Decision Northern Recycling Operations Contract Award Background: As part of Carroll County s membership in the Northeast Maryland Waste Disposal Authority (NMWDA), an RFP was issued on the County s behalf for the Operation, Transportation and Processing of Single Stream Recyclable Materials from Northern s Recycling Facility. The previous contract is expired. We had hoped to continue with that contract but the current company dropped its rate to $0. We bid this in hopes to continue with a revenue stream for the County. The start date of a new contract is July 1, 2015. The bids were submitted May 27 th. The fifteen day public notice period has passed. No comment has been received during the public notice period regarding the purchase of easement and real property along Rohrbaugh Road. The total acreage is 0.417+/- acre real property and 0.0459 +/- acre easement, with an agreed upon value of $7,500.00.
