At 5:40 pm, motion by Dale Bly, seconded by Marianna Redner to open the Planning Board Meeting. All yes, motion carried. Review of minutes Motion by Mike Quattrini, seconded by Marianna Redner to accept the December 5, 2017 meeting minutes amended as follows: to add the answer to Mary Lou Walker s question that the land has not been sold. All yes, motion carried. 1.) Brad Kapral, applying for a 2.75-acre subdivision from his 73-acre lot off Brown Road/Orchard Dr. Tax map: 336.00-01-012.111- The required Public Hearing was held at the December 5, 2017 meeting, however, due to an error in the maps the plats had to be redrawn. The new maps have been revised and corrected. At the December 5, 2017 meeting the Planning Board reviewed the submitted, claimed itself as lead agency, stated that they will conduct a coordinated review and had determined that the proposed action will not be a threat to the environment. A negative declaration was done at the time of approval of Conditional Use Permit. Motion made by Dale Bly, seconded by Marianna Redner, to approve the plats as submitted and authorize the Planning Board Chair to sign the maps. All yes, motion carried. Reminder to applicant that he has sixty-two days to file maps with the Steuben County Clerk. 2.) Loren VanCuren, subdivision of property Tax map: 319.00-01-037.100 & 319.00-01-083.000- On September 26, 2017 Mr. VanCuren had subdivided part of his land, however, at that time he was unable to file the final plat with the Planning Board chair. He was given thirty days from 09/26/2017 to provide the final plat. Due to a problem with the abstract of the parcel, he is now asking for additional time to get this completed.

2 P age Motion by Mike Quattrini seconded by Dick Pope to approve thirty more days from 01/23/2018 for Mr. VanCuren to bring the unchanged plat to the Planning Board for Chair Bennett to sign. All yes, motion carried. 3.) Southern Tier Storage, East Corning Road Tax map: 336.00-02-073.000- Applicant would like a Conditional Use Permit to change the existing mobile home that sits towards the front of the property into a mixed-use facility that has one apartment and a small retail store. Completed on 07/25/2017 and is on file for viewing. Public Hearing At 5:57 pm Chair Bennett opened the Public Hearing. At 5:58 pm Chair Bennett closed the Public Hearing. No comments offered. Motion by Dale Bly seconded by Marianna Redner to approve a Conditional Use Permit for Southern Tier Storage to change the existing mobile home to a residential / business use with no conditions attached. All yes, motion carried. 4.) Debbie Button, subdivision of Katherine Ellison s property on the Ellison Road, Town of Corning. Tax map: 353.00-03-009.111- Ms. Button is requesting to subdivide a 2-acre lot from her mother s 44.60-acre lot. (Mrs. Ellison provided a letter of permission for her daughter, Debbie Button, to subdivide.) Submitted plat shows that all setbacks are met. Also, STC and Town Code Officer previously spoke to Ms. Button about future subdividing of the land to ensure that no land locked parcels are created. Public Hearing At 6:01 pm Chair Bennett opened the Public Hearing. At 6: 02 pm Chair Bennett closed the Public Hearing. No comments offered. Motion by Marianna Redner seconded by Dale Bly for the Planning Board to declare itself as lead agency and classify this as an unlisted action. All yes, motion carried. Planning Board went through the Short Form EAF. Motion by Mike Quattrini seconded by Dick Pope that the Board determined this action will have a negative environmental significance. All yes, motion carried.

