MINUTES CITY OF THE COLONY PLANNING AND ZONING COMMISSION JULY 25, 2017 After determining that a quorum was present, the Planning and Zoning Commission of the City of The Colony, Texas convened into Regular Session which was held on Tuesday, July 25, 2017 at 6:30 PM in the City Council Chambers located at City Hall, 6800 Main Street, The Colony, Texas, at which time the following items were addressed: Board Members Present: Karen Hames, Chairman, Detrick DeBurr, Vice Chairman, Cesar Molina Jr., Shawn Rockenbaugh, Shannon Hebb, Brian Buffington, and Janece Pool. Board Members Absent: None City Council Liaison: David Terre, City Council Place 4 Staff Present: Surupa Sen, AICP, Planning Director, Mohamed Bireima, AICP, Senior Planner, Ed Voss, City Attorney, Naim Khan, P.E., Senior Engineer, and Brian McNuelty, Engineering Technician. 1.0 CALL REGULAR SESSION TO ORDER Chairman Hames called the meeting to order at 6:30 p.m. 1.1 CITIZEN INPUT Ms. Sen introduced Mohamed Bireima, the new Senior Planner to the Commission. 2 CONSENT AGENDA 2.1 Consider approval of the minutes of July 11, 2017 Regular Session. 2.2 FP17-0004, Westbury Phase 3B at Tribute Final Plat Consider approval of final plat for Lots 27-39, 73X, Block L, Lots 13-22, Block R, Lots 6-15, Block U, Lots 13-15, Block V, Westbury Phase 3B at Tribute, being 6.788 acres of land out of the B.B.B. and C.R.R. Chairman Hames read the Consent Agenda items into the record. 1 3

City of The Colony July 25, 2017 Planning and Zoning Commission Meeting Minutes Page 2 of 5 Commissioner Pool had a question about the Tribute Final Plat regarding how the roadways will be connected after the abandonment of the old Boyd Road, especially for the people who live outside the Tribute. Ms. Sen explained that this project has been done in several phases, and what is presented tonight does not show the entire development and how the roadway system will eventually be connected. She indicated that the City Engineer may be able to address this issue in more details. Mr. Khan assured that there will always be a roadway connection for the people outside the Tribute and they will not be disturbed. Ms. Sen added that City Staff could prepare an exhibit with the help of the developer that shows the future roadways connections and would share it with the Commission by email. With no further questions, Commissioner Hebb made a motion to approve the consent agenda items as presented and seconded by Commissioner Pool. The motion carried (7-0). 3 PUBLIC HEARING ITEMS 3.1 SI17-0002, Zoning Ordinance Amendments Conduct a public hearing, discuss and consider making a recommendation to City Council on amending certain sections of The Colony Zoning Ordinance to maintain consistency, provide clarity, and remove clerical errors within the Zoning Ordinance. Chairman Hames read Public Hearing item 3.1 into the record. Ms. Sen presented the ordinance amendments to the Commission. Chairman Hames appreciated the ordinance amendments and the work that has been done. Chairman Hames opened and closed the public hearing at 6:50 p.m. with no one wishing to speak. Commissioner Rockenbaugh made a motion to recommend approval of Item 3.1 as presented, Vice Chairman DeBurr seconded the motion. Motion carried (7-0). 3.2 SUP17-0003 Enterprise Auto Leasing Specific Use Permit Conduct a public hearing, discuss and consider making a recommendation to City Council on a request for Specific Use Permit (SUP) to allow Enterprise Auto Leasing to locate within an existing partially vacant building at 4695 SH 121 to operate a neighborhood auto rental branch within General Retail (GR) zoning district. Chairman Hames read Public Hearing item 3.2 into the record. Ms. Sen presented the staff report. 4

