Roll call of members: The following members were present: Wade Schexnaydre, Ken Firmin, Julio Dumas, Morrie Bishop, and Mathew Pryor The following members were absent: Aaron Chaisson Jr. and Anthony Christy III. C) Zoning Review ID PZ-1856.18 Conditional Use for Telecommunication Tower for Ralph J Stassi Jr. application submitted by New Cingular Wireless, PCS, LLC d/b/a AT&T Mobility Located on the north side of Lemanville Cutoff Road approximately 1350 east of the LA Hwy. 3120 to request a conditional use to construct a new Telecommunication Tower. Board Member Julio Dumas recused himself from this agenda item due to a conflict of interest. Mrs. Natalie Maples from Baker Donalson Attorney Office representing New Cingular Wireless, PCS, LLC d/b/a AT&T Mobility. Mrs. Maples presented a request for a Conditional Use permit to construct a new Telecommunication Tower and a variance for setback based on proposed tower is within a distance equal to 100% the height of the tower plus thirty (30) feet. Public hearing was opened. No one spoke during public comment. Public hearing was closed Commission Action: A motion was made by Morrie Bishop and seconded by Wade Schexnaydre to APPROVE to the request for a Conditional Use permit and the variance for setback based on proposed tower is within a distance equal to 100% the height of the tower plus thirty (30) feet. Rezoning Criteria: The applicant is requesting to rezone property from Medium Intensity (RM) to Mixed Use 2 (MU2). The property is located on the southeast corner of LA Hwy 73 and Post Office Road. The Zoning Commission has reviewed several petitions to rezone to commercial along LA Hwy 73 within the last year. The Zoning Commission had a Public Hearing on Petitioned property in May 2017. 8. Staff recommends: Mixed Use 2 (MU2) maybe an option for petitioned property.

Rezoning Criteria: The applicant is requesting to rezone property from Medium Intensity Residential (RM) to Mixed Use 2 (MU2). The property is located on the southwest corner of Alice Braud has a road width of approximately 12 feet along the front of property. The existing Mixed Use 2 (MU2) designation along the west side of LA Hwy 73 is approximately 530 feet north from the petitioned property. The applicant has expressed an interest for office space or retail business. The Zoning Commission has reviewed several petitions to rezone to commercial along LA Hwy 73 within the last year. The Zoning Commission had a Public Hearing on petitioned property in August 2016 8. Staff recommends: To deny the Mixed Use 2 (MU2) as requested. It is not recommended to rezone away from inter-section with Zoning District being continuous along the west side of LA Hwy 73.
