LAMBETH HOUSING TEMPORARY ACCOMMODATION TERMS & CONDITIONS This Licence is granted by Lambeth Housing Services and by signing this agreement you are agreeing to the terms and conditions set out below. Your room is furnished. The furniture inventory (if filled in) is: Inventory of Room Inventory of Room Bed Wardrobe Chest of drawers Table Chair Fridge Curtains (net & heavy) Cooker (if applicable) About your licence We give you your licence to Temporary Accommodation under Part VII of the Housing Act of 1996. You are a licensee resident, not a Tenant. You have none of the legal rights of a tenant. YOUR ACCOMMODATION 1. We can change the rooms we give you or transfer you to other Temporary Accommodation at any time without giving you notice. 2. We can enter your room at any time but will respect your need for privacy where this is possible. 3. We can change or withdraw any service we give you (including furniture) at any time. ENDING YOUR LICENCE As a licensee resident you have no rights under the Protection from Eviction Act of 1977. We can end your licence at any time on reasonable notice, but we will end it without notice if your breaches are serious and in our view require your urgent removal. We don t have to go to court if we want to evict you. Our Duties While you have a licence our duties are: Repairs 1. To keep in reasonable repair the inside and outside of the building. 2. To repair and keep in good working order equipment which supplies the heating, water, gas, electricity and sanitation. We are not responsible for repairing anything that you have damaged see your duties below. Nuisance 1
We will use our reasonable endeavours to stop any nuisance that prevents you from enjoying your accommodation in peace and quiet. Charges Your licence agreement will tell you the charges for your accommodation. We can only change these charges after giving you one week s notice in writing. Accommodation Charges Your Duties Your accommodation charge will be either one night or one week at a time. You must pay your amenity charges, and any accommodation charges that are not covered by Housing Benefit, weekly. We will give you a Swipe Card to pay your charges. If you fail to make payment as and when due it is likely that we will evict you. Housing Benefit You must fill in a housing benefit form before we will give you accommodation (staff will assist you). If, exceptionally, you are allowed into the accommodation before you have done this you must fill one in as soon as possible and in any case when required to do so by one of our officers. You must also provide proof of income i.e. Income support Book, Job Seekers Allowance, Child Benefit book within 14 days of admission. TV Licence We do not pay for television licences. You are responsible for paying for your own TV licence and are obliged to notify the TV licensing office once you have changed address. Change in your Circumstances You must inform staff if there is a change in your circumstances that could affect your need for accommodation (e.g., additions to your household, persons who have left your household, changes in medical conditions, or if you have alternative temporary accommodation, etc.) You must tell the hostel staff straight away. Looking After Your Accommodation You must keep your accommodation clean and tidy. You must take care of furniture and any other items that we lend you. You must not dismantle or remove any of the fixtures, fittings or furniture of the property. You must keep the interior of the property, fixtures, fittings and furnishings in good repair and proper working order (fair wear and tear excepted). At the end of the licence you must give back the property (together with all fixtures, fittings and furnishings in the property) to the Council in the same condition as at the start of the licence, replacing or repairing any damaged or missing items to the Council s reasonable satisfaction. You must not undertake any decorations or alterations or additions to the property whether structural, internal or external. You are not permitted to knock into any internal or external wall or to hang pictures which may cause damage to the decorations. You must not erect any satellite receiving equipment or radio aerials to the property. After you have finished using a shared bathroom, toilet or kitchen you must leave it clean and tidy. You must remove all of your rubbish properly. You must notify us immediately of any defect or problem with the property for which you as the licensee are not responsible for under this agreement. 2
Note: You will be liable for damage caused wilfully or otherwise to the property, whether by your or any of your visitors. This may include such things as damage to doors, windows, radiators, furniture, fixtures and fittings and sanitary ware. The hostel staff will decide if the repair is one which you will be recharged for. Children You must keep control of your children at all times. You must never leave them unsupervised in the hostel. Additional furniture Your accommodation is adequately furnished for your use. You are not permitted to bring any additional items of furniture into your room unless you get written permission from your Hostel Officer to do so, e.g. a child s cot. Please note that should we agree to this that these items must be removed when you vacate (see Leaving your accommodation