Vincent Acuna, Associate Planner, gave the staff report and PowerPoint presentation (copy on file). He noted the a revision to the conditions of approval to include additional conditions from engineering. Applicant Comments: Rob Hastings, RLH Architects, Chairman Guglielmo opened the public hearing and after seeing and hearing no one, closed the public hearing. The Commissioners were all in support of the project saying that a swim school in the City would provide a much needed service for the residents and the community and also complimenting the modern design. Moved by Munoz, seconded by Wimberly, carried 5-0 to adopt the Resolutions approving Design Review DRC2018-00257, Conditional Use Permit DRC2018-00256, Variance DRC2018-00964, and Uniform Sign Program Modification DRC2018-00849 with the amended Conditions of Approval. D5. DESIGN REVIEW DRC2018-00711 PANATTONI DEVELOPMENT COMPANY, INC. - A request to construct a 110,743 square-foot industrial building on a vacant 200,174 square foot (4.6 acres) parcel of land within the General Industrial (GI) District, located at the northeast corner of Center Avenue and 7th Street APN: 0209-251-10. This item is exempt from the Page 3 of 10

requirements of the California Environmental Quality Act (CEQA) and the City s CEQA guidelines under CEQA Section 15332 In-Fill Development Projects. Vincent Acuna, Associate Planner, gave the staff report and PowerPoint presentation (copy on file). He noted a revision to the Resolution of Approval. Commissioner Dopp asked if the developer would improve the landscaping along 7th Street and if the traffic analysis looked at the effect on the pavement and asphalt of streets from increased truck traffic in that area. Albert Espinoza, Assistant City Engineer, answered that the traffic study does not analyze the pavement conditions, but rather the traffic analysis of the number of trips that are expected to be generated from the business. However, the City does have a pavement management program through capital projects to evaluate the condition of the streets on an ongoing basis. Michael Sizemore, representing Panatonni Development Company, said they are excited for the opportunity to build another project in the City. Chairman Guglielmo opened the public hearing and after seeing and hearing no one, closed the public hearing. Commissioner Munoz stated the project is in line with other industrial projects within the City. Vice-Chairman Wimberly and Commissioners Oaxaca and Dopp complimented the design and said the project is appropriate with the land use in that area. Chairman Guglielmo said he liked the enhancement of the south elevation compared to the original design that was presented to the Design Review Committee. Moved by Wimberly, seconded by Oaxaca, carried 5-0 to adopt the amended Resolution approving Design Review DRC2018-00711. D6. TIME EXTENSION DRC2018-00966 YOULITA AND KIRYAKOS, LLC. - A request to allow for a one (1) year time extension of a previously approved Tentative Tract Map (SUBTT18823) to subdivide 3 parcels of land totaling 12.93 acres into 19 lots for the future development of single-family residences in the Very Low (VL) Residential District of the Etiwanda North Specific Plan (.1 to 2 dwelling units per acre) located on the west side of Wardman Bullock Road, south and east of Blue Sky Court; APN: 0226-081-15, 16 and 17. Related Files: Tentative Tract Map SUBTT18823, Variance DRC2012-00135, and Minor Exception Page 4 of 10

