ABATEMENT OF PUBLIC NUISANCE AT 3820 3rd STREET WHEREAS, the property loated at 3820 3 Street, Des Moines, Iowa, was inspeted by representatives of the City ofdes Moines who determined that the fire-damaged main struture in its present ondition onstitutes not only a menae to health and safety but is also a publi nuisane; and WHEREAS, the Titleholders, Paul Phanmaha and Silisone Phanmaha, were notified via personal servie more than thirty days ago to repair or demolish the fire-damaged main stmture and as of this date has failed to abate the nuisane. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES MOINES, IOWA: The fire-damaged main struture on the real estate legally desribed as Lot 7 Blok 1 1 in HIGHLAND PARK, an Offiial Plat, now inluded in and fanning a part of the City of Des Moines, Polk County, Iowa and loally known as 3820 3 Street, has previously been delared a publi nuisane; The City Legal Department is hereby authorized to file an ation in distrit ourt to obtain a deree ordering the abatement of the publi nuisane, and should the owner(s) fail to abate the nuisane, as ordered, that the matter may be referred to the Department of Engineering whih will take all neessary ation to demolish and remove said struture. If proedures to vaate the premises are not undertaken immediately upon reeipt of this notie, and in no ase later than seven (7) days, the City will issue a Muniipal Infration in aordane with Setion 60-304 and 60-306 pursuant to the Muniipal ode of the City of Des Moines. Additionally, if the property had a Certifiate of Inspetion, it is hereby revoked. Attahed is a listing of the violations existing on the date of the inspetion and a reommendation as to the remedial ation required to orret suh violations. The violations noted must be orreted within 30 days from date of notie. Failure to orret these violations will result in a request to the City Counil, sitting as the Board of Health, to approve legal ation. As a result of this publi nuisane ation there will be osts inurred by the City. Costs will be billed out when the nuisane has been abated. Failure to pay the osts will result in olletion by assessment to the property or personal judgment.
