APPROVAL OF THE April 3, 2013 MINUTES Moved by Larry Thomsen, seconded by Councillor Cindy Jefferies Resolved that the meeting Minutes of Wednesday, April 3, 2013 be adopted as transcribed. 2. NEW BUSINESS A. Planning Department Public School Site Lot 49MR, Block 4, Plan 092 0662 A Subdivision Application has been received to create a parcel for a new Red Deer Public School Board Elementary school and City of Red Deer Public Library from the existing municipal reserve lot in the Timberlands neighbourhood (Lot 49MR, Block 4, Plan 092 0662) Dayna Nebozenko, planner, presented the report. Moved by Councillor Cindy Jefferies, seconded by Peter Holloway, the proposed application satisfies the requirements of Whereas, submissions from landowners and referral agencies were presented to and considered by the subdivision authority as outlined in the subdivision report dated April 3, 2013; Therefore, the subdivision authority, being the City of Red Deer Municipal Planning Commission, approves the subdivision application subject to the following conditions: 1. Subdivision by plan of survey;

Prior to registration of the plan of subdivision, the Owner shall register a restrictive covenant on title to proposed lot 1, block 2, and, if necessary, proposed lot 14, block 1, satisfactory to the City Solicitor, which ensures that future development complies with all applicable Electric Utility Codes and regulations; 6. Municipal reserves, being approximately 2.542 hectares, are to be provided as shown on the approved sketch. 0.742 hectares of municipal reserve over dedication will be credited toward reserve dedication required in future phases of the NE ¼ Sec 2, Twp 38, Rge 27, W4M. Note: An existing deferred reserve caveat (DRC) on the SE ¼ Sec 2, Twp 38, Rge 27, W4M will be transferred/combined with outstanding reserves owed on the NE ¼ Sec 2, Twp 38, Rge 27, W4M when the final subdivision in the SE ¼ is approved. 6 April 10, 2013 Minutes, the proposed application satisfies the requirements of Whereas, submissions from landowners and referral agencies were presented to and considered by the subdivision authority as outlined in the subdivision report dated March 28, 2013; Therefore, the subdivision authority, being the City of Red Deer Municipal Planning Commission, approves the subdivision application subject to the following conditions: 1. Subdivision by Plan of Survey; 2. All outstanding taxes to be paid, or satisfactory arrangement for payment thereof, to the City of Red Deer; 3. Concurrent registration of utility easements and/or right-of-ways as required by the City of Red Deer and ATCO Gas; 4. As the proposed development is in close proximity to an existing storm main, one of two options must be met, satisfactory to Engineering Services Customer Service section: a. The current 1.83 metre right-of-way on the western edge of the property (Plan 792-0559) needs to be expanded to 3.0 metres from property line by registering a new 1.17 metre easement next to the existing easement, or; b. The owner must demonstrate the existing storm main is in satisfactory condition to allow a development in such close proximity. This can be accomplished by contacting the wastewater superintendent at 403-342- 8750 to set up a work order to video inspect this section of the storm sewer main. The video inspection will be used to determine if this storm main will require any repairs to maintain its service life. Should repairs be required the work will be scheduled and completed by City forces, at the City s expense. However, construction of the building foundation adjacent to any storm main repairs could not proceed until all required work had been completed. NOTE: Municipal reserves are not required as part of this subdivision as they were previously provided (MGA s.663 (d)).

Planning Department 5002 43 Avenue Lot Block 6, Plan 6245S Peter Lavigne A Subdivision Application has been received to create two parcels from an existing parcel at 5002 43 Avenue in the Michener Hill neighbourhood that would facilitate the construction of a new single detached dwelling (Block 6, Plan 6245S) Jordan Furness, senior planner, presented the report. Moved by Jim Marke, seconded by Councillor Cindy Jefferies, the proposed application satisfies the requirements of Whereas, submissions from referral agencies were presented to and considered by the subdivision authority as outlined in the subdivision report dated April 2 nd, 2013; Therefore, the subdivision authority, being the City of Red Deer Municipal Planning Commission, approves the subdivision application, with each lot having a depth of 24.69 metres, subject to the following conditions: 1. Subdivision by Plan of Survey; 2. Outstanding taxes to be paid or arrangements for payment thereof to the satisfaction of the City of Red Deer; 3. Concurrent registration of utility easements and right-of-way plans to the satisfaction of the City of Red Deer and ATCO Gas; 4. The applicant to enter into joint agreements between the two properties addressing drainage and if services will cross private land, a joint servicing agreement, with the City registered as a third party on both agreements, satisfactory to the City Solicitor.
8 April 10, 2013 Minutes Note: 1. No municipal reserves are required as part of this subdivision (MGA 663(c)). 2. A geotechnical report has been received but will not be reviewed until a development permit has been applied for showing details of a proposed development. 3. An indemnity agreement for developing within the escarpment area would be required, at time of development, between the owner and the City of Red Deer. 4. Due to restricted sigh lines, it is recommended that the new access for the northerly lot be placed at the north end of the proposed lot 15. 3.
