Social Media & IDX: IRMLS is getting a lot of questions related to listings posted on Social Media. Offices/Listing Agent can post their own listings on social media in accordance with Indiana License Law and MLS rules but they CANNOT post other offices listings on social media without the express permission of the Listing Office/Listing Agent. IDX Policy gives MLS Participants permission to display each other s listings on their websites. MLS Participants/Agents may NOT use IDX provided listings for any other purpose other than IDX display. Section 18.2.2 MLS participants may not use IDX-provided listings for any purpose other than display as provided for in these rules. This does not require participants to prevent indexing of IDX listings by recognized search engines. Additionally, IDX provided data may not be used for any other purpose or provided to any other person/vendor outside of the member and vendor who signed the data licensing agreements. Providing vendors or anyone with MLS logins and passwords is in violation of IRMLS rules and users are subject to a $1,000 fine per occurrence. Section 18.2.6 Except as provided in the IDX policy and these rules, any IDX site or a participant or user operating an IDX site or displaying IDX information as otherwise permitted may not distribute, provide, or make any portion of the MLS database available to any person or entity. MLS Mobile & RETS Refresh: Every Wednesday sometime between 8 am and 5 pm, Black Knight does a RETS refresh. During the refresh, access to MLS Mobile, the RETS server and other RETS related integrations will be briefly interrupted. GOVERNOR HOLCOMB LAYS OUT LEGISLATIVE PLANS IN STATE OF THE STATE Governor Eric Holcomb this week addressed the Indiana General Assembly in his first State of the State address. Holcomb outlined his agenda to improve Indiana s prosperity. He led by praising the state s business environment and pledging to preserve it. How? By maintaining a balanced budget and cultivating a strong economy. Indiana currently ranks in the top 10 nationally for business environment. Other priorities include creating a long-term roads and bridges funding plan, expanding the state s pre-k pilot program, and fighting to stop Indiana s growing drug epidemic. In addition to increased road funding, Holcomb touted support for two other programs important to our IAR agenda: $4 million for the successful Regional Cities Initiative; and $10 million for expansion of the South Shore Line between Gary and Michigan City. REALTORS across the state have participated in regional planning projects funded by the Regional Cities Initiative. The South Shore Line expansion would make the Northwest region of our state more attractive particularly to homebuyers commuting to and from the Chicago area and also across the most northern tier of Indiana. These quality of life issues mean better communities for homeowners. Governor Holcomb has been a champion for REALTOR issues throughout his career. IAR members and staff look forward to partnering with him on REALTOR -friendly issues that will, in his own words, take Indiana to the next level.

BAN ON SHORT-TERM RENTALS MAKES NEWS ACROSS THE STATE The topic of short-term rentals advertised on websites like Airbnb dominated headlines across the state this week. House Bill 1133, authored by Majority Leader Matt Lehman, calls for a state preemption of local bans on short-term rentals. The bill was this week heard by members of the House Committee on Government and Regulatory Reform. HB 1133 was amended to require homeowners who offer their residence as a short-term rental to carry at least $1 million of third-party liability insurance. IAR supports the provision that prevents local units from banning short-term rentals, however, the insurance provision is problematic. Carmel homeowners testified against HB 1133. The Carmel City Attorney, also opposing the bill, told legislators that Carmel residents who were currently offering their homes for short-term rental would be receiving a letter informing them that this practice was in violation of local zoning laws and that they had 10 days to remove their listing from sites like Airbnb, HomeAway, and VRBO. The city is carrying the water for the anti-competitive hotel and motel industry, which sees online rental options as rivals. IAR has long-advocated that a robust rental community offering diverse options for consumers seeking shortterm accommodations is good for the economy, tourism, and especially propertyowners. REAL ESTATE RELATED BILLS MOVING THIS WEEK Senate Bill 152: This bill, authored by Sen. Jim Merritt of Indianapolis, would provide local governments with additional tools to redevelop blighted and abandoned neighborhoods. The bill was amended in committee. The word governmental was added to the description of liens which the property would need to be free of before being obtained by redevelopment commissions. House Bill 1260: This bill, authored by Rep. Ed Soliday of Valparaiso, would allow Indiana rail carriers, or rail carriers authorized to operate in Indiana, to take property to expand their rail line only if they can prove that it will be used for the public good. The bill contains a provision to help facilitate dual tracking of the South Shore Line from South Bend to Chicago. This bill passed the House Committee on Roads and Transportation with a vote of 10-1. Senate Bill 558: This bill was this week introduced by Sen. Travis Holdman of Markle. It contains a number of landlord/tenant provisions, but most importantly to our members, it would prohibit local governments from controlling rental rates through a zoning ordinance unless the General Assembly authorizes such; also known as exclusionary zoning. SB 558 has been assigned to the Senate Committee on Civil Law. Senate Bill 310: Sen. Brandt Hershman of Wheatfield authored this bill, which would authorize third-class cities in Indiana to create land banks. Land banks are an important tool for local governments seeking to revitalize and manage blighted neighborhoods. SB 310 is scheduled to be heard next Wednesday, Jan. 25 by members of the Senate Committee on Local Government.
