MORTON COUNTY COMMISSION REGULAR MEETING May 23, 2017 The Morton County Commission Regular Meeting was called to order on May 23, 2017 at 5:30 PM by Chairman Schulz at the Morton County Courthouse, 210 Second Avenue NW, Mandan, North Dakota. Others present were Commissioners Leingang, Zachmeier, Boehm and Strinden, Auditor Rhone, States Attorney Koppy and Assistant States Attorney Grosinger. SITUATION: During the last 30-days Rural Fire Departments have responded to (15) grass fires. Extremely dry conditions throughout the county. Near term outlook does not reflect a positive precipitation forecast Fact that the Rangeland Fire Danger Index does not accurately reflect the propensity for fires. Plan a mechanism, e.g., Special Meeting, for quickly rescinding the Total Burn ban should wet conditions occur PRESENTED MOTION#1: Motion #1 Declare a total ban on open burning in Morton County until further notice

Drought Briefing Key Points It was one of the driest Mays on record at Minot (8 th driest) and Bismarck (4 th driest). Moderate drought has developed over parts of central and southern North Dakota. A wetter period may occur in mid to late June, with drier weather favored in early June and again during July and August.

What Follows a Dry May? Based on the Top-15 Driest Mays at Bismarck 60% of the top-15 driest Mays were followed by a wet June. Only 3 of the top-15 driest Mays on record were followed by a June that had less than 1.60 inches of rain (2002, 1997, and 1936). However, 75% of the following July and Augusts experienced below-normal rainfall.

Looking Ahead Summary of Summer Expectations Based on our analysis of historically dry Mays and support from some of our long range computer model simulations, we believe the following scenario may play out: When Rainfall Temperatures June A wetter period may develop mid to late month Near normal temperatures are favored July August Historical patterns favor a return to drier weather Historical patterns favor the dryness intensifying Historical patterns favor hotter than normal temperatures Historical patterns favor near normal temperatures Many of these historical patterns correlated with years conducive to an earlier than normal onset of wildfire concerns.

SITUATION: Morton County s authority for banning fireworks (Sales and Use) States Attorney. During the last 30-days Rural Fire Departments have responded to (15) grass fires. Extremely dry conditions throughout the county. Fact that the Rangeland Fire Danger Index does not accurately reflect the propensity for fires. Possibility the City of Mandan may ban the use of fireworks within city limits/the effect this may have for more people going outside city limits to use fireworks. Chance that we could have significant precipitation immediately prior to Independence Day (unknown)/is there a mechanism for quickly rescinding the Total Burn ban should wet conditions occur? Fact that many fireworks vendors have already purchased their merchandise. PRESENTED MOTION#1: Motion #1 Draft a Fireworks Ban readied for implementation at a to be announced Special Meeting (if deemed needed).

TOTAL BURN BAN NOTICE For MORTON COUNTY, NORTH DAKOTA June 8th, 2017 WHEREAS, the Morton County Board of Commissioners recognizes that abnormally dry conditions combined with high winds and almost daily fire responses within Morton County; and WHEREAS, all available resources remain committed to protecting life and property; and WHEREAS, the impact of fires threatens the health, well-being, and safety of citizens in Morton County; and WHEREAS, the cost of response and the inordinate equipment wear may be far in excess of available County resources. NOW, THEREFORE, BE IT RESOLVED, that the Morton County Board of Commissioners declares a Total Burn Ban (regardless of categories assigned per the North Dakota Adjective Fire Danger Map) effective immediately until further notice. The only allowed exceptions are the responsible use of gas grills and gas stoves used at a safe distance from combustible materials. Summary: the proposed subdivision is a one-lot residential subdivision, being broken off from a 298 acre farmstead, which includes the town of Haymarsh (platted in 1911). The farmstead is under contract for deed by Andrew and Monica Jacobson from Monica s parents Russell and Be Ba Gietzen. The applicants requested access to the proposed subdivision via right of way that was previously established on the plat of Haymarsh. The land that was platted as the town of Haymarsh is currently functioning as a single farm yard. The right of way and various lots established by the plat of Haymarsh are not distinguishable on site. The plat of Jacobson Subdivision should be accompanied by an ingress/egress agreement that defines the access corridor off of County Road 140. Staff recommended approval. b.
