VILLAGE ESTATES CONDOMINIUM TRUST RULES AND REGULATIONS 2008 A condominium community is like a small town. As residents of a small town enact laws through their selectmen, you adopt rules and regulations through your Board of Trustees to promote general well being and the common good. Please keep in mind that everything at Village Estates outside of your own four walls is owned and enjoyed by us all. Individual tastes and habits vary widely, therefore it is requested that you follow the rules respectfully and show courtesy toward your neighbors in order to promote a pleasant atmosphere in which to live. Your Board of Trustees has adopted the following Rules And Regulations in accordance with the provisions of the Trust Documents and Master Deed. These Rules and Regulations supplement the Trust Document and Master Deed. Provisions of those documents rule in any areas not specifically covered below. These Rules and Regulations become effective as of the date signed below and supersede all other Rules and Regulations previously adopted by this and previous Boards of Trustees. When appropriate, the Board of Trustees or the Management Company may elect to warn unit owners, verbally or in writing, before levying a fine for violation of the Rules and Regulations. However, there is no requirement to issue warnings before levying fines for violations. Dissemination of this document is considered sufficient notice of the Rules and Regulations and the consequences of violations. If a unit owner observes a violation, notice of the violation must be sent to the Management Company in writing and must include the date and time the violation was observed. If the unit owner observes a violation that the unit owner feels is causing an emergency, the unit owner should call the Management Company or local police, fire or other appropriate authorities.

Any unit owner found in violation of the Rules and Regulations will receive notice from the Management Company or the Board of Trustees. The unit owner may submit evidence of any extenuating circumstances, and subsequently the Board of trustees will allow a hearing on the violation. The decision of the Board of Trustees on violations is final. Unit owners should be aware that a fine for a violation of the Rules and Regulations constitutes an assessment as is the condo fee. Like unpaid condo fees, unpaid fines could ultimately result in a lien enforcement action by the association. **************************** I. Buildings and Grounds A. Common property: Except for the inside of your unit as defined by the Master Deed, Village Estates is owned in common by all unit owners i.e. the Association. Decks and stoops are owned by the Association, though the unit owner has right of exclusive easement from the Association. Unit owners are liable for all damage done to the common property by themselves, their children, guests, lessees, pets. Offenders will be assessed fines for specific violations listed below and will be assessed the cost of repairing damage.. B. Storage 1. Personal property and property being used by unit owners must be stored within unit owners units, with the exception of lawn furniture, barbecue grills and other items appropriate for outdoor use on decks or on patio areas below decks. 2. Nothing may be attached to building exteriors with nails, staples, screws, glue or any other device. This includes, for example, external wiring, antennae, canopies, flag poles, and flag pole holders, brackets for hanging plants or anything else. The Village Estates Master Deed dictates that the architectural and structural integrity of the buildings and units shall be preserved without modification. No addition, projection, decoration may be attached to any unit. As specified above, awnings and satellite dishes no may be attached with permission from the Board of Trustees and according to specific protocol for Village Estates. There shall be change of any window, door, exterior light, door knocker, or other hardware except with identical kind. (See Master Deed). If unit owners wish to replace items exterior to the building, such as doors and windows, a written request must be submitted to the Board of Trustees before proceeding with the changes. Fine: $100 plus removal of offending items, and replacement and

repairs as necessary. 7. There shall be no feeding of birds or any wild animal within 50 feet of the buildings at Village Estates. This rule includes bird feeding stations as well as any other means of distributing food out doors such as strewing it on the grounds. E. Waste management 1. Do not litter the grounds or place trash anywhere except in the dumpster. Items too large for the dumpster must be removed by unit owners at their own expense. Do not place in the dumpster any article that cannot legally be placed in a land fill, as for example: Christmas trees, oil based paint, paint thinner, batteries of any kind, tires, household appliances, computers, monitors, TVs. If in doubt, check with the town to see if the item can legally be placed in a land fill. plus the cost of removal 2. Garbage disposals are not allowed at Village Estates. 0 per violation plus cost of removal F. Common grounds 1. Activities in which balls or other articles are thrown or hit must take place far enough away from buildings and cars to ensure that no damage can be done. plus cost to repair damage 2. No activities are allowed on any planted landscaped areas such as those covered with wood chips or bark mulch. Although activities are allowed on areas covered with grass, care must be taken in these areas because the top soil is thin and the lawns are easily damaged. plus cost to repair damage 3. Yard sales and any similar activities are prohibited 0 4. Our landscaping is managed by a professional landscaper. Unit owners may not plant flowers, bushes or any other kind of plant anywhere on the common areas of Village Estates without permission from the Board of Trustees. plus cost of removal II Noise and disturbances

