Ward: 8 Contact: Kathy Ash, Manager 905-874-2067 OVERVIEW: The purpose of this report is to address the applicant's request to remove the Holding provision (H) to permit 2 additional single detached dwelling units in addition to the already permitted single detached dwelling currently under construction. The current zoning by-law that applies to the site states that the Holding (H) symbol shall not be removed until the Toronto and Region Conservation Authority has indicated to the City that they have no objection with further residential development occurring on the subject lands. The City has recently received confirmation from the Toronto and Region Conservation Authority that they are satisfied and have no objection with the development of two additional dwelling units. As such, staff is recommending approval of this zoning by-law amendment application in order to permit the development of the remaining two single detached dwelling units. In accordance with Section 36 of the Planning Act, a Public Meeting is not required to facilitate the lifting of the Holding (H) provision; however the notice of Council's intention to pass a zoning by-law to remove a holding symbol was advertised in the Brampton Guardian. RECOMMENDATION: 1. THAT a by-law be passed to amend Comprehensive Zoning By-law 270-2004 as amended. BACKGROUND: An application to amend the Zoning By-law submitted by Habitat for Humanity Brampton was approved in principle on May 25, 2011, which permitted the development of 3 dwelling units on Hoskins Square. The Zoning By-law was enacted on June 22, 2011. The zoning by-law that was enacted contained a Holding provision that states "the Holding (H) symbol shall not be removed until the Toronto and Region Conservation Authority has indicated to the City that they are satisfied that potential flooding can be properly mitigated and have no objection with further residential development occurring on the subject lands". CURRENT SITUATION/ANALYSIS: Habitat for Humanity Brampton has submitted an application to amend the zoning by law in order to lift the Holding provision on the subject lands. They have indicated their intent to begin construction of the remaining two dwelling units this spring. Habitat for Humanity Brampton is currently constructing a single detached dwelling on the same property. The additional two dwelling units will complement the design of the existing neighbourhood and will provide for an effective use of the lands. The Toronto and Region Conservation Authority has indicated that they have no objection to the lifting of Holding provision (H) at this time (see Appendix 1). As such, staff is recommending approval of the attached zoning by-law amendment in order to permit the development of the remaining two single detached dwelling units on the subject lands.
