I. GENERAL INFORMATION A. REQUESTED ACTION: Approval of Ordinance #1777 to revise the Zoning Map to reflect 2017 Annexation No. 2. II. ANALYSIS AND DEVELOPMENT ALTERNATIVES A. STAFF COMMENTS: 1. Ordinance #1777 will change the official zoning map of the City of Papillion in accordance with Section 205-32 of the Papillion Municipal Code, which allows the City to adopt a zoning map and to apply existing or future zoning regulations, property use regulations, building ordinances, electrical ordinances, plumbing ordinances, and all other regulatory ordinances of the pursuant to Neb. Rev. Stat. Section 16-901 and to provide for an effective date thereof. 2. The Official Zoning Map is being amended to show the 2017 Annexation No. 2 tracts within city limits. The 2017 Annexation No. 2 tracts are already located within the City s extraterritorial zoning jurisdiction. No conversion of the area s zoning districts is required. 3. Tract B is currently under construction for multi-family housing units known as Bellino Ninety Six. No other building permit applications are pending in Annexation Tracts A & C at this time. III. IV. RECOMMENDATION The Planning Department recommends approval of Ordinance #1777 (MISC-17-0005) based on consistency with 205-32 of the Zoning Regulations. ORDINANCE NO. 1777 AN ORDINANCE TO CHANGE THE OFFICIAL ZONING MAP OF THE CITY OF PAPILLION IN ACCORDANCE WITH SECTION 205-32 OF THE PAPILLION MUNICIPAL CODE TO INCLUDE PARCELS AND AREAS ANNEXED INTO THE CORPORATE LIMITS OF THE CITY BY ORDINANCE NO. 1776, AND TO PROVIDE FOR AN EFFECTIVE DATE THEREOF. WHEREAS, Neb. Rev. Stat. 16-905 provides that the City may, by ordinance, designate its jurisdiction over territory outside of the corporate limits of the City under Neb. Rev. Stat. 16-901 or 16-902 by reference to an official zoning map; and WHEREAS, pursuant to 205-32 of the Papillion Municipal Code, the adopted a zoning map depicting boundaries of zoning districts established by the City, which map, together with legends, references, symbols, boundaries, and other information, is prominently displayed in the City Council chambers. WHEREAS, Neb. Rev. Stat. 16-902 allows the to designate, by ordinance, the portion of the territory located within two miles of the corporate limits of the City and outside of any other organized city or village within which the will exercise the powers and duties granted by 16-902 to 16-904 of the Nebraska Revised Statutes. THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of Papillion, Nebraska, as follows: Section 1: Zoning Map Amendment. That the zoning map which is prominently displayed in the City Council chambers pursuant to 205-32 of the Papillion Municipal Code should be and is hereby amended to include those parcels and areas annexed into the corporate limits of the City by Ordinance No. 1776, otherwise known as 2017 Annexation No. 2. Section 2: Corporate Limits. That attached hereto and incorporated herein by this reference is a graphic depiction of the corporate limits before the adoption of Ordinance No. 1776, attached as Exhibit A, and a graphic depiction of the corporate limits after the adoption of Ordinance No. 1776, attached as Exhibit B. Section 3. Effective Date and Publication. This Ordinance shall be in full force and effect fifteen (15) days after its passage. The City Clerk is directed to effectuate the publishing of this Ordinance for at least one (1) week in a newspaper in general circulation within the City of Papillion, which publication must take place within fifteen days after the passage of the Ordinance by the City Council. The City Clerk, pursuant to Neb. Rev. Stat. 16-405, should cause this Ordinance to be published in book or pamphlet form, by reference to such code, or portions thereof, along with setting forth in this Ordinance the conditions, provisions, limitations or terms of such code. That this Ordinance shall have the same force and effect as though it had been spread at large in this Ordinance without further or additional publication thereof. That three copies of said code, in book or pamphlet form, have been filed for use and examination by the public in the office of the City Clerk. That the adoption of this Ordinance shall be construed to incorporate such amendments thereof as may be made therein from time to time, if three
