Peel Standard Condominium Corporation No. 713 Multi-function Room Agreement Reservation Requested by Suite # This Indenture made in duplicate the day of, 2014. Between: Peel Standard Condominium Corporation NO. 713 Hereinafter called the Lessor And: Hereinafter called the Lessee Of the Second Part Witnesseth that in consideration of monies, covenants and agreements hereinafter reserved and contained on the part of the lessee to be paid, observed and performed, the Lessor does agree that the Lessee may book the multi-function room at 1359 Rathburn Rd. East, Mississauga, Ontario L4W 5P7. To book the multi-function room on, 20. From: a.m./p.m. To: p.m./a.m. (Latest finishing time 2:00 a.m. of the following day.) Yielding and paying therefore, Two Hundred dollars ($150.00 user fee & $50.00 cleaning fee) of lawful money of Canada, to be paid without deduction at the Concierge desk of The Capri condominium by certified cheque, fourteen (14) days in advance of the booking date. At the same time a certified cheque of five hundred dollars ($500.00) as a security deposit is required, plus a cheque to cover security by the hour, as may be required. The deposit shall be returned, if the multi-purpose room is left in the same condition as it is found. The Security by the hour payment of $ is to be made payable to Ardent Security and Investigative Services Inc. The Lessee covenants and agrees with the Lessor as follows: 1
a) The maximum number of persons attending the function will be: b) To pay the user fee of $200.00 in two cheques of $150.00 and $50.00 fourteen (14) days in advance of booking date, consisting of the following: 1. User Fee made payable to Peel Standard Condominium Corporation NO. 713 $150.00 2. Cleaning Fee made payable to GTA Cleaning and Maintenance Services Inc. $50.00 3. Security Deposit $500.00 Peel Standard Condominium Corporation NO. 713 4. Supplementary Security Personnel $ Ardent Security & Investigative Services Inc. 2 Hours at $25.00/hr + HST See section (d) 5. Other $ c) That the Lessee is either an owner or a tenant, and is a resident at The Capri Tower. The resident must be in attendance at all times while the party is in progress. A resident over the age of 16 must accompany residents under the age of 16. d) Security services shall be arranged when 35 or more persons are in attendance. The cost for services shall be paid for by the resident and shall be at the rate charged by the Security Company. These services will be contracted from one half hour before guests are scheduled to arrive to one hour after the booked finished time for a minimum of 4 hours. The Security Company will be responsible for access control and ensuring that all guests and residents abide by the house rules and regulations. Payment for these Security Services shall be by certified cheque for minimum 4 hours payable to Ardent Security and Investigative Services Inc. fourteen (14) days in advance of booking date. Additional Security required hours must be paid by cheque at the end of function. Please note: On holidays the rate is time and a half. e) To provide to the Lessor a complete list of invited guests at least 72 hours in advance of the function commencement. f) The Corporation will not accept applications for stags, private Christmas Eve or
Day parties, New Year s Eve or Day parties and Halloween parties. Bookings for commercial/private enterprise use are strictly prohibited. g) That no tickets of admission will be sold. h) That there will be no gambling for money or prizes contrary to the by-law of the municipality, or provincial or federal laws. i) That the Lessor, or its agents or employee, shall not be liable for, and the Lessee shall save harmless the Lessor and its agents and employees from, any injury loss or damaged sustained on or about the premises. j) That no liquor, wine, or beer will be sold in or around the premises. k) That he will not allow more than 50 persons in the multi-function room at one time as specified by law. l) Applicants must ensure that guests vacate the multi-function room, not later than 1:30 a.m. Residents must clean and vacate the room by 2:00 a.m. Residents may return no later than 9:00 a.m. the following day to complete clean up if necessary. m) That upon vacating the premises he/she will check that all persons are out of the building, that all windows and doors are securely closed and latched, and that all appliances are turned off (except refrigerator) and in a safe mode, and immediately provided a status report to the concierge. n) That the doors to the hallway or exit doors not be propped open or obstructed. o) That all guests will arrive for and depart from the function through the main lobby, or the P1 lobby entrance only. p) That the Lessor, or its agents or employees, shall not be liable for, and the Lessee shall save harmless the Lessor and its agents and employees from any fines, legal action (civil or criminal), court awarded damages and similar levied or brought against the Lessor as a consequence of the use by the Lessee of the subject premises. q) Advance notice is required if there is a need to bring additional furniture/equipment into the party room. This furniture must be removed no later than 10:00 a.m. the following day. The existing furniture is not to be removed from the party room under any circumstances. All rented equipment, food, supplies, etc. must come into the building through the moving room and not through the main entrance door. r) Smoking is not permitted in the multi-function room. Any Resident or their 3
Guests who wants to smoke must smoke outside the front door area and not to use the fire exit door at the Party Room. s) Live bands are not permitted in the multi-function room. t) Decorations shall not be attached to any part of the multi-function room walls, kitchen counter, blinds, furniture, etc. u) The resident is responsible for gathering loose garbage and leaving the room in a presentable state. Failure to do so may necessitate additional costs, which will be deducted from the security deposit. v) Bookings can be made a minimum of 7 days and a maximum of 6 months in advance and are on a first come, first served basis. w) Bookings can be cancelled by giving at least 48 hours notice failure to give proper notice may result in loss of user fee. x) Residents must arrange to greet their guests at the lobby and direct them to the party room. The resident should advise the guests as to the alternate parking areas outside of the property as the visitor parking may not be sufficient to hold all the guests. An inspection will be made before and after each party is held, by a Corporation representative. The time of the inspection will be approximately 9:00 a.m. the day after the party or, if requested, immediately after the party has terminated. The Lessee may be present at this inspection if he/she so desires, if the Lessee is not present at 9:00 a.m. (or whatever time the Property Management establishes) the inspection will proceed without him/her.
