ARTICLE XII. - "C-1" COMMUNITY BUSINESS DISTRICT REGULATIONS Sec. 1. - Scope. The regulations set forth in this article, or set forth elsewhere in this ordinance when referred to in this article, are the regulations in the "C-1" Community Business District. Sec. 2. - Use regulations. (a) (b) The parking regulations for dwellings, schools, institution-, and similar uses are the same as those in the most restrictive adjoining "R" (Residential) District. The parking regulations for other purposes are: (1) One parking space on the lot for each one hundred (100) square feet of floor area in a building used for recreation or amusement or any restaurant or establishment the primary use of which is to serve meals, lunches or drinks to patrons, either in their cars or in the buildings; provided, Page 2 of 4
however, that no theater shall be erected or reconstructed unless there is provided on the same lot, or within three hundred (300) feet thereof, and within this district, a space for off-street parking which contains an area adequate to accommodate one automobile for every five (5) seats in one theater. (2) (3) (4) One parking space on the lot for each two hundred (200) square feet of floor area in a building which is used for any other purpose permitted in this district. In instances where the general public is invited upon private property to park automotive vehicles the entire area to be used for parking purposes shall be hardsurfaced with asphaltic or concrete pavement which shall have an average thickness of not less than four (4) inches or another type pavement of equal load bearing strength. In all instances where there is no specific parking requirement applicable, the minimum offstreet parking spaces available must be equal to the number required to accommodate all normally anticipated customers, employees and other needs of the establishment. (c) One loading space on the lot shall be provided for each fifteen thousand (15,000) square feet of floor area, or fraction thereof, in excess of five thousand (5,000) square feet, devoted to commercial uses. Where such space is located in a manner that a truck must back directly from a major thoroughfare into the loading space, a maneuvering space of forty-nine (49) feet shall be provided. (Ord. No. 2003-16, 5, 4-7-03) Sec. 4. - Height regulations. No building shall exceed three (3) stories, nor shall it exceed thirty-five (35) feet, in height. Sec. 5. - Area regulations. (a) (b) Front yards. There shall be a front yard having a depth of not less than forty (40) feet. Side yards. (1) (2) The side yard regulations for the most restrictive adjoining "R" (Residential) Districts shall apply to such residential uses when located in the "C-1" Community Business District. No side yard shall be required for other buildings except as follows: (i) On a corner lot there shall be a side yard along the side street of the same dimensions as the required front yard of the adjoining residence district. Such side yard, however, shall not reduce the buildable width of a corner lot to less than twenty-six (26) feet. (ii) Page 3 of 4
On an interior lot there shall be a side yard of not less than seven (7) feet in width on the side of a lot adjoining a dwelling district. (c) (d) Rear yard. The rear yard regulations for the most restrictive adjoining "R" (Residential Districts shall apply to such uses when located in the "C-1" Community Business District. In all other cases a rear yard is not required, except where a lot abuts upon a dwelling district, in which case there shall be a rear yard of not less than twenty (20) feet in depth. Lot area per family. When a lot is improved with a single-family dwelling or a two-family dwelling, the lot area per family regulations are the same as those required in the most restrictive adjoining "R" (Residential) District. (Ord. No. 74-1A, 1-24-74) Sec. 6. - Residential floor area regulations. The residential floor area regulations are the same as those in the most restricted adjoining "R" (Residential) District.
