This property is used like right-of-way. Additionally, in order for the easterly single-family residential lot to be buildable, the lot needs to have access to a public right-of-way and the lot has no other access. Therefore, as the land is being used as right-of way and to make the adjacent lot buildable, staff is requesting the Commission approve the Quitclaim deed to designate this area as right-of-way for right-of-way purposes. Ideally, the right-of-way line would be consistent along the corridor. Area in question noted in Orange above: Page 1 of 6

This land has some of the MURT amenities in it and parallels two lots zoned single family residential. The area of railroad right-of-way not presently city right-of-way is boxed in red below. The two zoning lots are roughly divided by the blue line. For the east lot to be buildable, it must have access to city right-of-way and the railroad right-of-way in this location has not been designated as city right-of-way as a result the lot does not meet the zoning requirement for access to a city right-of-way and the lot has no other right-of-way access. As this property is used like right-of-way with trees and light poles for the MURT installed, it is the recommendation of staff that it should be designated city right-of-way. In addition, making this designation would allow the easterly lot to be buildable and it would also provide a consistent northerly right-of-way line. Therefore, staff is requesting the Commission approve the Quitclaim deed to designate this area as right-ofway for right-of-way purposes. Page 2 of 6