DRC2012-00513. On January 23, 2013, a Mitigated Negative Declaration of environmental impacts was adopted by the Planning Commission for Tentative Tract Map SUBTT18823. The California Environmental Quality Act provides that no further environmental review or Negative Declaration is required for subsequent projects or minor revisions to the project within the scope of the previous Mitigated Negative Declaration. Tabe van der Zwaag, Associate Planner, said the item will be continued to an unspecified date to allow time for the applicant to complete an updated Biological Resource study. He also noted there was a resident who was present prior to the meeting and discussed with the applicant their concern about vagrants moving into partially completed houses in that area. Carlos Cueva, representing the applicant, confirmed that he did speak with the homeowner and will be working with the homeowner. They will also be working on the biological study. Chairman Guglielmo opened the public hearing and after seeing and hearing no one, closed the public hearing and continued the item to an unspecified date. D7. DESIGN REVIEW DRC2018-00167 HPA, INC. FOR RICHARD DICK & ASSOCIATES - A request for site plan and architectural review of a 41,777 square foot warehouse distribution building that includes 3,000 square feet of office area on a 2.0 acre parcel of land in the Industrial Park (IP) District on the east side of Pittsburgh Avenue approximately 450 feet south of 6th street; APN: 0229-263-71. This item is exempt from the requirements of the California Environmental Quality Act (CEQA) and the City s CEQA guidelines under CEQA Section 15332 In-Fill Development Projects. Tabe van der Zwaag, Associate Planner, gave the staff report and PowerPoint presentation (copy on file). Chairman Guglielmo asked about the neighboring fence mentioned in the staff report. Mr. van der Zwaag said that the property to the east constructed a metal fence along the southern portion of the property, but it s not placed on their property line so the two property owners will work together to replace the fence with a new metal fence and avoid potentially created a double fence along the properties. Henry Pyle, representing the applicant, said that they ve been in contact with the real estate manager for McLain Foods about the fence and they are willing to work together to put up a new fence as discussed. Chairman Guglielmo opened the public hearing and after seeing and hearing no one, closed the public hearing. Commissioner Munoz stated his support for the project in the industrial area and Vice- Chairman Wimberly concurred. Commissioner Oaxaca commented on the design consistency with the surrounding buildings. Commissioner Dopp said he liked the trucks being oriented towards the back of the building. Moved by Wimberly, seconded by Oaxaca, carried 5-0 to adopt the Resolution approving Design Review DRC2018-00167. D8. Items D8 and D9 will be taken simultaneously. DESIGN REVIEW DRC2018-00392 CDS DEVELOPMENT FOR LONGHORN STEAKHOUSE A request for site plan and architectural review of a 5,825 square foot sit down restaurant with a 675 square foot outdoor eating area on a 71,063 square foot parcel of land in the Regionally Related Office/Commercial (RRO/C) District of the Victoria Community Plan at the southeast corner of Foothill Boulevard and Day Creek Boulevard at 12327 Foothill Boulevard; APN: 0229-021-76. Tabe van der Zwaag, Associate Planner, gave the staff report and PowerPoint presentation (copy on file). James Powell from Darden Restaurants said they are prepared to submit building plans for review soon and intend on pulling demolition permits in early fall. Chairman Guglielmo opened the public hearing and after seeing and hearing no one, closed the public hearing. All Commissioners stated their support of the project and were excited about Longhorn choosing Rancho Cucamonga as the location for their first venture into California, filling a site that has been vacant for an extended period of time. Moved by Munoz, seconded by Wimberly, carried 5-0 to adopt the Resolution approving Design Review DRC2018-00392 and Conditional Use Permit DRC2018-00393 as presented by staff. D10. CONDITIONAL USE PERMIT DRC2018-00868 CLINTON ESMENJAUD FOR OLD CUCAMONGA TATTOO COMPANY - A request to operate a 1,500 square foot tattoo studio in a commercial center on the west side of Haven Avenue at Town Center Drive in the General Commercial (GC) District at 7890 Haven Avenue, Suite 19; APN: 1077-401-29. This item is exempt from the requirements of the California Environmental Quality Act (CEQA) and the City s CEQA guidelines under CEQA Section 15301 Existing Facilities. Tabe van der Zwaag, Associate Planner, gave the staff report and PowerPoint presentation (copy on file). In addition to the presentation, Mr. van der Zwaag asked the Commission give feedback as to whether they would like to continue to see Conditional Use Permit applications for tattoo shops at Planning Commission or if the review and approvals should be done at staff level. The owner and applicant Clinton Esmenjaud said he wanted to create an upscale and modern tattoo parlor to create a positive environment for residents and the City. Chairman Guglielmo opened the public hearing. Brian Tomer, representing the landlord for the center, spoke in support of the project and stated the landlord is in support of the project as well. He said they ve passed on similar projects in the past but feels this is a good tenant for the center. Page 7 of 10

Derek Robertson spoke in support of the project. Chairman Guglielmo closed the public hearing. Commissioner Munoz and Vice-Chairman Wimberly advised the applicant to read and follow the Conditions of Approval. Commissioner Oaxaca said the concept of body art has become more mainstream and appreciates the applicant s approach to the business. Commissioner Dopp concurred with Commissioner Oaxaca. Chairman Guglielmo said the special conditions applied by staff to this project were very applicable and relevant. The Commissioners agreed that they would like to continue to see Conditional Use Permit applications for tattoo parlors in the City forwarded to the Planning Commission for review. Moved by Wimberly, seconded by Dopp, carried 5-0 to adopt the Resolution approving Conditional Use Permit DRC2018-00868 as presented by staff. E. COMMISSION BUSINESS/HISTORIC PRESERVATION AND PLANNING COMMISSION INTER-AGENCY UPDATES: Commissioner Munoz gave an update from League of California Cities regarding continued discussion about Governor Newsome s goal to build more housing. The League sees it as increased State oversight and control of local governments. A primary concern is the State s ability to take transportation funds from the City if housing production is lower than regional housing requirements. Commissioner Oaxaca commented that cities don t build, developers build. Commissioner Munoz agreed and said that cities can t compel developers to build a certain number of housing and said he anticipates continued conversation in Sacramento regarding this issue. He wants the residents to be aware that the State can take away the City s ability to condition projects. There are numerous proposed Bills that could potentially prohibit the City from controlling development. Commissioner Dopp asked if there is data on where the city is with meeting the housing needs. Mr. Ghirelli replied that the City provides an updated housing report every year to the State to determine if the City is complying with the housing element of the General Plan which can be provided to the Commissioners. Commissioner Munoz added that the City and the Planning Department have done a great job of building high-density and single-family homes to meet housing needs and developers know they are getting a great return on investment when building in Rancho Cucamonga.
