1. Introduction This report has been prepared by the Department of Environment, Land, Water and Planning (DELWP) State Planning Services team for the Kaufland Stores in Victoria Advisory Committee (Advisory Committee). This report provides information on the process undertaken by DELWP to carry out public notification of the proposals by Kaufland Australia Pty Ltd to use and develop land and amend the planning scheme controls for various sites. The Advisory Committee is considering the sites in two groups. This report concerns the second group. The Terms of Reference for the Advisory Committee at Clauses 12-17 set out the requirements for giving notice and receiving submissions. In summary, after consulting with the relevant municipal councils, DELWP forwarded a cover letter and information sheet inviting submissions from: each relevant council the owners and occupiers of properties adjoining or surrounding the proposed development sites relevant government agencies and servicing or referral authorities the prescribed Ministers to be given a notice of a planning scheme amendment under section 19(1)(c) of the Planning and Environment Act 1987 In addition, a notice about the Advisory Committee was placed in newspapers circulating in the locality of the proposed development sites and a hard copy of all supporting documents was made available at locations as nominated by each council. 2. Proposals On 24 July 2018, the Minister for Planning referred proposals by Kaufland Australia Pty Ltd to the Advisory Committee for consideration of the planning merits and to provide advice on the suitability of the proposed planning scheme amendments. Public notification about Kaufland s proposals was undertaken for the second group of three sites. Site 1126-1146 Centre Road, Oakleigh South 1158 Nepean Highway, Mornington 1550 Pascoe Vale Road, Coolaroo Notification inviting submissions on the proposed use, development and planning scheme amendments commenced on 5 December 2018 and concluded on 1 February 2019. 2.1 Information sheets DELWP prepared an information sheet for each site as part of the notification process. Each information sheet briefly describes the proposal, outlines the proposed planning scheme amendment, the role of the Advisory Committee and provides information on how to make submissions. The information sheets directed readers who wished to view further information to engage.vic.gov.au/kaufland-advisory-committee and to locations where hard copy documents were available for inspection. Separate telephone numbers and email addresses were provided on the information sheets for questions about the Advisory Committee process or for all other planning questions. The information sheet accompanied letters sent to all parties. A copy of each of the information sheets can be found at Attachment 1. 3. Notification Clauses 12, 13 and 14 of the Terms of Reference required DELWP to carry out notification to each relevant council, the owners and occupiers of adjoining or surrounding properties, relevant government agencies and servicing or referral authorities, and to place a public notice in a local newspaper or newspapers, where available. DELWP consulted the relevant councils on the notification to be undertaken (example letter at Attachment 2). Advice provided by the councils included: the name and address details of affected owners and occupiers of land, relevant servicing and referral authorities, local newspaper/s in which to publish a notice and preferred locations to make a hard copy of the supporting documentation publicly available. 3.1 Owners and Occupiers DELWP provided the councils with a suggested notification boundary for each site. Mornington Peninsula, Kingston and Monash* councils provided name and address details for a wider area of owners and occupiers. Maps indicating the perimeter suggested by DELWP and the areas for which councils provided owner and occupier details are at Attachment 3. In each case, notice was sent based on the details provided by the councils. DELWP sent a copy of the relevant information sheet and a letter explaining the process to each owner and occupier within the notification boundaries (example letter at Attachment 4), as follows: Kaufland Stores in Victoria Advisory Committee 3
Oakleigh South: 406 owners and occupiers notified for properties in the municipalities of Kingston and Monash Mornington: 638 owners and occupiers notified Coolaroo: 17 owners and occupiers notified *Although the Oakleigh South site is fully contained within the City of Kingston, is it close to the boundary with Monash City Council. 3.2 Servicing authorities The councils provided the details of servicing or referral authorities who should be notified of the proposals.
