Rules and Regulations December 2012 Wording in Italic indicates Board of Directors additions to the current rules and regulations previously adopted 13.2 No Owner shall keep or park on the Master Association property or on a residential unit any trailers, golf carts, campers, boats, trucks, motorbikes, or motorcycles, it being intended that the only vehicles permitted to be kept on the property by owners, their guests, licensees, invitees, or assigns will be customary private passenger vehicles including vans and small pickup trucks of the same approximate length as passenger vehicles and which are used as private passenger vehicles. 13.3 Each Residential unit shall be used exclusively as a resident dwelling and no business or trade shall be permitted or conducted therein. 13.4 Each Owner, Lessee, or occupant shall maintain at all times in good condition and repair subject to the regulations of the Master Association, all exterior portions of their property and improvements made thereon including lawn and garden areas. Each Owner, Lessee and Guest is responsible to keep said property trimmed in an orderly fashion, free of weeds, unsightly growths and healthy lawns. 13.5 No Residential unit shall be divided or subdivided nor shall any structural alterations or changes be made to the dwelling located on said residential unit without prior approval of the ARC. In addition no unit may sublease any rooms in unit to any individual other than owner or Lessee/Guest that will be occupying the unit in owner absence. 13.6 No wire, Television antenna, aerials, satellite dishes or similar structures of any sort shall be erected, constructed, or maintained on the exterior of any building, and no owners shall permit or maintain any exposed outside storage or storage containers. Subject to Renewable Energy Law as applicable. 13.7 No clothes Lines, hangers or drying facilities shall be permitted or maintained on the exterior of any improvement and no clothes, rugs, drapes, spreads, or household articles or goods of any sort shall be dried, aired, beaten, cleaned, or dusted by hanging or extending same from any window or doorway. 13.8 No Owner may dispose of or keep refuse, trash, or garbage in or on any exterior area of the owner s residence or on the Master Association Property except those receptacles approved by Master Association. 13.9 No residential unit shall be subject of a partition action that seeks to physically divide a residential unit. Please see 13.5 13.10 No sign of any type shall be maintained, kept, or permitted on any part of the property that is made subject to these Covenants, except as approved by the ARC. Initials 5

13.10 (A) Maplewood Homeowners Association participates in a community yard sale on an annual basis in the month of November each year. If you should choose to abstain from participating you will need to contact the management office the beginning of November of each calendar year in writing to abstain from participating. Per Collier County Code Enforcement if you do not abstain from participating you will not be allowed to have an individual Yard Sale within six months from the community yard sale. 13.11 No Owner shall have the right to use water from the lake or drainage ditch without the association s written approval, which approval may be given unconditionally or conditioned upon such terms as the Master Association sees fit, including a charge to take and use such water. 13.14 No Weeds, High Grass, underbrush or other unsightly growths shall be permitted to grow or remain upon any part of the property. Lawns are to be maintained in a neat and orderly fashion and dead grass is to be replaced by the owner. Failure to do so will result in violation of Community documents resulting in possible fine committee action and/or corrective measures at the unit owner s expense as allowed under chapter 720 of Florida Statutes and Master Association Documents. 13.5 All Telephone, electric, water, sewer, television, fuel lines and pipes or other distributers must be underground from the lot line to the use connection. All Air conditioning units, pool pumps and filters shall be suitably screened by means of landscaping or other screening devices from view from the road and adjoining properties. 13.17 Except for required service or deliveries, no owner shall park or permit to be parked either on a lot or within street right of way within the property, any vehicle designed or used for COMMERCIAL PURPOSES or CONTAINING EXTERIOR ADVERTISING MATTER; any swamp buggy, stock car, or other vehicle not normally used for highway travel; or any boat, trailer or camper except when such motor vehicle, boat, trailer, or camper is parked or stored within closed garage. Should a unit owner wish to park a recreational vehicle, moving trailer, or vehicle longer than described description above, that owner will need to notify management of length of stay, not to exceed 48 hours, and will be subject to all Collier County Code enforcement regulations. In addition no unit may park a commercial vehicle used for such trade overnight in unit driveway. Should owners/tenants/guest vehicle display commercial lettering of any kind it must be covered during the overnight period. Failure to cover lettering or advertisement said unit will be subject to all violations and remedies as allowed by Community Documents and Florida Statutes. 