Regular Council Meeting March 5, 2018 Public Meeting for Zoning By-law Amendments: NOTE: Declaration of Pecuniary Interest & General Nature Thereof Zoning By-law Amendment 109 Fire Route 85e - Belmont Ward (Jack Lake) The Township of Havelock-Belmont-Methuen is in receipt of an application for a Zoning By-law Amendment for certain lands located in Part Lot 30, Concession 8, being Lot 5 of Plan 11, in themethuen Ward (Dunkerley). The subject lands are currently zoned Seasonal Residential (SR) Zone. The proposed zoning by-law amendment will change the zone category to "Special District 198 (S.D. 198) Zone in order to permit the redevelopment of the lot in the form of a single detached vacation dwelling; while also introducing certain site-specific regulations. Zoning By-law Amendment Part Lot 14, Concession 6 (Belmont Ward) The Township of Havelock-Belmont-Methuen is in receipt of an application for a Zoning By-law Amendment for certain lands located in Part Lot 14, Concession 6, in the Belmont Ward (Ellis). The subject lands are currently zoned Rural (RU) Zone and Seasonal Residential (SR) Zone. The proposed zoning by-law amendment will
Page 2 of 7 change the zone category to "Special District 200 (S.D. 200) Zone, in order to satisfy a condition of consent for a lot addition; while also introducing certain site-specific regulations. Regular Meeting Resumes: The By-law regarding the Zoning By-law Amendment may be considered at this time or later in the meeting under By-laws. Committee of Adjustment (Minor Variance Applications): A-03-18, Minor Variance, John Tucker, Part Lot 13, Concession 4, Parts 1 and 2 of Plan 45R11031, having municipal address 331 Mile of Memories Road Belmont Ward The purpose of this application is to seek minor variance approval and relief from Section 2, Section 4.10 B (a) (i) and (ii) and Section 6.2.6, in order to permit the following: 1. The construction of an attached garage and second storey living space, having the following effect: i. reducing the minimum required side yard setback from 15 feet as per Section 6.2.6 (d) to 8.1 feet (35.73 feet existing); ii. increasing the maximum allowable height of the existing dwelling from 30 feet as per Section 6.2.6 (h) to 32 feet (1-storey existing); and iii. notwithstanding the provisions of Section 2 (Definitions) for the purposes of the subject lands a Dwelling, Single Detached may also include a secondary residential dwelling unit; having a maximum floor area of 1,120 ft 2 ; 2. The reconstruction of an attached front yard deck having the effect of reducing the front yard from 50 feet as per Section 6.2.6 (c) to 47.5 feet (48.75 existing); and 3. The proposed building expansion as referenced above together with the reconstruction of an addition and rear yard deck, having the effect of increasing the maximum allowable lot coverage from 15% as per Section 6.2.6 (g) to 17.4% (10.6% existing).
Page 3 of 7 A-04-18, Minor Variance and Application for Permission, Paul and Julie Cumming, Part Lot 14, Concession 6, with municipal address 97 Fire Route 26a Belmont Ward (Belmont Lake) The purpose of this minor variance application and application for permission is to seek relief from Section 4.10 A together with Section 4.10 B (a) (ii) to permit the construction of a addition to both the east side and west side of the existing cottage, which will have the following effects: 1. Notwithstanding any provision of Section 4.21 to the contrary, lands zoned Environmental Protection (EP), Rural (RU) and Seasonal Residential (SR) shall be considered one lot and provisions of the Seasonal Residential (SR) Zone shall apply. 2. reducing the minimum required water yard setback from 100 feet as per Section 4.35 to 94.2 feet (94.2 feet existing) from the east cottage addition and to 95.3 feet (94.2 feet existing) from the west cottage addition; and 3. reducing the minimum required front yard setback from 70 feet as per Section 11.2.1 c) to 94.2 feet (94.2 feet existing) from the eastern cottage addition and to 95.3 feet (94.2 feet existing) from the western cottage addition. A-0518, Minor Variance, Alex Dobos, Lot 14 of Registered Plan 45M-203, Big Island (Belmont Lake) The purpose of this minor variance application is to permit the construction of a cottage with an attached lakeside deck, which will have the following effects: 1. reducing the minimum required water yard setback from 100 feet as per Section 4.35 and Section 4.43.58 to 59.8 feet for the cottage and to 49.8 feet for the deck; 2. reducing the minimum required front yard setback from 70 feet as per Section 12.2.1 (c) to 59.8 feet for the cottage and to 49.8 feet for the deck; 3. reduce the minimum required south side yard setback from 35 feet as per Section 12.2.1 (d) to 26.3 feet for the cottage and to 31.4 feet for the deck; and 4. reduce the minimum required north side yard setback from 35 feet as per Section 12.2.1 (d) to 31.2 feet for the cottage.
Page 4 of 7 A-06/18, Minor Variance, Arne Nordtorp, Part Lot 29, Concession 9, with municipal address 359 Fire Route 85a Methuen Ward (Jack Lake) The purpose of this minor variance application is to seek relief from Section 4.10 B (a) (ii) in order to permit the construction of an addition to the existing cottage, which will have the following effects: 1. reducing the minimum required water yard setback from 100 feet as per Section 4.35 to 29.6 feet (15.2 feet existing) from the north shoreline and to 65.9 feet (31.6 feet existing) from the south shoreline; 2. reducing the minimum required front yard setback from 70 feet as per Section 11.2.1 c) to 29.6 feet (15.2 feet existing) from the north shoreline and to 65.9 feet (31.6 feet existing) from the south shoreline; and 3. increasing the maximum allowable lot coverage from 15% as per Section 11.2.1(g) to 17.9% (17.2% existing).
