Code 3.2-6538; and WHEREAS, the Board has held a duly advertised public hearing concerning the addition of the areas and subdivisions to the schedule of areas restricting dogs from running at large. NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the Gloucester County Board of Supervisors this 5th day of May 2015 that Chapter 3, Article II Dogs, Division 2 entitled Dogs Running at Large in Certain Areas, Section 3-47 of the Gloucester County Code be, and it hereby is, amended to add certain areas and subdivision as follows: Sec. 3-47. Official schedule of restricted areas for dogs running at large. PUBLIC HEARING NOTICE Pursuant to the Code of Virginia, the Gloucester County Board of Supervisors will conduct a Public Hearing on May 5, 2015 beginning at 8:00 p.m. in the Colonial Courthouse, 6504 Main Street Gloucester, Virginia to consider the following: AN ORDINANCE TO AMEND CHAPTER 3 OF THE GLOUCESTER COUNTY CODE, ARTICLE II - DOGS, DIVISION 2 - ENTITLED DOGS RUNNING AT LARGE IN CERTAIN AREAS BY AMENDING SECTION 3-47 TO ADD THE FOLLOWING AREAS TO THOSE AREAS COVERED BY THE PROVISIONS OF THAT SECTION: Abingdon Magisterial District: Belroi Road Area; Hutchesons Subdivision; Hutch Creek Subdivision; Courthouse Spring Subdivision; and Courthouse Square Subdivision. The County is authorized to designate areas within the County in which it is unlawful to permit dogs to run at large, pursuant to Virginia Code Section 3.2-6538. The Belroi Road Area is described as: All properties listed on the recorded plat known as A.G. Birdsall Plat, recorded as Plat Book 1, Page 350, or better described as: Properties on the East side of Belroi Road, addressed: 7289 7489 Belroi Road; properties on the West side of Belroi Road, addressed: 7264 7434 Belroi Road; all vacant properties adjacent to any of the above addressed properties; and the portion of Belroi Road and easements adjacent to the properties listed above. Although portions of each of the subdivisions to be included lie within Sanitary District #1, which is already a leash law area, adding the entire subdivisions to the leash law area will help clarify, for the citizens and the Animal Control Officers, leash law boundaries in those subdivisions. The proposed Ordinance will make it unlawful to permit dogs to run at large in all sections and phases of the subdivisions listed above, as shown on all plats now on record in the clerk's office of the county circuit court and all future recorded plats of sections of each subdivision appurtenant to the subdivisions as they exist on May 5, 2015.