13.18 Garbage containers, lawn trimmings, and trash stored for pickup shall comply with garbage and trash collection services rules for Collier County. Trash containers, if stored outside the home must be shielded with a hedge or similar vegetation. No fencing of any kind is permitted on the property. No owner may leave any refuse at curb area for trash collection except those items that will be retrieved on pick up day by Waste Management. All items not able to fit in trash receptacle must be stored out of sight until arraigned pick up day. Should owner have any question on refuse pick up please call Waste Management at 239-252-2380. 13.19 Normal household pets, provided they are not kept, bred or maintained for any commercial purpose, are allowed, however this provision does not prevent more restrictive rules regarding pets by other association. No Owner may obtain or permit to be kept on property any breed deemed to be an aggressive breed not restricted to; Doberman, Rottweiler s, Pit Bulls, or other known aggressive breeds. 13.21 No noxious or offensive activity shall be carried on upon the property or upon any part or portion thereof, nor shall anything be done thereon which may be or become a nuisance. Should any unit have a guest for more than 48 hours and that guest is identified to have any previous Felony criminal record with regard to sexual predator actions/sex crimes or other felony convictions easily identified or notified by law enforcement, guest will be required to leave immediately and owner may be subject to fining action or other legal remedies for failure to notify association of occupant. Owner and/or Tenant or any other occupant of the household represents that neither owner/occupant has ever been convicted of any felony or misdemeanor involving sexual misconduct or controlled substance. Owner/tenant that at the best to neither their knowledge nor any occupant of the property is subject of a criminal investigation or arrest warrant. Owner/tenant hereby further represents that neither owner/tenant nor any occupant has any criminal charges of a sexual nature at this time or has been convicted of a criminal charge of sexual nature. A guest or other party under the owner/tenant control shall not engage or facilitate criminal activity on or near the property, including but not limited to violent activity or drug related criminal activity. 13.22 Driveways and off-street parking areas shall be paved with concrete, asphalt or decorative paving. No overnight street parking is permitted and is subject to Collier County enforcement. Any parking on right of way will be at owners or guest own risk. Master Association has no claim to any damage or vehicle removal that may result from owner or guest parking in right of way. 13.23 Operable doors shall be provided for all garages. Garage doors shall be closed except when vehicles are entering or exiting. All Garage doors must have similar appearance and any replacement Garage Doors must be presented to ARC for approval prior to installation. 13.25 No Engine driven motor vehicles, motor cycles, or moped shall be used within the Common Areas or on the bicycle paths, except when such vehicles are used for maintenance of the common Areas. 13.26 Mailboxes and their supporting structures must be approved by the Master Association. All replacement mailboxes and supporting structures must be approved prior to installation or replacement if previous mailbox does not match new mailbox or supporting structure. All Mailboxes on Stanhope Circle are to be black in color with matching support post and all Mailboxes must be white on Crossfield Circle with matching support structure. All Maintenance of Mailboxes and support structures are the responsibility of Owner of corresponding lot/unit. Initials 7

13.28 Leasing: No Lot or unit maybe rented more than three times a year with a minimal period of 30 days. The board of Directors shall have the authority to approve all leases and renewals thereof, which authority may be delegated to a committee or agent. No person may occupy a residential unit as a tenant, family member of a tenant or otherwise without prior approval of the Board of Directors. The Board of Directors shall have the duty to approve or disapprove all proposed leases and occupancy in owner absence within 20 days of receipt of all required information including but not limited to; Completed Application, all associated fees and full criminal background information. Once all information is received the Board of Directors will provide an answer within 20 days of receipt. Approval or disapproval shall be in the form of electronic notification or written verification. Verification will not be transmitted verbally. Same rules will apply for All Sales/Purchases within community. I acknowledge by signing this form and initialing the Association Application for purchase or lease that I have read and understand the above Rules and Regulations of the Maplewood Homeowners Association. As a renter/lessee/occupant in owner absence and Purchasers I am obligated to abide by Community Documents and corresponding Rules and Regulations.