A. Noise and other disturbances that show lack of respect for others are prohibited. for first incident, $100 for subsequent incidents III Pets A. No animals, birds or reptiles may be kept anywhere on the property at any time. Guests and lessees are not permitted to keep any pets. (See Master Deed) B. Exceptions to Paragraph A above 1. Unit owners may keep within their own units those small fish usually found in home aquariums, and domesticated caged birds of the canary and parakeet types. 2. The keeping of a dog or cat at Village Estates is not a right, but a conditional license available only when the unit owner is in residence. This conditional license is subject to termination at any time by the Board of Trustees upon determination that a dog or cat is vicious or annoying to other unit owners or has otherwise become a nuisance. The license may also be terminated if the animal has not received appropriate vaccinations or if any other condition or reservation set forth here is in violation. A unit owner having a dog or cat at Village Estates assumes full liability for any injury to persons or damage to property caused by their animal or resulting from its presence. The conditional license to keep one dog or cat at Village Estates is granted to the unit owner subject to the foregoing and following conditions: 1. Each unit owner must register his/her dog or cat with the Management Company by providing pertinent information requested. 2. A dog or cat must be of a size that can be comfortably transported In one s arms and must not weigh more than twenty-five pounds. unit. 3. A dog or cat must be on a leash any time the pet is outside its unit owner s unit. 4. Unit owners are prohibited from caging a dog or cat or tying a dog or cat anywhere on the premises outside the unit owner s

Dog and cat owners shall make certain that their pets refrain from barking, howling, or making other noises that may disturb unit owners 7. Security A. Unit owners must provide the Management Company with a name, address and phone number of a designee who would be able to provide access to the unit in the event of an emergency. The designee should also be able to reach the unit owner when away in order to ask for instructions as necessary in the event of an emergency. B. Unit owners must tell the Management Company if their unit will not be occupied for a long time. A unit which is empty for an extended length of time may affect the master fire insurance policy for Village Estates. C. Unit owners must give the Management Company any mailing address used other than or in addition to the unit number at Village Estates in order to provide for timely notification of official communications. V. Management A. Do not direct or reprimand people hired by the Management Company as they perform their duties. If you want them to do a job or are dissatisfied with their performance, notify the Management Company in writing.

VI. Children A. No children under the age of 18 are allowed to live in any Village Estates condominium unless an adult is living with them who is responsible for them. B. Children are not allowed to mark or play on paved areas or on planted, landscaped areas covered with wood chips or bark mulch. Fine: $25 plus cost to repair damage VII. Condominium fees A. Condominium fees are due on the first day of each month in advance. In order for the condominium fee to be on time, the Management Company must have received the fee by the first day of the month that the fee is due. A fine of $10 will be assessed by the 15 th of the month during any month a unit owner has an unpaid balance from fees, fines, previous late charges or other assessments. VIII. Selling and Leasing of Units A. Provisions for selling a unit are contained in the Trust Document and Master Deed. Unit owners are responsible for referring to these documents when selling a unit and are also responsible for providing buyers with all condominium documents: the Trust Document, Master Deed and these Rules and Regulations. Copies of these documents may be purchased from the Management Company. B. Provisions for leasing a unit are contained in the Trust Document and Master Deed. Unit owners are responsible to these provisions and also to the following: 1. Units may not be leased without prior written permission from the board of Trustees. To make certain that Village Estates meets regulations of the secondary mortgage market, the Board of Trustees will allow no more than 5 units to be leased at any one

time. 0 for the unit owner 2. The Board of Trustees will grant permission to lease only to current owners or to a confirmed buyer who has signed a purchase and sale agreement. The permission to lease does not automatically transfer from one owner to the next owner. 0 for the unit owner 3. Lessees must comply with all provisions of the Trust Document, Master Deed and these Rules and Regulations. for the unit owner, plus any fine levied for the Particular infraction. 4. The Board of Trustees will revoke its permission to lease if unit owners are not current in paying fees, fines, and other assessments. The Management Company will unit owners via certified mail, or other certifiable means, when permission to lease is revoked. these rules and Regulations does not constitute an excuse for violating these provisions. The following trustees, constituting a majority of the trustees on the Board of Trustees at Village Estates, have adopted these rules and Regulations for Village Estates as of the date signed below.