3 P age Motion by Dale Bly seconded by Marianna Redner to approve the plat as presented and to authorize Chair Bennett to sign the stamped plats. All yes, motion carried. Applicant was advised that she has sixty-two days to file plats with the Steuben County Clerk. 5.) Dale Leonard, 3150 Gorton Road-request for recommendation to ZBA for an area variance. Tax map #: 319.00-01-045.120- Mr. Leonard is planning to erect a larger garage in the same location where a building currently exists. He would like to place the building twenty-feet from the side lot line, however he is in a R-1 zone where requirement is a fifty-foot setback. The submitted action is a Type II action, with no further review needed. Motion by Mike Quattrini seconded by Dale Bly that this request is an automatic referral to the Zoning Board of Appeals, from the ZBA to the Planning Board, consistent with the Comprehensive Plan and is not detrimental to the neighborhood. All yes, motion carried. 6.) Guthrie Hospital, 1 Guthrie Drive-submitted a revised site plan, still in the preliminary stage. Tax map #: 319.00-01-020.200- The revised site plan appears to have addressed many of the concerns from previous meetings. Joe Middleton, Jody Allen, and Doug Bailey were present to address questions pertaining to the revised site plan. Board members reviewed the presented SWPPP. Town of Corning has hired Hunt Engineering to review preliminary site improvements over the concept plan Storm Water Mitigation Plan. Janet Thigpen, Flood Plain Mitigation expert has also reviewed the revised site plan. Jody Allen stated that there will now be 229 parking spaces, which is over the required amount. Extensive storm water analysis has been completed. Flood plain development permit discussed. Water and sewer will be tied in to existing town water and Chemung County sewer. Proposed lighting is similar to the original building. Signage, landscape plan and hours of operation of the building were discussed. All involved and interested agencies that need to be notified of Guthrie s proposal are as follows: a) Town of Big Flats b) Steuben County (239-m needs to be sent to Bath) c) Town of Corning Town Board

4 P age d) East Corning Fire Dept e) NYS DOH f) Chemung County Sewer g) Dominion Gas h) Southern Tier Network-fiber provider i) Corning Natural Gas j) Neighborhood Association k) NYS DEC l) NYSEG m) Town of Corning Water Department Motion by Dale Bly seconded by Marianna Redner for the Planning Board to claim itself as lead agency, classify this as an unlisted action and consider the application to have a coordinated review. All yes, motion carried. Dominion Encroachment Agreement Dominion has a standard encroachment agreement that sets forth limitations and use of certain types of construction equipment, except for limitations that are directed towards certain levels and types of excavation. This is all directed towards safety. The Dominion r-o-w R-O-W has a 26-inch pipeline and a 30-inch pipeline within it. They also stipulate a list of equipment which can be used and describes certain conditions where hand digging is required. An additional section requires that Dominion be notified of any work in advance and to have a Dominion rep on site during any work within the r-o-w. Guthrie is committed to deliver a 6-week look-ahead work schedule in advance and in February will be scheduling a preconstruction meeting with Dominion as to what will be happening and to review the equipment that will be used. Within that there is certain equipment, construction techniques that are absolutely disallowed. Dominion also reserves the right to have access to the pipelines after the parking lot is constructed and Guthrie is to assume responsibility for any reconstruction of pavement, landscaping, etc. Motion by Dale Bly seconded by Dick Pope to deem this preliminary site plan as complete and to schedule a Public Hearing for 02/27/2018 at 5:30 pm. Motion carried, all yes. 7.) Corning Town Board Supervisor Feehan conveyed to the Planning Board that she would like to improve communication between the two boards and stated that the Town is willing to give each Planning Board and Zoning Board member a town issued email for better communication.

5 P age Another item is the updating of the Zoning Law. Existing law will be red-lined and forwarded to Planning, ZBA and Town Boards to review. Currently the Planning Board has only 5 of the required 7members vs. 7 and the ZBA has 3 4 of 5 vs. 5. The Town Board can amend this to be permanent if all three boards agree is considering reducing the permanent Planning Board membership to 5 members and the ZBA to a 3-member Board. 8.) Other Business Procedural Changes- -CEO Coons stated that there will be a procedural change in the process. The proper order is to establish yourself as lead agency, determine if uncoordinated or coordinated and then complete the. Variances-the Planning Board does not give a recommendation on approval or denial, rather an Advisory Opinion on whether it is consistent with the language of the Town s Comprehensive Plan or if it is a detriment to the neighborhood. Also, subdivision procedurals from now on must have completed signed plats at the Planning Board Meeting or the plat will be deemed a preliminary or concept plan and applicant would have to come back with the final plat for approval. This also will be affecting the publishing time of the public hearing legal ad for subdivision. Training-there are several classes coming up. Secretary will forward options to members.
