TERMS AND CONDITIONS FORMING PART OF THIS APPLICATION FOR PROVISIONAL ALLOTMENT OF APARTMENT IN THE RESIDENTIAL GROUP HOUSING COLONY CASA ROMANA SITUATED IN THE REVENUE ESTATE OF VILLAGE-MAHESHWARI, SECTOR-22, TEHSIL-DHARUHERA, DISTRICT-REWARI, HARYANA. I/We request for a allotment of a Residential Apartment ( Unit ) in your Group Housing Project Casa Romana Situated In the Revenue Estate of Village-Maheshwari, Sector-22, Tehsil-Dharuhera, District-Rewari, Haryana (hereinafter referred to as the Project ) I/We understand and agree that; 1. The Promoter is fully competent to invite this application for sell of the apartment /residential unit in the project and all the legal formalities with respect to the right, title and interest of the Promoter regarding the Said Land on which Project is to be constructed have been complied with. 2. The Director General, Town & Country Planning (DGTCP), Haryana has granted the approval/ sanction to develop the Project vide approval dated 18.03.2013 bearing license/ sanction No. 13 of 2013. 3. The Promoter has obtained approval on the layout plan/ demarcation/ zoning/ site plan/ building plan/ or any requisite approval for the Project as the case may be, from Director General Town and Country Planning, Haryana. The Promoter agrees and undertakes that it shall not make any changes to these approved plans except in strict compliance with section 14 of the Act/ any other laws of the State as applicable. 4. The Promoter has registered the Project under the provisions of the Act with the Haryana Real Estate Regulatory Authority at Panchkula, Haryana on under registration no. ; 5. I/We Have seen and accepted the schedule of payments, plans, specifications, design and other relevant details of the Project. 6. I/We understand and agree that this application is an Expression of Interest and expresses my/our intent and desire to seek an allotment of Unit in your Group Housing Project in Dharuhera, Haryana and the same does not in any manner amount to booking and/or does not create any right or interest whatsoever in my/our favour in respect of any Unit, notwithstanding the fact that the Company may have issued a receipt in acknowledgment of the money tendered hereof or paid by me/us from time to time. 7. I/We understand and agree that by submitting this application, I/We do not become entitled to the allotment of a Unit; the allotment of a Unit shall be made by the Promoter upon with the issuance of an allotment letter in due course of time. In the event, a Unit is allotted to me/us, I/we agree to sign and execute all necessary documents and complete all formalities including but not limited to execution of standard Buyer's Agreement, affidavits, undertakings etc. and unequivocally agree to abide by the terms and conditions laid down therein. The amount tendered by me/us as above shall be adjusted towards the booking of the Unit allotted to me/us upon completion of all formalities as conveyed to me/us by the Promoter. 04
8. I/We understand and acknowledge that in case of non-realization of amounts paid herewith or my/our failure to execute the necessary documents/affidavits, receipts etc. including the standard Buyer's Agreement, within the time stipulated by the Promoter, present application will be treated as cancelled. In such an eventuality, the amount paid by me/us shall stand forfeited and I/we shall be left with no claim/right/entitlement whatsoever against the Promoter arising out of application. 9. If for any reason whatsoever, the Promoter fails to allot a Unit within a period of 6 (six) months from the date hereof (subject to the realization of the amount as tendered with this Application) the Promoter shall refund the amounts tendered by me/us along without interest. I/We understand and agree that the Promoter shall have no other liability and/or obligation of any kind or nature whatsoever except return of the amounts as aforesaid. 10. Notwithstanding anything contained herein, I understand and agree that the validity of this application shall be subject to realization of the amount tendered by me/us with this application. 11. The Promoter shall have right to raise finance/loan from any Bank/Financial Institution by way of mortgage/charge/securitization of receivables or in any other mode or manner by charge/mortgage of the Apartment/Building /Project /Licensed Land including any addition thereto subject to the condition that the Apartment shall be free from all encumbrances at the time of execution of Conveyance Deed. The Promoter/ Bank/ Financial Institution, as the case may be, may always have the first lien/charge on the Apartment for all their dues and other sums payable by the Applicant(s) or in respect of any loan granted to the Promoter for the purpose of the construction of the Building/Project. 12. I/We shall be solely responsible for complying with the necessary formalities a laid down in Foreign Exchange Management Act 1999 (FEMA), Reserve Bank of India Acts & Rules (RBI) made there under or any other statutory amendments/modifications, made thereof and all other applicable laws including that of remittance of payments, acquisition, sale, transfer of immovable property etc., and provide the Developer with such permissions, approvals as may be required.
