THE TERM REQUIRED IS FIVE (5) YEARS, SUBJECT TO AVAILABILITY OF APPROPRIATIONS. THE UNITS MUST BE IN THE SCHINNEN/BRUNSSUM AREA (SEE ATTACHED BOUNDARIES MAP). TYPE OF UNITS OFFERS FOR LEASE CAN EITHER BE FOR: * EXISTING UNITS IMMEDIATELY AVAILABLE AND MEETING THE MINIMUM REQUIREMENTS, OR * UNITS WHICH MUST BE ALTERED TO MEET THE MINIMUM REQUIREMENTS AND DELIVERED BY THE DELIVERY DATE(S) SPECIFIED IN THIS SOLICITATION. MINIMUM BASIC REQUIREMENTS OFFERS MUST MEET THE FOLLOWING MINIMUM REQUIREMENTS AND SAFETY STANDARDS: - NO MORE THAN TEN [10] UNITS UNDER LEASE TO THE US ARMY IN A SINGLE BUILDING - BUILDINGS OF FOUR (4) FLOORS AND HIGHER MUST HAVE A SPRINKLER SYSTEM INSTALLED IN EACH APARTMENT. - UNITS MUST BE LOCATED WITHIN THE SCHINNEN/BRUNSSUM AREA (SEE ATTACHED BOUNDARIES MAP) - THE FACILITY MUST BE FREE OF ALL ENVIRONMENTAL /HEALTH HAZARD MATERIALS, LEAD BASE PAINT, RADON, AND ASBESTOS CONTAINING MATERIALS. WRITTEN CERTIFICATION THAT THE PROPERTY MEETS THESE REQUIREMENTS MUST BE INCLUDED WITH THE OFFER. 1

SMOKE DETECTORS MUST BE REPLACED BY THE LESSOR WHEN OLDER THAN TEN (10) YEARS. - MAIN ENTRANCE WITH SECURITY LOCKS. ONE (1) KEY SYSTEM WITH CERTIFICATE AND SIX (6) EACH KEYS FOR EACH QUARTER. - INTERCOM IN CONNECTION WITH DOORBELL. - LOCKS AND HINGES MEET DUTCH (STICHTING KWALITEIT GEVELBOUS) SKG** SAFETY STANDARDS (SEE ATTACHED). - AT LEAST FOUR (4) COAT HOOKS IN HALLWAY - BATHROOM; SHOWER (CABINET) WITH TOWEL BARS, TOILET PAPER ROLL HOLDER, SOAP DISH HOLDER AND MEDICINE CABINET. - KITCHEN EQUIPMENT; KITCHEN HAS BUILT IN CABINETS, OVEN AND OVEN HOOD, REFRIGERATOR AND RANGE OR AT LEAST THE CONNECTION FOR THESE SEPARATE (NOT BUILT-IN) APPLIANCES. VENTILATION OVEN HOOD WITH EXHAUST TO EXTERIOR. - SUFFICIENT PARKING SPACE AVAILABLE WITHIN THE VICINITY OF THE BUILDING. LEASE TERM THE LEASE TERM SHALL BE A FIVE (5) YEAR TERM, WITH GOVERNMENT TERMINATION RIGHTS TO BE NEGOTIATED. DELIVERY DATE THE U.S. IS SEEKING BENEFICIAL OCCUPANCY OF 23 UNITS NO LATER THAN 30 SEPTEMBER 2019. 2

NEGOTIATIONS AND COMPETITIVE RANGE UPON COMPLETION OF THE INITIAL EVALUATION OF OFFERS, THE REAL ESTATE CONTRACTING OFFICER AND/OR HER AUTHORIZED REPRESENTATIVE WILL CONDUCT ORAL OR WRITTEN NEGOTIATIONS WITH ALL RESPONSIVE OFFERORS THAT ARE WITHIN THE COMPETITIVE RANGE. OFFERS THAT DO NOT MEET THE MINIMUM BASIC REQUIREMENTS WILL NOT BE CONSIDERED. THE COMPETITIVE RANGE WILL BE ESTABLISHED BY THE CONTRACTING OFFICER ON THE BASIS OF PRICE, NEIGHBORHOOD CRIME HISTORY AND ENERGY EFFICIENCY (HEREINAFTER REFERRED TO AS THE EVALUATION FACTORS), AND WILL INCLUDE ALL OFFERS THAT HAVE A REASONABLE CHANCE OF BEING SELECTED FOR AWARD. THE OFFERORS WILL BE PROVIDED A REASONABLE OPPORTUNITY TO SUBMIT ANY PRICE, TECHNICAL OR OTHER REVISIONS TO THEIR OFFERS THAT MAY RESULT FROM NEGOTIATIONS. NEGOTIATIONS WILL BE CLOSED WITH SUBMISSION OF BEST AND FINAL OFFERS, WHEN CALLED UPON BY THE REAL ESTATE CONTRACTING OFFICER. AFTER REVIEW OF BEST AND FINAL OFFERS IS COMPLETED, THE LEASE WILL BE AWARDED TO THE OFFEROR(S) WHOSE OFFER IS MOST ADVANTAGEOUS TO THE UNITED STATES GOVERNMENT, BASED ON THE EVALUATION FACTORS CONSIDERED. THE GOVERNMENT RESERVES THE RIGHT TO MAKE MULTIPLE AWARDS UNDER THIS SOLICITATION IN ORDER TO FULFILL THE TOTAL REQUIREMENT OF 24 SINGLE OCCUPANT HOUSING UNITS. THE OFFERORS WILL BE REQUIRED TO SUBMIT A STATEMENT OF FINANCIAL RESPONSIBILITY AND PROOF OF OWNERSHIP ALONG WITH THEIR BEST AND FINAL OFFER. AWARD AFTER CONCLUSION OF NEGOTIATIONS, THE REAL ESTATE CONTRACTING OFFICER WILL REQUIRE THE OFFEROR(S) SELECTED FOR AWARD TO EXECUTE THE PROPOSED LEASE PREPARED BY THE BENELUX REAL ESTATE FIELD OFFICE, WHICH REFLECTS THE AGREEMENTS OF THE PARTIES. THE PROPOSED LEASE SHALL CONSIST OF: (A) STANDARD U.S. GOVERNMENT CORPS OF ENGINEERS LEASE FOR ACQUISITION OF REAL PROPERTY IN THE NETHERLANDS (B) PERTINENT PROVISIONS OF THE OFFER (C) PERTINENT PROVISIONS OF THIS SOLICITATION REMARKS EACH RESPONSIVE OFFER MEETING THE MINIMUM REQUIREMENTS WILL BE INSPECTED PRIOR TO BEST AND FINAL OFFER SUBMISSION, AND OFFERORS WILL BE PROVIDED WITH EXACT SECURITY REQUIREMENTS WHICH WILL HAVE TO BE TAKEN INTO CONSIDERATION AT THE TIME IN THE BEST AND FINAL OFFER SUBMISSION. 3
