Completed New Resident/Tenant Package should be accompanied by a copy of executed lease agreement or addition addendum and $50 processing fee. 15.02 Subject to the provisions hereof, a Unit Owner is permitted to lease his or her Unit, provided however, that such Unit Owner provides the Association with notice of same, together with a copy of the executed lease between the Unit Owner and the tenant prior to the tenant s taking possession. Each lease shall be in writing and shall specifically provide (or, if it does not, shall be automatically deemed to provide) that a material condition of the lease shall be the tenant s full compliance with the covenants, terms, conditions and restrictions of the Declaration (and all Exhibits hereto) and with any and all rules and regulations adopted by the Association from time to time (before or after the execution of the lease and/or modifications, renewals or extensions of same). The Unit Owner will be jointly and severally liable with the tenant to the Association for any amount which is required by the Association to repair any damage to the Common Elements resulting from acts or omissions of the tenants (as determined in the sole discretion of the Association) and to pay any claim for injury or damage to property caused by the negligence of the tenant. All leases are subordinate to any lien filed by the Condominium Association, whether prior or subsequent to such lease. No lease of a Unit shall be for a period of less than ninety (90) days, and no Unit shall be leased more than two (2) times in any calendar year (i.e., no more than two (2) leases of a Unit may be commenced during any calendar year). When a Unit is leased, a tenant shall have all use rights in Condominium Property and those Common Elements otherwise readily available for use generally by Unit Owners, and the Owner of the leased Unit shall not have such rights, except as a guest, unless such rights are waived in writing by the tenant. Nothing herein shall interfere with the access rights of the Unit Owner as a landlord pursuant to Chapter 83, Florida Statutes. The Association shall have the right to adopt rules to prohibit dual usage by a Unit Owner and a tenant of Association Property and Common Elements otherwise readily available for use generally by Owners. The Venetian on the Ortega Condominium Association Quick Overview of Restrictions Please read the following carefully and initial each line stating that you understand and will comply. You will be expected to abide by these restrictions. A violation notification will be mailed to the owner and fines may be assessed unless otherwise approved by the association. This is a partial, but important, list of the full Rules and Regulations and Policy Notes. Initial each item stating that you understand and will comply with that rule. 1. Allow the Board or the authorized agents of the Association to enter any Unit for the purpose of maintenance, repair or replacement of any Common Elements or for making emergency repairs which are necessary to prevent damage to the Common Elements or to another Unit or Units. 2. All Children under twelve (12) years of age must be accompanied by a responsible adult when entering and /or utilizing the recreational facilities. 3. No balconies, patios or terraces shall be extended, enclosed or decorate in any way whatsoever by a Unit Owner without the prior written consent of the Board. 4. Not hang any laundry, garments or other objects which are visible from outside of the Unit, except for draperies, blinds, shades or other suitable window coverings. Decorative window coverings shall not include any type of reflective film on any glass windows or doors. 5. Not allow any rubbish, refuse, garbage or trash to accumulate in places other than the receptacles provided thereof, so that each Unit, the Common Elements and Limited Common Elements shall at all times remain in a clean and sanitary condition. 6. Use only the parking space or spaces, if any, specifically designated for use by Unit Owners. 8. No more than two (2) pets (limited to domesticated animals). Pets shall only be in the hallways and/or patios of the building as a means of direct ingress or egress to and from its Owner s Unit and the exterior of the building. 9. No recreational vehicles, campers, boats, trailers, nonfunctioning vehicles, commercial vehicles or any vehicle with commercial markings will be allowed in the parking area and/or on the Condominium Property. Schedule of Fines and Charges: Unit Owners are responsible for ensuring that all tenants, guests and vendors abide by the governing documents of the association. Unit Owners found to be out of compliance with the Association s governing documents will receive a letter outlining the violation and providing the Unit Owner with the opportunity to attend a hearing before the Covenant Enforcement Committee prior to the fine being imposed.
