CAITHNESS HOMEOWNERS ASSOCIATION RULES AND REGULATIONS Caithness is a small intimate community made up of 33 units. The Homeowner s Association is responsible for creating and enforcing rules and regulations in order to maintain, improve, and promote a harmonious community living experience for the homeowners and/or tenants at the Caithness. The following Rules and Regulations have been adopted, effective August 1, 2010, for such purposes: HOUSEHOLD PETS 1. The only household pets allowed at the Caithness are those considered domesticated and legal, i.e. dogs, cats, birds, fish, hamsters, etc. 2. Pets are limited to two (2) pets per unit. Animals found to be a disturbance of any kind including but not limited to constant vocalizations such as barking or howling will NOT be allowed to stay on the premises. If the pet owner does not initiate a solution, a fine of $50 will be levied against the unit owner and the pet and, upon review by the HOA Board, will increase by $25 increments per offense. 3. Any dog in a common/shared area must be accompanied by the owner. The Board will not enforce a leash policy at this time, but should incidences occur to prompt such enforcement, the Board reserves the right to modify this rule and enforce a leash up policy. 4. Animals that attack another animal or human being or show aggressive tendencies must be promptly and permanently removed from the Caithness property pursuant to review by the HOA Board. If the pet owner does not take immediate action to remove the pet, the HOA will levy a $100 fine towards the owner of the pet and will initiate legal action to have the pet removed. All costs including but not limited to legal costs and attorney fees incurred in said legal action will be the responsibility of the pet owner. 5. Animal waste left in the common areas is to be removed by the pet owner as soon as possible. The HOA has provided a pet waste removal station in the Caithness courtyard for the convenience of pet owners. Any unit occupant not picking up animal waste deposited by their pet in the common areas will cause a $50 fine to be imposed on the unit owner. The fine will increase by an additional $25 for each subsequent offense. 6. The weight limit of a pet is 35 pounds. All pets weighing more than 35 pounds which were living at the Caithness prior to August 1, 2010 are grandfathered in and no action will be required. NOISE 1. Quiet hours are from 10:00pm until 7:00am as per the Salt Lake City Noise Ordinance. 2. Violations of the noise ordinance will result in a written warning to the unit owner. If the
warning does not resolve the problem, the unit owner will be fined $50, with increasing increments of $25 for each subsequent offense. 3. If the tenant of a unit is causing enough disturbance for police intervention, there will be an automatic fine assessed to the unit owner in the amount of $50 unless the unit has caused previous disturbances, in which case the fine will increase by $25 from the most recent fine imposed. ** Please remember that shared walls and units below share thin walls that are not sound proof. Please keep the volume on televisions, radios, music players, video games, etc, at a level that is respectful of your neighbors.** FIREWORKS 1. Fireworks are prohibited on the grounds of Caithness Condominiums. Any individual found to be using or lighting fireworks will be subject to a $100 fine. 2. Unattended and uncontained fires are prohibited on the ground of Caithness Condominiums. That includes, but is not limited to: fire pits, bonfires, fires built anywhere on the property. All fires must be in BBQ grills or other contraptions built to contain them. All fires in said allowable containers MUST be extinguished before being left unattended. 3. Fire that is left unattended will result in an automatic fine of $50. UNIT OCCUPANTS 1. Units at Caithness Condominiums are primarily for owner occupants. 2. Any unit sold with the knowledge that the new owner intends to use the unit as a rental property requires notification and approval by the HOA Board. 3. An owner renting out his/her unit must provide the Renter Information set forth in the Unit Data Form (attached) to the HOA Board and a copy of the rental lease. Private information on the rental lease, such as a tenant s SS#, birth date, etc, may be redacted/removed from the copy of the lease provided to the HOA Board. 4. THESE RULES AND REGULATIONS, as hereafter amended or as otherwise adopted by the HOA Board, shall be attached and incorporated to any rental lease agreement applicable to a Caithness unit. In the case of a violation of said Rules and Regulations by a tenant and/or guest of a tenant of a unit owner, the fine or penalty imposed herein shall be the obligation of the unit owner and it shall be the owner s charge to ensure compliance by his/her tenant, as a condition of the rental lease, whether or not the same is specifically stated in the lease agreement.
