Woods County Attorney The County Attorney received correspondence from the Martin County School Board Attorney that contained two resolutions requesting action by the Martin County Board of County Commissioners (Board) to direct the Supervisor of Elections to place: 1) on the August 28, 2018 Primary Election Ballot a referendum on the question of increasing ad valorem millage by one half mill for 4 years and 2) on the November 6, 2018 General Election Ballot a referendum on the question of the levy of a one half cent school sales surtax for a 7 year period. BACKGROUND/RELATED STRATEGIC GOAL: School Board Resolution 18-01 (Ad Valorem Millage) and Resolution 18-02 (Half Cent Sales Surtax) are attached to this item. 1. Resolution 18-01: Section 1011.71(9), Fla. Stat. District School Tax governs the ability of a school board to levy additional millage for school operational purposes subject to approval by a majority of the voters of Martin County. Section 1011.73(2), Fla. Stat. governs the Board s role in this matter: The district school board, pursuant to resolution adopted at a regular meeting, shall direct the county commissioners to call an election at which the electors within the school district may approve an ad valorem tax millage as authorized under s. 1011.71(9). 2. Resolution 18-02: Section 212.055(6), Fla. Stat. authorizes the school board to levy a one-half cent sales surtax subject to approval by a majority of voters in Martin County. Section 212.055(6)(b), Fla. Stat. provides, in part, that upon passage of a resolution levying such sales tax the sales tax question conforming to Section 101.161, Fla. Stat. shall be placed on the ballot by the governing board of the County. ISSUES: None. LEGAL SUFFICIENCY REVIEW: There is no legal sufficiency required for this item. RECOMMENDED ACTION: RECOMMENDATION 1. Move that the Board authorize placement of the Martin County School Board ballot language contained in School Board Resolution 18-01 concerning the increase in ad valorem millage by one-half mill for four years on the August 28, 2018 Primary Election Ballot which will be provided to the Supervisor of Elections for formal action. 2. Move that the Board authorize placement of the Martin County School Board ballot language contained in School Board Resolution 18-02 concerning the levy of a half-cent sales surtax for seven years on the November 6, 2018 General Election Ballot which will be provided to the Supervisor of Elections for formal action.
