PUBLC LASON: Notice of the application was published in Living in the City on Saturday April 9, 201 1. No replies. City Council intends to consider removing the "h-95" holding provision, which was put in place to ensure that the urban design concepts established through the Official Plan and/or Zoning amendment review process are implemented and that the development agreemenl incorporates these concepts and addresses identified Urban Desian issues to the satisfaction of the General Manager of Planning and Development. 1 2

MacLean To ensure that the urban design concepts established through the Official Plan and/or Zoning amendment review process are implemented, a development agreement will be entered into which, to the satisfaction of the General Manager of Planning and Development, incorporates these concepts and addresses identified Urban design issues. n January 201 1, the proposed site plan and elevations were submitted to the Urban Design Peer Review Panel and they were found to be acceptable. The London District Catholic School Board has entered into a development agreement with the City to construct this school as per the accepted plans. As a result, it is appropriate to consider removal of the h-95 holding provision at this time. CONCLUSON Based on the executed subdivision agreement it is appropriate to consider removal of the h-95 holding provision from the CFl Zone at this time. WHEREAS Claybar Developments nc. has applied to remove the holding provisions from the zoning for the land located at 2727 Tokala Trail, as shown on the map attached to this by-law, as set out below; AND WHEREAS it is deemed appropriate to remove the holding provisions from the zoning of the said land; THEREFORE the Municipal Council of The Corporation of the City of London enacts as follows: 1.
