Approval. was received from the Planning Commission on March 3, 20:09 for a proposed project to the north ofthe existing park (commonly referred to as Phase III). The project includes the expansion of approximately (8.1) new RV lots, new roads, water features, landscaping, watermainextension an additional septic Held. Construction approval was obtained from the State of Michigan as an extension of the current campground license. W» The Phase III project was delayed due the economic slow down in 2010 and the permit expired. The project was reintroduced and approved on May 23, 2011. There were no modifications to- the priorly approved plan. During 2.012,. the park was forced to spend most ofthe year defending itself against several of the parks owners overthe resale of power from Consumers Energy. The dispute resolution was necessary to allow the expansion to continue. Along with the. distraction, however, the permit elapsed, for yet a third time-. Please accept this asa request to extendthe permit. for a period of two more years. The expansion is being looked at to be started as a joint venture ora possible sale. The landscaping plan shall be attached to this Special Use Permit as Exhibit B, with plant species to be appropriate for existing soils, the size, location and number to be approved by the Landscape Committee. All landscaping shall be sprinkled by an automatic sprinkling system. Any change in thelandscaping plan shall be approved by the Landscape Committee on the Acme Township Planning Commission. A landscaping plan has been submitted that was developed in 2008 when the application was previously submitted and approved, and which was developed by the applicant in conjunction with Landscape Architect and former Planning Commissioner David Krause. It consists primaribr of a landscaped berm on the north side of the property. Other than this, landscaped bujfers are provided by the wetlands that permeate and surround the site and signyicant mature natural vegetation. Section Z5. 6. g of the ordinance provides credit for existing vegetation as opposed to providing new more formal landscaping as follows. In keeping with the general goals of the townshm to maintain a very natural aspect to the community and to respect wetlands and other natural ecosystems to the greatest extent possible, stay recommends that retention of the natural vegetation is far preferable in this instance to substitution with human landscaping. 4. Any waste receptacle placed on the property shall be screened, and the location approved by the Acme Township Planner. Central dumpster sites that serve the development are currently located on site. 5. The elevations shall be as on the Site Plan, with the final grade consistent with adjoining developed properties. The Site Plan provides adequate elevations. 6. Parking shall meet all of the requirements of the Acme Township Zoning Ordinance. Parking is generally accomplished within each site. 7. There shall be no outside storage or sales. No outside storage or sales are proposed 8. The Applicant must obtain all necessary permits, including soil erosion, and Department of Natural Resource permits, and/or approvals. Initial permits and/or approvals have been obtained by the applicant; subsequent approvalsqmermits will need to be obtained from prior to construction. 9. The signage shall meet all of the requirements of the sign provisions of the Acme Township Zoning Ordinance, without variance. No new signage is proposed. 10. If there is or will be an on-site sewage disposal system on the Applicant's property which requires a permit under the authority of Act 98 of the Public Acts of` 1913 as amended (MCL 325.210 gt gi,) the Applicant agrees to allow Acme Township to accept ownership and responsibility for the operation of the on-site sewage disposal system and extensions to the on- site sewage disposal system and the Applicant agrees to execute a Sewerage Agreement in a form acceptable to Acme Township's Attorney. Permit N0. 2011-01P 11. lf there is or will be a water system on the Applicant's property which requires the approval of the Michigan Department of Health pursuant to the Michigan Safe Water Drinking Act (MCL 325.1001 Q gi,) the Applicant agrees to allow Acme Township to accept ownership and responsibility for the operation of the water system and extensions to the water system and the Applicant agrees to execute a Water System Agreement in a form acceptable to Acme Township's Attorney. The existing conditions that exist in the original/existing SUP be carried forward to the new SUP. b. All structures greater than 100 square feet shall require a land use permit from the T ownshzp. Depending on options, the coach houses may require additional agency review by the Grand Traverse County construction code standards, Grand Traverse County Drain Commissioner, Metro Fire, etc. 13. The Developer shall provide a Bond, Letter of Credit or Cash Surety in a form and amount acceptable and approved by the Acme Township Planner, for completion of the development, including landscaping, paving, lighting and irrigation. Provided and approved. 14. The development shall be subject to all applicable restrictions and requirements as set forth in the Acme Township Zoning Ordinance of 2008, as amended. The development is also subject to all of the requirements of this Special Use Permit. Any violation of these conditions or requirements shall serve as grounds for revocation of this Special Use Permit by the Acme Township Board. In the event of any such violation, Acme Township shall give written notice to the Applicant, by ordinary mail addressed to the Applicant at the last address furnished to Acme Township by the Applicant. The notice shall state that unless the violation is corrected or resolved, to the satisfaction of the Acme Township Board, within thirty (30) days from the date of the notice, then the Acme Township Board may revoke this Special Use Permit after a hearing. In the event a hearing becomes necessary, the Acme Township Board shall establish the notice requirements and such other conditions with respect to the hearing as the Acme Township Board may deem appropriate. After the hearing, if the Acme Township Board revokes this Special Use Permit, then enforcement of the violation may be made by an application for appropriate relief in the Grand Traverse County Circuit Court. The Applicant agrees that Acme Township may recover all of its costs, including attorney fees, associated with, or resulting from, such violation. Agreed to by applicant. 15. The rights set forth in this Special Use Permit are in addition to those granted to Acme Township by the Township Rural Zoning Act and other appropriate statutes and laws, including the Acme Township Zoning Ordinance.
