TITLE Approval of property sales of 315 square feet for the South Lander Street Grade Separation Right of Way 2. PURPOSE This Board Action Report details the sale of 315 square feet of land and loss of one parking stall at the John Stanford enter for Education Excellence to the ity of Seattle, which has stated that this area is needed for the right of way for the South Lander Street Grade Separation project. 3. REOMMENDED MOTION I ove that the School Board authorize the Superintendent to execute a contract with ity of Seattle in the aount of $50,540 for sale of 315 square feet of real property and payent for the loss of one parking stall at the John Stanford enter for Educational Excellence. The sale is outlined in the for of the August 3, 2017 Fair Offer Letter attached to the School Board Action Report, with any inor additions, deletions, and odifications deeed necessary by the Superintendent, and to take any necessary actions to ipleent the contract. 4. BAKGROUND INFORMATION Background: Per Board Policy No. 6882, Rental, Lease and Sale of Real Property, the District real property requires School Board Approval. This action is the sale of 315 square feet of real property at the JSEE to the ity of Seattle for the right of way for the South Lander Street Grade Separation project. The South Lander Street Grade Separation is a $140 illion dollar critical transportation project to iprove freight obility and safety for people walking, biking and driving. The overpass will cross over the existing BNSF railroad tracks at South Lander Street, which runs next to the JSEE west property line. The project will reduce conflict between the over 3,000 rail cars, 1,400 surface freight trucks, general traffic, bicyclist and pedestrians that travel the corridor per day. The portion of real property being sold is a sall strip along the southeast corner under the existing flagpole, which will be used for a new retaining wall necessary for the 1

overpass. In addition to the cash payent, the ity will be relocating the flagpole and redesigning the 3 rd Avenue South, exit / entrance to the South Parking lot at their cost. The easternost driveway out of the south lot onto South Lander Street will be eliinated. A qualified appraiser has appraised the property and the District has approved the appraised value of $50,540. The fee forula confors to the Unifor Standards of Professional Appraisal Practice (USPAP). a. Alternatives: Multiple discussions were held between ity and District staff to iniize the square feet needed for the right of way. The current grade separation design requires 315 square feet of District property. The alternative would be to not sell the property; the grade separation project is a citywide obility project to benefit obility and safety. Lack of the right of way ay delay the project if the ity needs to redesign the area. b. Research: Please see attached ity of Seattle Offer to Purchase. The District Legal Departent has reviewed the letter. 5. FISAL IMPAT/REVENUE SOURE Fiscal ipact to this action will be a cash payent of $50,540 to the District. This is apital Fund Revenue. EQUITY ANALYSIS As part of the State Environental Policy Act review, the ity of Seattle conducted the Social Effects and Environental Justice Discipline Report which looks at the aspects of equity and social justice, can be found at http://www.seattle.gov/transportation/docs/lander_socialej.pdf. 8. STUDENT BENEFIT All odes of transportation such as pedestrians, bicyclist and otorized vehicles will benefit fro a safer and ore efficient crossing of the BNSF rail tracks. 9. TIMELINE FOR IMPLEMENTATION Upon approval of this otion, the Fair Offer Letter will be accepted with the ity of Seattle. Within 45 days, the ity will pay the District a lup su of $50,540. 13.
