WHEREAS, Developer proposes to construct 1,152,000 square feet of office, 215,000 square feet of retail, l,030 multi-family residential units, and 190 hotel rooms, or their equivalent pursuant to the terms of the Downtown Development of Regional Impact (the "Project") as referenced in the draft Development Agreement; and WHEREAS, City Council has adopted Ordinance No. 88-144, implementing the Florida Local Government Development Agreement Act pursuant to Florida Statutes Section 163.3220-163.3243, and has established procedures for approval of development agreements; and WHEREAS, the City believes it is in the best interest of the citizens of the City of Tampa to consider entering into a Development Agreement, by and between the City of Tampa, Florida, a municipal corporation organized and existing under the Jaws of the State of Florida (the "City") and the owner of the property, Strategic Property Partners, LLC ("Developer"); and WHEREAS, it is necessary to set two public hearings to consider the approval of the Development Agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMPA FLORIDA: Section l. That two (2) public hearings be held by the City Council of the City oftampa, Florida, on August 23, 2018, at 10:30 a.m., or as soon thereafter as the matter can be heard, and September 6, 2018, at I 0:30 a.m., or as soon thereafter as the matter can be heard, in Council Chambers, Third Floor, City Hall, 315 East Kennedy Boulevard, in the City oftampa, Florida, at which public hearings all parties in interest and citizens may appear and be heard as to any and all matters pertinent to the proposed Development Agreement. Section 2. That the Developer is hereby directed to publish the attached notice (or substantially similar notice) of City Council's intent to consider the proposed adoption of the City of Tampa Development Agreement for Strategic Property Partners LLC in a newspaper of general circulation and readership approximately eight (8) days prior to each public hearing. The Developer is hereby directed to mail, approximately seven (7) days prior to the first public hearing, notice of City Council's intent to consider the proposed adoption of the Strategic Property Partners, LLC Development Agreement to all property owners, according to the latest ad valorem tax records, within a distance of one hundred fifty ( 150) feet in all directions from the property to which the Strategic Property Partners LLC Development Agreement applies. Both the newspaper notices and individual notice shall specify: (l) the location of the land subject to the Strategic Property Partners LLC DeveloQment Agreement, (2) the development uses proposed on the property, (3) the proposed population densities and building intensities, (4) the proposed building height, and (5) that a copy of the proposed Strategic Property Partners LLC Development Agreement can be obtained at the office of the City Clerk of the City of Tampa. Section 3. That as a condition precedent to the public hearing, Petitioner shall provide evidence of having published said notice in accordance with Section 2 ofthis Resolution. Evidence shall be made by affidavit with proof of publication filed with the City Clerk not less than three (3) days prior to the date of the public hearing. In the event that proof of publication is not timely filed, City Council shall re-set the hearing for a new date and the Petitioner shall be required to.again publish notice and provide proof thereof as required above. The proposed Development Agreement for the above described property would allow the Developer to construct the following: 1,152,000 square feet of office, 215,000 square feet of retail, 1,030 multi-family residential units, and 190 hotel rooms, or their equivalent pursuant to the terms of the Downtown Development of Regional Impact, with a proposed building height of up to 350 feet as approved by the Federal Aviation Authority and Hillsborough County Aviation Authority, subject to the terms and conditions of the Development Agreement. A copy of the proposed Development Agreement may be inspected by the public in the office of the City Clerk, 315 E. Kennedy Boulevard, Third Floor, City Hall, Tampa, Florida 33602, between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday, except holidays.
