PROJECT TIMELINE Completed Application Submission Date: November 8, 2004 Application Revision & Re-submission Date: March 30, 2005 Planning Report Date: May 18, 2005 The applicant is proposing: a Development Variance Permit to vary the Sign By-law regulations: to vary the minimum distance required between free-standing signs from 30 metres (100 ft.) to 10 metres (33 ft.); and to reduce the required setback from 2 m (6.6 ft.) to 1.5 m (5 ft.) in order to allow for an existing free-standing sign.

REFERRALS: Engineering: No concerns (Appendix III). The Planning & Development Department recommends that: 1. Council approve Development Variance Permit No. (Appendix IV), varying the following, to proceed to Public Notification: (a) to vary the minimum distance between free-standing signs from 30 metres (100 ft.) to 10 metres (33 ft.); and (b) to vary the required setback for a free-standing sign from 2 metres (6.6 ft.) to 1.5 metres (5 ft.). PLAN AND POLICY COMPLIANCE OCP Designation: LAP Designation: Complies. Complies. DEVELOPMENT CONSIDERATIONS: The automotive dealership is located on the east side of 120 Street, between 62 Avenue and 64 Avenue. The surrounding area is commercial and multiple residential in Surrey and commercial and single family residential in Delta. Development Permit No. 7904-0287-00 was issued on November 1, 2004 in order to permit major exterior renovations and a small addition to the existing automotive dealership. Through this process it was determined that one of the existing freestanding signs was not approved under any of the previous Development Permits. It was determined that a Development Variance Permit application be submitted as the freestanding sign does not conform to the Sign By-law. The sign is located 1.5m (5ft) from the property line instead of the required 2m (6.5 ft) and is located within 30m (98ft.) of another freestanding sign. The dealership is in the process of renovating the structure and has recently planted the landscaping requirements outlined in the above noted Development Permit. BY-LAW VARIANCE AND JUSTIFICATION (a) Requested Variance:

To vary the required 2 metre (6.5 ft.) setback for an existing free-standing sign to 1.5 metres (5 ft.). Applicant's Reasons The sign was believed to have been permitted and ownership has changed. Staff Comments: The existing sign advertises Air Care, car rentals and announcements. The height of the sign is 3.81 metres (12.5 ft.) which is below the maximum height of 4.5 metres (15 ft.). The sign area is 7.4 square metres (80 sq.ft.) which is less than the maximum sign area of 13.9 square metres (150 sq.ft.), (Appendix V). Transportation Engineering has reviewed the location of the sign and does not have a problem with its retention until the widening of Scott Road. (b) Requested Variance: To reduce the required 30 metre (10 ft.) distance between free-standing sign to 10 metres (33 ft.) in order to allow for an existing free-standing sign. Staff Comments: The Sign By-law permits one free-standing sign per 30 metre (87 ft.) of frontage. Through a previous Development Permit process, three free-standing signs were permitted and are currently on the lot. The lot frontage is 126.6 m (415 ft.) which allows for four free-standing signs. The free-standing sign that is 10 metres (33 ft.) in distance from the subject sign is relatively small, with a length of 1.9 metre (6.3 ft.) and a height of.5 metre (1.75 ft.)
