COUNCIL OF THE TOWN OF LA PLATA NOTICE OF PUBLIC HEARING November 28, 2017 Notice is hereby given that the Council of the Town of La Plata will hold a public hearing on November 28, 2017 at 7:00 p.m., or as soon thereafter as possible, in the La Plata Town Hall, 305 Queen Anne Street, La Plata, Maryland. The purpose of the hearing is to consider a petition by Mallards Pond, LLC, pursuant to the provisions of Local Government Article, Section 4-404, of the Annotated Code of Maryland, to change the corporate boundaries of the Town of La Plata by annexing parcels of land consisting of 3.8222 acres, more or less, located in the First Election District of Charles County, and a related zoning classification request and annexation plan. The parcels which are the subject of the annexation petition are located immediately south and west of the existing corporate boundaries of the Town, contiguous to commercial property to the east and residential property to the south and west, and includes segments of the Rights-of-Way of Lee and Scroggins Streets. The perimeter metes and bounds descriptions of the parcels to be annexed are as follows: BEING parcels of land hereinafter described for Annexation into the Town of La Plata, Maryland, said parcels of land being comprised of all of the lands acquired by Mallards Pond, LLC from MD. Quality Homes, Inc., by deed dated December 28, 2012 as recorded in Liber 8058 at Folio 289, being depicted as Tax Map 108, Parcel 7; and portions of Lee Street and Scroggins Street as shown on Charles County Board of County Commissioners Right of Way Plat HC-35 recorded in Plat Book Liber 11, Page 79, all among the Land Records of Charles County, Maryland, said parcels being described as follows: Part 1 ~ Eastern Portion of Proposed Annexation
BEGINNING for the same at an iron rod found in the southern right of way line of an old road known as Mayday Road; said beginning point being further described as being in the outline of a parcel of land now or formerly in the name of Rudolph L. Garner, Sr. Family Trust by deed dated October 31, 2006 and recorded among the Land Records of Charles County, Maryland in Liber 6103 folio 114; said beginning point being still further located as marking the northwestern most corner of Chesapeake Street, a 50 right of way as shown on a plat recorded among the Plat Records of Charles County, Maryland in Plat Book 38 at Page 81 and conveyed to the Town of La Plata by deed dated March 28, 1989 and recorded among said land records in Liber 1371 folio 348; said beginning point being lastly described as the northeastern most point of the herein described; THENCE leaving said point of beginning, so fixed, and running and binding with said Chesapeake Street; and a parcel of land known as Potomac Square Condominiums and shown on a plat recorded among said plat records in Plat Book 41 at Page 51; and the boundary of the Town of La Plata the following course and distance as adjusted to Maryland State Plan Coordinate System (NAD 83/2011) and by sound surveying methods correcting variations in descriptions of record; 1. South 10 13 44 East 239.52 feet to a concrete monument found marking the northwestern most corner of a parcel of land now or formerly in the name of Verizon Communications, Inc. by deed dated July 18, 1967 and recorded among said land records in Liber 189 folio 556; THENCE leaving said Potomac Square Condominiums (PB 38 Pg. 81) and running and binding with said Verizon Communications, Inc. parcel (L.189 F. 556) and continuing with the boundary of the Town of La Plata the following course and distance; 2. South 12 07 53 East 59.02 feet to a concrete monument found marking the northeastern most corner of a parcel of land now or formerly in the name of The Amy Frances Scroggins Living Trust by deed dated September 22, 2006 and recorded among said land records in Liber 6091 folio 378; THENCE leaving said Verizon Communications, Inc. parcel (L.189 f. 278) and running and binding with said Scroggins Living Trust parcel (L. 6091 f.556) and continuing with the boundary of the Town of La Plata the following four courses and distances; 3. South 78 33 23 West 186.60 feet to a point, and 4. South 11 26 37 East 175.44 feet to an iron rod found in the northern right of way line of Scroggins Street, a 50 right of way shown on a plat recorded among the said plat records in Plat Book 11 at Page 79;thence also with the northern right of way line of Scroggins Street (PB 11 Pg. 79); 5. North 79 45 13 East 149.29 feet to a point; and 6. South 06 58 10 East 50.08 feet to a point on the southern right of way line of said Scroggins Street (PB 11 Pg. 79) said point also being the northeast corner of Lodge Street, a 30 right of way shown on a plat recorded among the Plat Records of Charles County, Maryland in Plat Book 11 at Page 79;

South 79 45 13 West 150.41 feet to a point in the outline of a parcel of land now or formerly in the name of Thomas and Kelly Barnes by deed dated July 6, 2004 and recorded among said land records in Liber 4817 folio 468; THENCE leaving said Curry parcel (L. 414 f. 70) and running and binding with said Barnes parcel (L. 4817 f. 468) and a parcel of land now or formerly in the name of Michael and Amanda Cole by deed dated March 6, 2015 and recorded among said land records in Liber 8861 folio 451 the following course and distance and continuing with the boundary of the Town of La Plata; 8. South 77 01 15 West 172.12 feet to a point; THENCE leaving said Cole parcel (L. 8861 f. 451) and running through Scroggins Street (PB 11 pg. 79); with the outline of a parcel of land now or formerly in the name of T & J Property Rentals by deed dated July 2, 2012 and recorded among said land records in Liber 7872 folio 48, and with the boundary of the Town of La Plata the following course and distance; 9. North 76 18 10 East 321.66 feet to the point and place of beginning; CONTAINING 0.3692 acre or 16,083 square feet of land, more or less, as described by Lorenzi, Dodds, and Gunnill, Inc. in January, 2017; BEING part of the land shown on a plat entitled Right of Way Plat... Lodge Street, Scroggins St., & Lee Street as recorded among the Plat Records of Charles County, Maryland in Plat Book 11 Page 79. CONTAINING 3.8222 acres of land more or less. The Petitioner is requesting that the lands to be annexed be placed in the Town s R3 Residential zoning classification. Following the public hearing, the Town Council may enter into an annexation agreement with the Petitioner to establish terms, circumstances and conditions applicable to the properties to be annexed into the Town, and to the owners of such properties. However, subject to the terms of any annexation agreement, the properties to be annexed into the Town, and all owners of such properties, will be subject to the Charter, laws, ordinances and resolutions of the Town of La Plata from and after the effective date of the annexation. At the public hearing all parties in interest and citizens will have an opportunity to be heard. Special accommodations for persons with disabilities will be made upon request.