at the end of this agreement) Visitors Your visitors are permitted on the premises between 8am and 10pm only. Visitors who are not on your housing application are not allowed to stay overnight. Your visitors MUST NOT be left alone on hostel premises, nor do they have access to facilities such as bathrooms and kitchens when you are not there. You are responsible for ensuring that they do not cause a disturbance or nuisance anywhere in the hostel premises or in the immediate vicinity. Fire Safety You must do everything you can to stop the risk of fire. You are not permitted to use extensions leads/sockets in your room. If you or anyone who lives with you or visits you interferes with fire-fighting equipment, we will you evict you immediately. Candles are not to be used in your room. You are not permitted to use chip pans. Animals Animals or pets are prohibited in any part of the hostel. Keys If you lose your keys then you will have to pay for the cost of cutting new ones. Weapons You are not allowed to keep any offensive weapons on the premises, including knives which would not be considered for normal kitchen use, guns and swords. Smoking Policy You are not allowed to smoke in the communal areas of the hostel, including shared bathrooms & kitchens. You are allowed to smoke in your room. Insurance The London Borough of Lambeth is not responsible for loss or damage to any of your personal belongings. You are advised to bring a small amount of personal belongings with you and to keep most of your belongings in storage. You are advised to take out contents insurance for any valuables that you bring with you into hostels. 3
Causing a Nuisance You must not do anything or let your visitors do anything, which annoys or causes a nuisance, or may have this effect to other people who live in the accommodation, your neighbours or people living in adjoining properties. You must not harass or allow your visitors to harass or disturb other people who live in the accommodation or neighbours or people living in adjoining properties. You must not harass anyone because of his or her race, colour, religion, age, sex, sexual orientation or disability. You must not play or let your visitors play any audio equipment or instruments including radios, televisions, cassette recorders, CD players so loudly that they can be heard outside your accommodation/room. You must not at anytime be or threaten to be violent, or allow your visitors to be or threaten to be violent towards other people who live in the accommodation, their visitors or staff. Your home must be used for residential purposes only and cannot be used to conduct business. You must not conduct any illegal activity on the premises including the possession of drugs and/or firearms. Holidays/Being Away from the Hostel Due to the temporary nature of your accommodation you must request permission from the Hostel Manager should you wish to go on holiday or be away from the hostel for any reason. You will normally be granted up to two weeks. If you plan to be away for a longer period then you will be required to vacate the hostel. In such cases you will have to clear your room of personal belongings, your licence agreement will be ended and you will have to re-apply to the homeless department when you return. Leaving your accommodation When you leave your room it must be clean and tidy. It is your responsibility to remove all of your rubbish. You will be re-charged for any missing or damaged items, or if we have to clean your cooker and fridge after you have gone. You must take all of your belongings with you. If we have to store your belongings then we will charge you for the removal and storage. We will not store any large items of furniture, e.g. sofas which you may have brought into the room. Any such item left behind will be immediately disposed of. The Council may take whatever lawful action it deems necessary to deal with any goods left behind, including selling them to pay for the cost of removal and storage and to pay any rent arrears left on your account. Complaints If you have any complaints then tell the Temporary Accommodation staff in the first instance. London SW9 9SP I Agree (by signing my licence agreement): 1. To use the accommodation as my only home 2. Not to run a business from the accommodation 3. Not to use or let my visitors use the accommodation for any illegal purposes 4. To be responsible for my own personal belongings 5. To clean and maintain the accommodation and take care of furniture and any other things given to me 6. Not to have any pets 7. Not to allow any other people other than those who are authorised to do so to live in my accommodation. To keep to the terms and condition in this licence agreement for as long as I live at the accommodation Ending of the Licence The licence can be ended if 1. You fail to make payment for your accommodation when it is due 2. You fail to provide proof of income within 14 days 3. You fail to keep to the terms of this licence 4. You or your visitors cause serious and/or persistent nuisance/harassment to other people, neighbours and staff 5. You either no longer need or do not want the accommodation Licensee I have read and understood the Terms and Condition of my Licence Agreement and by signing the licence agreement I agree to abide by these Conditions while living in Temporary Accommodation 5
