Mineral Wells ISD is a tax exempt entity, so please do not include tax. 1. Bidders are advised that Mineral Wells ISD s contracts are subject to all legal requirements provided for in the Texas Education code 44.031 and/or applicable state and federal statutes. Any bid, after being opened, becomes subject to the Open Records Act, Article 6252-17a V.T.C.S. 2. All contracts and agreements between vendor and Mineral Wells ISD shall strictly adhere to the statutes as set forth in the Uniform Commercial Code as last amended in 1977 by the American Law Institute in the National Conference of Commissioners on Uniform State Laws. Reference: Uniform Commercial Code, 1987 official text. 3. No officer or employee of Mineral Wells ISD shall have a financial interest, direct or indirect in any contract made with Mineral Wells ISD, or shall be financially interested, directly or indirectly, in the sale to Mineral Wells ISD of any material, supplies or service except on behalf of Mineral Wells ISD as an officer or employee. 4. Any purchase order resulting from this Request for Proposal is subject to cancellation, without penalty, either in whole or in part, if funds are not appropriated by the Texas Legislature, E-Rate, or otherwise not made available to Mineral Wells ISD. 5. PREPARATION OF BIDS Bids will be prepared in accordance with the following: a) All information required by the bid form shall be furnished. b) Where there is an error in extension of price, the unit price shall govern. c) Quote will remain valid for at least 90 days.
7. Bidders will not include federal tax nor State of Texas limited sales excise or use tax in bid prices since Mineral Wells ISD is exempt from paying such tax, as are local school districts. An exemption certificate will be signed where applicable upon request. 8. By submitting a bid, bidder certifies to the best of his/her knowledge that all information is true and correct. 9. REJECTION OF BIDS a) Mineral Wells ISD may reject a bid if: 1) The bidder misstates or conceals any material fact in the bid, or if 2) The bid does not strictly conform to law or the requirements of the bid, or if 3) The bid is conditional except that the bidder may qualify the bid for acceptance by Mineral Wells ISD on All or None basis or a Low Item basis. An All or None bid must include all items upon which bids are invited. b) Mineral Wells ISD may, however, reject all bids whenever it is deemed in the best interest of Mineral Wells ISD to do so, and may reject any part of a bid unless the bid has been qualified as provided in 9 (a)3 above. Mineral Wells ISD may also waive any minor informalities or irregularities in any bid to include failure to submit sufficient bid copies, failure to sign second and/or third bid copies, failure to submit literature or similar attachments, or business affiliation information. 10. LATE BIDS OR MODIFICATIONS Bids and modifications received after the time set for the bid opening will not be considered. Bids received after the time set for the bid opening will be returned unopened. DISCRIMINATORY PRACTICES / BACKGROUND CHECKS During the performance of this contract, the contractor agrees not to discriminate against any employee or applicant for employment because of race, color, national origin, age, religion, gender, marital or veteran status, or handicapping condition. It is the contractor s responsibility to perform background checks on all employees that will enter school property and assure that individuals with criminal records do not perform work on school property. 12. AWARD OF CONTRACT a) The contract will be awarded to the lowest responsible bidder whose bid, conforming to the Invitation to Bid, is most advantageous to Mineral Wells ISD; price, quality and suitability to purpose will be the controlling factors, and Mineral Wells ISD reserves the right to arrive at such by whatever means deemed appropriate. b) Mineral Wells ISD reserves the right to accept any item or group of items of this bid, unless the bidder qualifies the bid by specific limitations. c) Mineral Wells ISD reserves the right to award the bid to one vendor or multiple vendors. d) A Notice of Award mailed or otherwise furnished to the successful bidder results in a bidding contract without further action by either party. 14. PATENTED OR COPYRIGHT PROTECTED ITEMS In the event any article to be sold or delivered hereunder is covered by any patent, copyright, trademark, or application thereof, the seller shall indemnify and hold harmless Mineral Wells ISD from any and all loss, cost, expenses and legal fees on account of any claims, legal actions, or
judgments on account of manufacture, sale or use of such article in violation of infringement or the like of rights under such patent, copyright, trademark or application. 15. All insurance requirements, including Workers Compensation, as outlined in the Texas State Statutes shall be met prior to any delivery and shall remain in effect during the life of this contract. 16. Mineral Wells ISD shall not pay for work, equipment, or supplies which are unsatisfactory. 17. Evaluation criteria shall include, but is not limited to the following: a) Price (55%) b) References (quality of work with previous customers) (25%) c) Vendor s experience with the specific technology that will be implemented (20%) 18. For contractual pricing, prices must remain firm for the entire contract. Only price adjustments resulting in a price decrease will be accepted. Mineral Wells ISD reserves the right to re-negotiate rates at the end of each contract period. 19. If you would like to have a walk-through of the campuses before placing your bid, please contact Greg Bird 20. The awarded vendor must provide Mr. Greg Bird proof of completion of warranty documentation, service level agreements, and licenses within 10 days upon completion of the job. Failure to do so will result in delay of payment by the district. 21. Payment will not be made to awarded vendor until successful testing of all cabling and equipment has been certified.
SCOPE OF WORK The purpose of this project is to replace each of the campuses existing Cat 5 copper cabling with Cat 6 cabling. Below is the number of terminated Cat 6 connections we will need at each location. The bid should include labor, cabling, patch panels, wall facing, raceway (if needed), any other materials needed to finish the job and termination on both ends.
