CHAPTER D-11 An Act respecting the Department of Co-operation and Co-operative Development Short title 1 This Act may be cited as The Department of Co-operation and Co-operative Development Act. R.S.S. 1978, c.d-11, s.1. Department continued 2(1) The department of the Government of Saskatchewan called the Department of Co-operation and Co-operative Development is continued. (2) The Minister of Co-operation and Co-operative Development shall preside over the department. R.S.S. 1965, c.25, s.2; R.S.S. 1978, c.d-11, s.2. Staff 3 The staff of the department shall consist of a deputy minister, to be called the Deputy Minister of Co-operation and Co-operative Development, and such other employees as are required for the proper conduct of the business of the department. Scope 4 All that part of the administration of the Government of Saskatchewan relating to bodies incorporated or to be incorporated for co-operative enterprise shall be under the control of the department. D-11 DEPARTMENT OF CO-OPERATION AND CO-OPERATIVE DEVELOPMENT Duties and powers of department 5 The department shall take such measures as the minister deems advisable or as may be required by the Lieutenant Governor in Council for the encouragement generally of co-operation and co-operative development in the province and in particular, but without limiting the generality of the foregoing, shall: (a) encourage and assist in the organization of co-operative enterprises among persons or groups who desire to provide themselves with or to market commodities or services or both on a non-profit co-operative self-help basis; (b) provide for such inspection and examination of the affairs of co-operative bodies as may be necessary to secure the due observance of and compliance with the requirements of all Acts relating to co-operation and co-operative development and any regulations thereunder; (c) institute inquiry into and collect, assort and systematize information and statistics relating to co-operation and co-operative development; (d) establish a research service for inquiry generally into the operation of co-operative enterprises and for the making of such investigation and analysis of economic, social and other problems as may be deemed advisable for the encouragement of new or improved methods or means of co-operative organization and development and, in particular, study and report upon questions relating to: (i) agricultural production and the processing and marketing of agricultural products; (ii) industrial development, manufacturing and sale by wholesale; (iii) credit, investment and business finance generally; (iv) retailing of goods and services; (v) community and other services; (e) disseminate information relating to co-operation and co-operative development in such manner and form as may be found best suited to encourage interest in the principles and practices of co-operation on a non-profit self-help basis; (f) issue such reports, circulars and other publications relating to co-operation and co-operative development as may be deemed advisable; (g) perform such other duties and provide such other services as may be designated by the Lieutenant Governor in Council. 5 DEPARTMENT OF CO-OPERATION AND CO-OPERATIVE DEVELOPMENT c. D-11 Committees and other personnel 6(1) For the purpose of this Act, the minister may, as he considers advisable, appoint committees, and engage consultants and professional and technical personnel and he may determine the duties and powers of people appointed or engaged under this subsection. (2) The minister may pay such per diem allowance, travelling expenses and other remuneration, as the Lieutenant Governor in Council may determine by regulation, to people appointed or engaged under subsection (1). 1973-74, c.23, s.1; R.S.S. 1978, c.d-11, s.6. Grants 7(1) Subject to the approval of the minister, the department may make annual or other grants, not exceeding $5,000 in any one case, to any person, agency, organization, association or institution to assist in the development, expansion or maintenance of co-operative and credit union services in Saskatchewan. (2) Subject to the approval of the Lieutenant Governor in Council, the minister may make annual or other grants in amounts in excess of $5,000 to any person, agency, organization, association or institution to assist in the development, expansion or maintenance of co-operative and credit union services in Saskatchewan. 1973-74, c.23, s.1; R.S.S. 1978, c.d-11, s.7. Loans and purchase of shares 8 Subject to the approval of the Lieutenant Governor in Council, the minister may: (a) make loans to co-operative associations and credit unions and take security in respect of such loans, and (b) purchase shares in co-operative associations and credit unions. 1973-74, c.23, s.1; R.S.S. 1978, c.d-11, s.8. Additional powers 9 The department may co-operate with any department of the Government of Canada or of Saskatchewan or of any other province of Canada, or with any other governmental body, or with any educational institution or co-operative organization, in the furtherance of co-operative development and the understanding of co-operative principles and practices. Acts administered 10 The department shall administer the following Acts: (a) The Co-operative Associations Act; (b) The Co-operative Marketing Associations Act; (c) The Credit Union Act; (d) such other Acts as may be designated by the Lieutenant Governor in Council. D-11 DEPARTMENT OF CO-OPERATION AND CO-OPERATIVE DEVELOPMENT Persons required to furnish information 11(1) All officers of co-operative corporations to which any Act administered by the department applies and all officers of credit unions shall furnish the minister with such information as he may from time to time require. (2) A person who fails to comply with a request of the minister under subsection (1) or who knowingly makes a false statement in any information furnished to the minister is guilty of an offence and liable on summary conviction to a fine not exceeding $100. Annual report 12(1) The minister shall, in accordance with The Tabling of Documents Act, submit to the Lieutenant Governor in Council an annual report respecting the work performed by the department.
