In accordance with Section 33 of the Planning Act and the former City of Toronto Municipal Code Ch. 363, Article 11 Demolition Control, the applications for demolition of two vacant single family dwellings at 350 and 352 Sheppard Avenue East are referred to the North York Community Council to refuse or to grant the applications as building permits have not been issued for replacement buildings. If the North York Community Council grants issuance of the demolition permit, it may impose conditions if any, to be attached to the demolition permit. RECOMMENDATIONS Toronto Building recommends that the North York Community Council give consideration to the demolition application for 350 and 352 Sheppard Avenue East and decide to: 1) Refuse the application to demolish the single family dwellings because there are no permits to replace the buildings on the site; or,

2) Approve the application to demolish the single family dwellings without conditions; or 3) Approve the application to demolish the single family dwellings with the following conditions: a. that a construction fence be erected in accordance with the provisions of the Municipal Code, Chapter 363, Article III, if deemed appropriate by the Chief Building Official; b. that all debris and rubble be removed immediately after demolition; c. that sod be laid on the site and be maintained free of garbage and weeds, in accordance with the Municipal Code Chapter 623-5, and 629-10, paragraph B; and d. that any holes on the property are backfilled with clean fill. FINANCIAL IMPACT There are no financial implications resulting from the adoption of this report. COMMENTS On March 16, 2012, applications for Demolition Permits for two vacant single family dwellings located at 350 and 352 Sheppard Avenue East were submitted by Yim Chan of Makrimichalos Cugini Architects. At the time of applications for demolition, building permit applications for replacement buildings had not been submitted. As a result, Toronto Building submitted a report to the North York Community Council, and at the May 15, 2012 of the North York Community Council, the applications for demolition were refused because there were no permit applications to replace the buildings on the site. Subsequent to the meeting a Building Permit Application for a 4-storey Commercial Office Building with a roof-top garden was submitted on June 12, 2012 and is currently under review by the Toronto Building Division. The Zoning by-law # 637-2012 for the proposed office building was enacted by Council on May 9, 2012 and is in full force and effect. A Site Plan Control Applications was submitted for approval and the Notice of Approval Conditions was issued on April 27, 2012. The City of Toronto Municipal Code [Chapter 363, Article 11, Demolition Control Subsection D(1)] requires that applications be referred to Community Council for

consideration if no building permits are issued to erect replacement buildings on the property. The applications for the demolition of the single family dwellings have been circulated to the Heritage Preservation Services, Urban Forestry, Medical Officer of Health and the Ward Councillor. Heritage Preservation Services have responded that the properties are not included in the City s Inventory of Heritage Properties. We have submitted full Building Permit Applications to the City for the construction of an office building that we will be occupying for our North York based business. At their meeting on May 15, 2012, the NYCC refused the request for issuance of demolition permits, because at that time we had not submitted the building permit applications. Permit plans had not been finalized at that time as we were waiting for TTC technical approval for the building. We now have full TTC approval and full Building Permits were submitted to the City of North York in September. Granting the Demolition permits prior to the building permit being issued is a big help to us and for the city for the following reasons: Both 350 and 352 Sheppard Avenue East have been vacant for almost 2 years and for safety it is best for everyone to have them demolished and the site secured. We need to get the heavy demolition and construction work completed before the weather turns colder We are also under a tight deadline as half our staff is in rented offices where the lease runs out at the end of May. We need to start the demolition process to complete the project on time to move these employees to our new North York offices.
