DIVISION 13. B-3 CITY CENTER COMMERCIAL DISTRICT* *Cross references: Businesses, ch. 30. Sec. 130-461. B-3 city center commercial (Old Town district). (a) (b) Purpose and intent. The purpose of this district is to provide for the proper climate to attract and retain the original city center commercial, or the Old Town district. Such a district is intended to provide an attractive and successful commercial area at the scale and intensity of use compatible with the original development of the area. It is further the intent of the city council to assist in the attempt to provide pleasant retail and professional office/commercial uses along with some residential uses, at a human scale, oriented to attracting pedestrian shoppers, tourism, and local convenience. Recognizing the economic value of the existing Old Town area, it shall further be the intention of this district to encourage the retention and rehabilitation of structures and uses in the district that have historic and/or architectural significance. Similarly, new construction in this district must respect and be compatible with the overriding intent of this district. Uses permitted by right. All uses permitted by right in the B-1 and B-2 zones (sections 130-421(b) and 130-441(b)). Antique shop. Craft shop and limited associated manufacturing activities as an accessory use. Drugstore. Educational and instructional classes with a class size less than ten students per class. Restaurant, formal and informal with pedestrian carryout, but not informal with drive-through. Retail sales activities similar to those listed in this subsection. Single-family dwelling, subject to appropriate regulations of the R-2-S zone. (c) Uses permitted subject to a special use permit: Child care center. Church, chapel, synagogue, temple or other place of worship. DIVISION 12. B-2 NEIGHBORHOOD COMMERCIAL DISTRICT* *Cross references: Businesses, ch. 30. Sec. 130-441. B-2 neighborhood commercial. (a) (b) (c) Purpose and intent. The purpose and intent of the B-2 neighborhood commercial zone is to provide office, retail, service and institutional uses at a scale and level appropriate adjacent to a suburban residential neighborhood setting. Uses permitted by right: Automatic vending machine. Bank, savings and loan institution, employee credit union. Laundromats and establishments for receiving and distributing articles for laundry or cleaning. Professional office. Professional personal service use similar to beauty parlors, barbershops. Restaurant (formal) not offering any live entertainment. Retail sales activities conducted entirely within an enclosed building with no outside display of food or any other goods or merchandise except plants and flower. Specialty Food Shop (amended 7/27/09) Uses permitted subject to a special use permit: Aerobic and dance studio for instructional classes only. Child care center. Private, parochial or religious school. Public and semipublic use. Sale of Christmas trees. Sale of fireworks. (d) Uses prohibited. All uses not specifically permitted are prohibited, including drivein facilities, exclusive of banks. (e) Screening. The B-1 professional business office zone is designed to provide office development with limited retail and institutional uses. The B-1 zone serves as a transition allowing office uses between nearby residential developments and higher intensity nonresidential uses. Establishments limited to the filling of prescriptions and sale of pharmaceutical and related medical supplies and equipment. Independent retail sales activities within existing buildings or as independent freestanding structures provided they do not exceed 20 percent of the total gross floor area of the principal office complex. Medical, dental office, and clinics without facilities for the overnight care of patients. Offices for business or professional use. Printing and copying service, not exceeding 7,500 square feet total gross floor area. Telecommunications office and support service. Uses permitted subject to a special use permit: Child care center. Church, chapel, synagogue, temple or other place of worship. Accredited educational and vocational training facility. Funeral chapel, mortuary, excluding crematory. Hospital.
