The regular meeting of the Agricultural Preserve Advisory Committee was called to order by Debbie Trupe at 9:00 A.M. in the Santa Barbara County Planning and Development, Third Floor Conference Room, 123 E. Anapamu Street, Santa Barbara, CA 93101. ACTION: Trupe moved, seconded by Lackie, and carried by a vote of 3-0 (McIssac, Lackie & Trupe voted) to approve the Minutes of August 14, 2015, as amended. ACTION: Lackie moved, seconded by Ricardo, and carried by a vote of 4-0-1 (Lackie, Ricardo, Jevremovic, Larsen voted, Trupe abstained) to approve the Minutes of September 4, 2015 as amended.

CONTINUED ITEMS: V. 98-AP-016 Nojoqui Ranch Winery Goleta Ryan Cooksey, Planner (805) 568-2046 Consider the request of David Swenk agent for the owner, Nojoqui Ranch, LLC of Case No. 98-AP-016 regarding the construction of a Tier II Winery operation to include a winery and hospitality facility which would include a tasting room and its consistency with the Uniform Rules and consider ongoing eligibility of the property as an agricultural preserve consistent with the Uniform Rules and any enforcement actions pursuant to Uniform Rule 6.. The property is 230.03 acres identified as Assessor s Parcel Number s 081-020-024 & 081-020-029 zoned AG-II-100 with an AG-II Comprehensive Plan designation located at 2323 Old Coast Highway in the Goleta area, Third Supervisorial District. (Continued from 9/3/15) Lackie moved, seconded by Ricardo, and carried by a vote of 4-0-1 (Trupe abstained) to continue the project to the November 6, 2015 APAC meeting. V. NEW ITEMS: 2. 68-AP-018 Rancho Sisquoc Expansion Rancho Sisquoc 15DVP-00000-00007 Florence Trotter-Cadena, Planner (805) 934-6253 Consider the request of David Swenk, agent for the owner representative, Ed Holt, of Case No. 15DVP-00000-00007 regarding the approval of the final development plan to expand the existing Rancho Sisquoc Winery production facility to add 2,800 square feet to the wine production facility to accommodate their wine production operations and its consistency with the Uniform Rules and consider ongoing eligibility of the property as an agricultural preserve consistent with the Uniform Rules and any enforcement actions pursuant to Uniform Rule 6. The property is 5,511.89 acres identified as Assessor s Parcel Number 133-040-011, zoned AG-II-100 with an AG-II Comprehensive Plan designation located at Foxen Canyon Road in the Rancho Sisquoc area, Fifth Supervisorial District. Ricardo moved, seconded by Lackie, and carried by a vote of 5-0 to continue the project to the November 6, 2015 APAC meeting based upon the applicants map and in-correct Assessor Parcel Number and the application material provided. The applicant has been advised to work with the planner to determine the correct Assessor Parcel Numbers and to also determine what Agriculture exists on the rest of the contracted land. JDJ Land Company 3. 71-AP-79 Agricultural Preserve Replacement Contract Guadalupe 15AGP-00000-00017 Florence Trotter-Cadena, Planner (805) 934-6253 Consider the request of James Merrill agent for the owner, JDJ Land Company LLC, of Case No. 15AGP-00000-00017 regarding the request for replacement contract and its consistency with the Uniform Rules and consider the ongoing eligibility of the property as an agricultural preserve consistent with the Uniform Rules and any enforcement actions pursuant to Uniform Rule 6. The property is 85.10 acres identified as Assessor s

