Requested Final Subdivision Plat approval for an eight unit townhome development EXHIBITS: Resolution No. 2350 Vicinity Map Final Plat drawings BACKGROUND AND OVERVIEW The subject request is for final plat review for a 21,000 square foot (approximately half acre) property addressed off of 8 th Street and Cheyenne Street, titled 8 th Street Residences. The property is zoned C-1 commercial, which allows both traditional commercial uses as well as mixed use, which can include a residential component of up to 75% of the gross floor area by right. The 100% residential use, consisting of eight (8) townhome units, that was proposed by the applicant required a Special Use Permit (SUP), which was granted by Planning Commission at the time of Site Plan approval. The townhome project also received Historic Preservation Board approval, in the form of a Certificate of Appropriateness, in advance of the Site Plan and SUP approvals at Commission. A Subdivision Development Agreement (SDA) has also been drafted to address the obligations and responsibilities of the applicant relative to the City, including the construction, maintenance and liability of public improvements on and adjacent to the site, which will be finalized and signed by the applicant, the City Attorney, and City Manager. REFERRALS AND NOTIFICATION Referrals for the final plat proposal have been sent to City Fire and Public Works Departments for approval. Proper notice of this public hearing was accomplished according to law, including posting on the subject property, publication in the local newspaper, as well as the necessary letters to all owners and renters of real property within 500 feet of the subject property. No

COUNCIL ACTION In considering this request, City Council is governed by the provisions of Section 17.30.050 of the Golden Municipal Code, which state that Council should hold a public hearing with public testimony and evidence, and take appropriate action on the request. The 8 th Street Residences final plat conforms to the requirements of the City s Subdivision Ordinance, as codified in Title 17 of the Golden Municipal Code. All applicable conditions are included in the Resolution. Upon approval of this final plat by City Council, any future replat of the property would require additional approval. SUBDIVISION AND ZONING ORDINANCE REVIEW Zoning The property is zoned C-1 (Commercial and Mixed Use), and a Site Plan and SUP was approved by Planning Commission to allow 100% residential. The proposed development complies with that zoning. Public Improvements (17.50) Public Improvements to serve the site were addressed by the approved site development plan, as well as the SDA, and will be designed to meet City standards. The applicant will need new water and sewer taps and associated new service lines for the multifamily residential units, and related fees are due at the time of building permit issuance. Dedications and Fees in Lieu (17.60) The parkland dedication fee and the school dedication fee are due at the time of building permit issuance. STAFF COMMENTS AND SUMMARY Regarding the above referenced criteria, staff believes the proposed Final Plat to be in compliance with the C-1 zoning, SUP and the applicable provisions of Title 17, and recommends approval.

RESOLUTION NO. 2350 A RESOLUTION OF THE GOLDEN CITY COUNCIL APPROVING THE 8 TH STREET RESIDENCES SUBDIVISION AND AUTHORIZING THE SUBDIVISION DEVELOPMENT AGREEMENT WHEREAS, 8 th Street Residences, LLC. (subdivider) has submitted a proposed final subdivision plat for property within the City of Golden, State of Colorado, entitled 8 th Street Residences; and WHEREAS, the proposed subdivision is a replat of Lots 10, 11, and 12, Block 20, Barber s Addition to create eight (8) townhome lots and a tract. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GOLDEN, COLORADO: Section 1. The final subdivision plat for 8 th Street Residences is hereby approved subject to the following conditions: a. The subdivider shall pay applicable fees incurred as a result of the application approval, including, but not limited to, utility, remapping, public land dedication, cash-in-lieu fees, legal notice and legal review, and recording fees. b. The subdivider shall submit, within ninety (90) days of the date of this approval, all documents required by the Golden Municipal Code for finalization of the subdivision plat. c. Within ninety (90) days of the date of this resolution the subdivider shall execute a subdivision development agreement in a form satisfactory to the city attorney which shall provide, inter alia, that the subdivider shall design, construct, install and warrant all public improvements on the property or otherwise serving the property at the developer s expense and provide financial surety, performance and maintenance guarantees for the same in a form and with such guarantor as may be satisfactory to the city attorney and city manager, including but not limited to the following improvements: a. Domestic water and wastewater facilities as are necessary to serve the subdivision, said design and construction to be in accordance with plans approved by the city engineer, as in conformance with the city s engineering regulations. b. The design and construction of all streets, trails, and sidewalks within and adjacent to the subdivision. The design and construction shall be in accord with the plans approved by the city engineer, as in compliance with the city s engineering regulations. c. The design and construction of all fire lines and infrastructure shall be in accord with the plans approved by the City of Golden Fire Department as in compliance with the current and adopted fire code regulations. d. All drainage systems, including erosion abatement as are necessary to serve the subdivision, said design and construction to be in accord with the plans approved by the city engineer, as in compliance with the city s engineering regulations. e. On behalf of the city, the City Manager is authorized to execute the Subdivision Development Agreement.

Section 2. The dedication of all easements and all other places designated for public use as shown upon the final plat of 8 th Street Residences is hereby accepted by the City of Golden, subject however, to the condition that the City shall not undertake maintenance of any easement or other place designated for public use until after construction of said public improvement has been satisfactorily completed by the land owner and accepted in writing by the City of Golden. Section 3. The Mayor and City Clerk are hereby authorized and directed to certify upon the final subdivision plat the City s approval and acceptance thereof. The City Clerk is hereby authorized and directed to file the subdivision plat with the Jefferson County Clerk and Recorder s office upon fulfillment of all conditions as indicated herein. Section 4. Unless otherwise extended by City Council, the approval of the Golden 8 th Street Residences final plat shall be null and void if the conditions are not complied with within ninety (90) days of the date of this Resolution.