City of The Colony July 25, 2017 Planning and Zoning Commission Meeting Minutes Page 3 of 5 Chairman Hames asked how many rental cars will be parked on the facility and where these cars will be parked on site. Ples Schnitz, AKS, LLC, 13601 Preston Road, suite 107W, Dallas, TX 75240, answered that 27 spaces would be available for the facility, and the rental cars will be parked on the spaces fronting onto Highway 121 and the spaces immediately next to the space will be reserved for rental cars and the customers. He added that the 15 spaces that are located along the truncated portion of the building will stay reserved for the convenience store and the future tenants for the vacant space. Commissioner Buffington asked a follow-up question about how many cars would be in the facility. Jeff Halbert, Enterprise Rental Cars, 4201 N State Highway 161, Irving, TX 75038, answered that about 15 to 20 cars should be well under the amount of parking for this type of facility. He added that there should be ample parking on the site. Chairman Hames opened and closed the public hearing at 7:00 p.m. with no one wishing to speak. Vice Chairman DeBurr made a motion to recommend approval of Item 3.2 as presented, Commissioner Hebb seconded the motion. Motion carried (7-0). 3.3 SI17-0004 First Amendment to Deed Restrictions Conduct a public hearing, discuss and consider making a recommendation to City Council on a first amendment to Deed Restrictions dated October 29, 1984, and recorded at Volume 1512, Page 589 in the Real Property Records of Denton County, Texas, on October 31, 1984 ( Deed Restrictions ) by and between The City Of The Colony, Texas, a Texas home-rule municipality; Armor Safe Technologies LLC, a Texas limited liability company, Westport Villas, LLC, a Texas limited liability company and The Talmadge Tinsley Company, INC, a Texas Corporation, in order that the permitted uses allowed under The Colony Zoning Ordinances does not conflict with the Deed Restrictions. Chairman Hames read Public Hearing item 3.3 into the record. Ms. Sen presented the staff report. Commissioner Hebb asked whether the deed restrictions modification is applicable only to the townhomes shown on the presentation slide. Ms. Sen answered that the modification would apply only to the properties shown on the request and any future modification would have to come to this Commission and the City Council for final approval. Chairman Hames opened and closed the public hearing at 7:04 p.m. with no one wishing to speak. 5

Motion carried (7-0). 4 DISCUSSION ITEMS 4.1 SP17-0008 Grandscape Lifestyle Center Area 2A Development Plan Discuss and consider making a recommendation to City Council on a request for Development Plan for Grandscape Lifestyle Center Area 2A that includes construction of public sanitary sewer and water utilities, private roadway and roundabout infrastructure, and a parking garage structure adjacent to Nebraska Furniture Mart s truck entrance from Destination Drive within Planned Development 25 (PD 25) aka the Grandscape Planned Development zoning district. Chairman Hames read Discussion item 4.1 into the record. Ms. Sen presented the staff report. Chairman Hames asked where the LED signs would be located, what direction they would be facing, and whether they would be intrusive to any neighbor. Ms. Sen answered that the primary goal of these signs to get the attention of people driving on the highway and that was the reason the signs were oriented toward the highway on the plans. Commissioner Buffington asked if staff know how many residential units would be built within the residential towers shown on the conceptual plans. Ms. Sen answered that staff currently does not have that information as these towers are shown only conceptually on the plans. Commissioner Buffington asked whether the parking garage would accommodate parking for the future residents of the tower and whether there would be agreement between the current and future users of the garage. Ms. Sen confirmed that the garage would be available for the entertainment center as well as the future residents. She added that there is currently one owner and one developer of the site, however, they will move in the future toward an agreement when the residents move in or the property is separately platted. Commissioner Buffington asked whether there would be any security measures in the garage when the future residential component is added to the development. Ms. Sen explained that staff is not aware of any security measures being added at this time; however, she thought there would possibly be some kind of cameras or sensors in the garage. She added that the Commission would have a chance to look at this again when the site plan for the residential development is submitted for review and approval. 6

Commissioner Buffington made a motion to recommend approval of Item 4.1 as presented, Commissioner Hebb seconded the motion. Motion carried (7-0). PLANNING AND ZONING COMMISSION REPORT Item # 3.1 AGENDA DATE: August 8, 2017 DEPARTMENT: Development Services Department PLANNER: Surupa Sen, AICP, Planning Director, 972-624-3164 SUBJECT SP17-0008 Grandscape Lifestyle Center Area 2A Revised Development Plan Discuss and consider making a recommendation to City Council on a request for Revised Development Plan for the Grandscape Lifestyle Center Area 2A to accommodate the construction of a 7-story parking garage above grade adjacent to Nebraska Furniture Mart s truck entrance from Destination Drive, including public sanitary sewer and water utilities, a private roadway and roundabout infrastructure. The subject property is zoned within Planned Development 25 aka the Grandscape Planned Development zoning district. OWNER/ENGINEER Owner/Developer: The Colony LDC The Colony, Texas Engineer/Surveyor: Olsson Associates Overland Park, Kansas EXISTING CONDITION OF PROPERTY The property is currently undeveloped. PROPOSED DEVELOPMENT Area 2A of the 90-acre Grandscape Development includes the construction of public sanitary sewer and water utilities, private roadway and roundabout infrastructure, and a 7-story parking garage above grade adjacent to Nebraska Furniture Mart s truck entrance from Destination Drive. Area 2A will serve parking and infrastructure needs for future entertainment, retail, and residential projects immediately to the north of the garage. The original design of the parking garage that was presented and approved by the Planning and Zoning Commission on July 25, 2017 included seven (7) parking levels, with one partial level below grade and six (6) levels above grade, including parking provided on the roof of the structured garage. The proposed garage would have accommodated 3,430 parking spaces. The revised parking garage design will include seven (7) parking levels with all levels above grade, including parking provided on the roof of the structured garage. The revised garage will accommodate a total of 3,388 parking spaces. Mass grading and site preparation has already begun, and other infrastructure improvements are expected to be underway in summer 2017. Future phases will be presented before the Commission and City Council for review and approval as the tenant specifications and other design parameters (site layout, parking distribution, interior connectivity, pedestrian access etc.) are finalized. 1 8