Page 3 Parcel Number 113-040-001, 115-020-015 zoned AG-II-40 with an AC Comprehensive Plan designation located at Simas Road/Main Street/Hwy 166 in the Guadalupe area, Third Supervisorial District. Lackie moved, seconded by Jevremovic, and carried by a vote of 5-0 to continue the project to the November 6, 2015 APAC meeting. The project description should be corrected to reflect that the contract is a New Contract, not a Replacement Contract. The applicant also needs to resolve the issue with the contract which is bisected by the city of Guadalupe City limits. 4. 71-AP-004 Michael Replacement Contract Santa Maria 15AGP-00000-00019 Florence Trotter-Cadenza, Planner (805) 934-6253 Consider the request of Lisa Bodrogi agent for the owner, Richard & Kandi Michael, of Case No. 15AGP-00000-00019 regarding the replacement contract for 71-AP-004 and its consistency with the Uniform Rules and consider ongoing eligibility of the property as an agricultural preserve consistent with the Uniform Rules and any enforcement actions pursuant to Uniform Rule 6. The property is 1,546.39 acres identified as Assessor s Parcel Number 129-180-016, 129-180-040, 101-040-026 & 101-040-027 zoned AG-II- 100 with an AC Comprehensive Plan designation located at 6355 Palmer Road in the Santa Maria area, Fourth & Fifth Supervisorial District. Lackie moved, seconded by Ricardo and carried by a vote of 5-0 to find the request for a Replacement Contract for parcel number s 129-180-016, 129-180-040, 101-040-026 & 101-040-027 Consistent with the Uniform Rule eligibility specifically rule 1-2. 5. 71-AP-004 Michael Non-Renewal Contract Santa Maria 15AGP-00000-00018 Florence Trotter-Cadena, Planner (805) 934-6253 Consider the request of Lisa Bodrogi agent for the owner, Richard & Kandi Michael, of Case No. 15AGP-00000-00018 regarding the non-renewal of contract 71-AP-004 and its consistency with the Uniform Rules and consider ongoing eligibility of the property as an agricultural preserve consistent with the Uniform Rules and any enforcement actions pursuant to Uniform Rule 6. The property is 1,546.42 acres identified as Assessor s Parcel Number 129-180-016,129-180-039,129-180-040,101-040-026,101-040-027, zoned AG-II-100 with an AC Comprehensive Plan designation located at 6355 Palmer Road in the Santa Maria area, Fourth & Fifth Supervisorial District. Lackie moved, seconded by Ricardo and carried by a vote of 5-0 to accept the request for Non Renewal for parcel number s 129-180-016,129-180-039, due to the determination that the parcel would not meet the Uniform Rule eligibility specifically rule 1-2.2 of the Uniform Rules.

Page 4 DISCUSSION ITEMS: 6. 82-AP-013 Calhaven, LLC Residence Addition Toro Canyon No Planner Assigned Request of Brian Banks agent for the owner Sophie Calvin for information regarding an addition to the existing single family dwelling residence of approximately 1,750 square feet and a covered loggia of approximately 918 square feet. The property involves Assessor s Parcel Number 155-040-031 & 155-040-033 which consists of 160.90 acres currently zoned AG-II-100 with an AC Comprehensive Plan designation. The property is located at 850 Toro Canyon Road in the Toro Canyon area, First Supervisorial District. Applicant to identify all buildings on the property. The two parcels are currently under contract. Demonstrate water source for the property. Sophie Calvin corrected the agenda and stated that she was not the owner but the owner s representative. 7. 69-AP-047 Schaff Lot Line Adjustment Lompoc No Planner Assigned Request of Steve Welton agent for the owner Victor Schaff for information regarding a lot line adjustment between legal parcels. The properties involve Assessor s Parcel Numbers, 099-090-013 which consists of 642.65 acres & 099-090-003 which consists of 2.0 acres, and are currently zoned AG-II-320 with an AG Comprehensive Plan designation. The property is located at 2765 Canyon in the Cebada Canyon area, Third Supervisorial District. Finalize the lot acreage and show proof of water source on both contracts. Show proof of farm employee s employment. VII. REPORTS OF COMMITTEE MEMBERS: Committee members may make reports to Committee regarding individual contracts requiring placement on a future agenda or on general procedural matters. No official action shall be taken on any individual matter. Debbie Trupe reported that she had a site visit at 6858 Casitas Pass Road, the site of the project, Smith Agricultural Accessory Structures, with the agent Erik Nagy and a representative of the owner Mr. Smith. The property consists of container production Ag. The existing palm trees that are on the property, if taken care of properly are saleable. However, the existing agriculture may not be enough to qualify or be eligible. If the applicant does not bring the project back to the APAC Committee in 6 to 8 months, the Committee will place the project back on the agenda for review. David Lackie asked County Counsel if the Vine Oaks Non-Renewal could be taken to the Board of Supervisor s based on the approval of the minutes where the APAC Committee voted on the Non- Renewal of their Williamson Contract or should the APAC Committee formally send a letter on behalf of APAC informing them of their action. County Counsel will follow up with the planner, Florence Trotter-Cadena.

Page 5 Sergio Ricardo inquired as to whether the APAC Committee will follow up with the Shadow s Fund Contract Cancellation. The APAC Committee will direct staff to follow up with the Shadow s Fund representatives. There being no further business to come before the Agricultural Preserve Advisory Committee the meeting was adjourned until 9:00 A.M. on November 6, 2015, in the Planning and Development, Third Floor Conference Room, 123 E.