SMOKING Smoking is NOT allowed in any area which may affect other residents, including but not limited to hallways, stairways, shared entries, courtyards and all other common areas. With regard to smoking within individually-owned units, please see Judicial Code, Chapter 38, Section 78-38-1: (Nuisance defined) A nuisance is anything which is injurious to health, indecent, offensive to the senses or an obstruction to the free use of property so as to interfere with the comfortable enjoyment of life or property. A nuisance may be the subject of an action. A nuisance under this section includes tobacco smoke that drifts into any residential unit a person owns, rents or leases from another residential or commercial unit. Violations of the Caithness no smoking policy will result in a verbal warning to the involved party(ies), together with a written warning to the unit owner(s). Any subsequent violations will result in a $50 fine per offense to the owner of the unit. POSTERS, ETC. All posters, decorations, signs, etc., that are visible in the common areas must not be offensive to any person, race, gender, ethnicity, political persuasion, religious belief, etc. Any object that is displayed, complained about, and found to be offensive by the Board, must be removed from the visible common area. Non-compliance with this request by the Board will result in an automatic fine of $25 to the respective unit owner. YARD MAINTENANCE A yard service is contracted to maintain the common grounds at Caithness Condominium, including but not limited to the front of the building. If a unit owner has any concerns regarding this maintenance, he/she may contact the HOA Board through our property manager, Parker Brown Property Management. DUMPSTER/DEBRIS DISPOSAL The Caithness dumpster and specified recycling bins are available for the disposal of garbage, yard debris, glass and other recyclables from the residents who live on the property. The front of the building and the front of individual entrances should be kept free of daily living trash and debris (papers, napkins, drink containers, fast food bags, etc.) Garbage and debris, including food stuffs and pet food ( Trash ) placed or left outside the entrance to a unit or in the common areas, is an attraction to rodents and pests and should be removed promptly. Trash left in a common area outside of a trash receptacle or the dumpster, or in any area surrounding, outside of or at the entrance of a unit for longer the twenty four (24) hours, will result in a warning to the unit owner either verbally or in written form. Failure by a unit owner to remove trash promptly following the receipt of warning, will result in the imposition of a $50 fine.
ALL HOUSEHOLD TRASH DEPOSITED IN THE DUMPSTER MUST BE IN A TIED OFF PLASTIC BAG. Our garbage removal company levies a fee against Caithness in the amount of approximately $100 if certain items are found in or around the dumpster. These items include, but are not limited to: toilets, construction materials, gas containers, anything hazardous, oversized items, furniture, etc. The company will also charge Caithness a $100 fee if items are placed in front of the dumpster instead of inside it. Any resident that causes Caithness to incur this fee from will be assessed a $100 fine. Any subsequent occurrence of the same action by the same resident will result in an increase of $50 per offense, i.e., first incident $100, second incident $150, third incident $200, and so on. HOA MONTHLY FEES Monthly fees are due on the First day of the month. They are considered late if not paid by the 10 th of the month they are due. For mailed payments, the postmark on the envelope must be on or before the 10 th of the month due to be considered on time. For each month a payment is late, a $30 late fee which will be added to the balance owed by home owner. These Rules and Regulations are adopted by the Caithness Condominiums Homeowners Association as of March 21, 2013. The HOA Board reserves the right to revise, delete, and/or modify these Rules and Regulations pursuant to the terms of the Caithness Condominium Declarations and Covenants, as it deems necessary. A complete copy of these Rules and Regulations has been provided to each unit owner of record, by regular mail, and by email address of record, as of the 1st day of April, 2013.