ATTACHMENT 1 Staff Analysis Summary of Request Grandscape is one of the largest and unique mixed-use real estate developments located in The Colony, Texas, in the heart of Dallas/Fort Worth, the 4 th largest metropolitan area in the nation. The sprawling 400+-acre development will feature 3.9 million square feet of retail, entertainment, dining, hospitality, office and attractions. Grandscape, developed by Nebraska Furniture Mart, a Berkshire Hathaway company is the developments first anchor. The home furnishings giant opened a 1.86 million square foot store in May 2015, offering furniture, flooring, appliances and electronics. The next phase of the project to be completed includes completion of 90+ acres (over 2 million square feet of mixed-use development) adjacent the Furniture Mart. Several first-to-market tenants and retailers will be announcing plans to join the project in the near future. Area 2A of the 90-acre Grandscape Lifestyle Center Development includes construction of public sanitary sewer and water utilities, private roadway and roundabout infrastructure, and a parking garage structure adjacent Nebraska Furniture Mart s truck entrance from Destination Drive. Area 2A will serve parking and infrastructure needs for future entertainment, retail, and residential projects immediately to the north of the garage. The original design of the parking garage that was presented and approved by the Planning and Zoning Commission on July 25, 2017 included seven (7) parking levels, with one partial level below grade and six (6) levels above grade, including parking provided on the roof of the structured garage. The proposed garage would have accommodated 3,430 parking spaces. The revised parking garage design will include seven (7) parking levels with all levels above grade, including parking provided on the roof of the structured garage. The revised garage will accommodate a total of 3,388 parking spaces. There will be two dedicated public elevators extending to all levels of the public parking garage as well as escalators traversing levels 1-4 at the valet and main public entry into the garage. On the west end, four additional elevators will be provided for the full height of the garage. The at-grade level at the north will consist of a valet and concierge public space that serves all parkers of the garage. This valet area will consist of finishes consistent with hospitality requirements, and will have soft seating, restrooms, casework/millwork, and architectural improvements to provide a luxury experience at the valet. The proposed garage is naturally ventilated above grade. The structure will be fully sprinkled per code requirements. There will be multiple exit stairs within the garage. The exterior materials will be complementary to the entire Grandscape development and will include stone, metal mesh screens, metal panels, and wood-look Longboard cladding. Structured branding and advertising are designed into the exterior of the building without affecting the natural ventilation. This branding and advertising may be digital or still. Mass grading and site preparation has already begun, and other infrastructure improvements are expected to be underway in summer 2017. Future phases of the Grandscape Lifestyle Center will be presented before the Commission and City Council for review and approval as the tenant 3 10

specifications and other design parameters (site layout, parking distribution, interior connectivity, pedestrian access etc.) is finalized. Existing Condition of Property The subject property is currently undeveloped. Platting Status The property is platted as part of Lot 3, Block A, Grandscape Addition Phase II. Infrastructure Improvements The City is not planning any specific public infrastructure improvements for this area. Circulation and Parking Garage 3 under Area 2A will provide 3,430 parking spaces Landscaping and Irrigation Area 2A parking garage has been proposed with heavy landscaping. Pacific Sunset Maple, Oklahoma Redbud, Desert Willow, Texas Red Oak, Allee Elm, and Magnolia are to name a few canopy or over-story trees proposed. Deciduous and evergreen shrubs are proposed for parking garage perimeter landscaping. Development Review Committee Review The DRC finds that the Area 2A Development Plan meets all applicable requirements of the Grandscape PD Ordinance, and therefore recommends approval. 4 11
