McLean that the Municipal Planning Commission adopt the September 7, 2004 Minutes of the Regular Meeting of the Municipal Planning Commission as presented. BUSNESS ARSNG FRQM THE MNUTES Application for a commercial renovation (demolition) and outdoor patio on Lot 1, Block B, Plan LXXX (4615 Lakeshore Drive). MOVED by Clr. W. Elgermsa that the application be tabled until the applicant can provide an engineer's report assessing the structure as a result of the proposed renovation. Application for an apartment condo resort on Block 21, Plan 2036HW (5040 53 Street). The applicant was present and advised that he reduced number of units to 84, pushed the building back from 53 Street (closer to the golf course side) and continued with the design process. He stated that he is still refining the look (elevation) of the front entrance. The density and kind of trees is undetermined at this time. The Developer indicated the exterior will be a combination of acrylic stucco and rock on the balconies in earth tone colours and the roofing will be sculptured shingles. The Developer advised the development will be high classed and of high quality. Donna Mae Roth excused herself from the meeting siting conflict of interest. MOVED by Clr. B. ! a height relaxation from 15.0 metres to 18.0 metres in recognition that the stepped roof and the increased pitch improves the asthetics of the building; a minimum parcel area relaxation (exceeds the maximum allowable floor area by 34.6%) in recognition of: the provision of underground parking; densities per dwelling units are less than the Town's Land Use Bylaw requirements the superior exterior design of the project. Donna Mae Roth returned to the Municipal Planning Conunission Meeting at 7:25p.m. HOME OCCUPATON BUSNESS LCENSE APPLCATONS Patricia Lecour: Application for a Home Occupation Business License, Mutts'n Suds, Daycare, dog washing and grooming on Lot 8, Block 8, Plan 762-1445 (122 Westview Drive). The matter was referred from the March 1, 2004 Municipal Planning Conunission Meeting to allow staff time to assess the impact of the Home Occupation and report back to the Municipal Planning Conunission in 6 months time. MOVED by Clr. W. Elgermsa that the application be approved as a Home Occupation Type "A" as no complaints have been received from adjacent properties with respects to the dog grooming business. DEVELOPMENT APPLCATONS- TOWN OF SYLVAN LAKE M. L. Armstrong: Town of Sylvan Lake., Arena Ccmplex: Lakeway Landing Phase 7: Application to replace existing recreation vehicle with permanent 4 Season House on Lots 11 & 12, Block 10, Plan 862-1794 (3501 50 Avenue). MOVED by Clr. W. Elgermsa that the application be denied as the development does not comply with the Narrow Lot General Residential District (R5) in which it is located with respects to setbacks and the number of permitted dwelling units per parcel. Further, the use does not comply with the permitted non-conforming use (Recreation Facility - RF) in that the development is a permanent dwelling (not recreation vehicle). Application for a new arena multi-use facility on Lot 1, Block 3, Plan 5732CL (4803 48 Street)(Zoned DC-1). MOVED by Clr. B. Dyrland that the Municipal Planning Conunission recommend to Council that the application be approved. CARRED Clr. W. Elgersma - Opposed SUBDVSON APPLCATONS- TOWN OF SYLVAN LAKE Request by Parkland Community Planning Services for decision on proposed subdivision application to create 79 residential parcels on S.W. Y.. 29; 38-1-5. MOVED by Clr. B. Dyrland: WHEREAS, in the opinion of the subdivision authority, the proposed application satisfies the requirements of Section 654 of the Municipal Government Act, and the relevant matters listed in Section 7 of the Subdivision and Development Regulations; and ~ ~ M.P. W. Elgersma that the Municipal Planning Commission! refer the matter to Council with recommendations that a letter be sent to. 1 Red Deer County stating that:. Next Meeting Date: the proposed subdivision not be approved; the Area Structure Plan not be approved; until such time as an ntermunicipal Development Plan (agreement) has been approved between Red Deer County and the Town of Sylvan Lake. NFORMATON TEMS The next meeting of the Municipal Planning Commission will be held on Monday, October 4, 2004. CORRESPONDENCE- None COMMTTEE/STAFF REPORTS Kindercare Property: The Assistant Chief Adminstrative Officer updated the Municipal Planning Commission on development of the lands. The Municipal Planning Commission discussed appropriate zonings for the land in recognition of Council's denying third reading to high density residential (R3) designation for the area. Council's decision was based on input from adjacent property owners. The Board indicated that General Residential District (R2) which permits duplexes and is consistent with the property to the east of it, would be appropriate. This would also allow higher density (R3 uses) as discretionary possibilities. The Board also recognized that high quality, higher density development (condominiums/townhouses/apartments) occurs in Communities which have developments backing onto golf courses. M.P.C.
