OCEAN PLACE VILLAS HOA RULES & REGULATIONS 1. GENERAL MAINTENANCE AND USE Each resident shall maintain and use his dwelling in such a manner as to not create a fire hazard to others and so as to preserve the exterior appearance of the dwelling. Each owner is responsible for the proper conduct of his family, his guests, his tenants, and his service personnel. He should be certain that they understand and observe the Rules and Regulations. 2. RENTERS Owners are responsible for their tenant s compliance with the Rules and Regulations of the Association. Any violation of the Rules and Regulations will be the responsibility of the unit owner. All renters should be advised of, and given a copy of, and requested to comply with the Rules and Regulations. 3. FIRE PROCEDURES If you discover a fire in the unit, please do the following: From a safe location immediately call the Fire Department (911) and tell the dispatcher the building number and unit number/letter. Leave your unit unlocked and close the door. Alert the other occupants in your building. 4. NOISE Being thoughtful of one s neighbor is essential in a multi-family community. Noise becomes an annoyance during certain hours of the day, such as early morning or late evening, when most people are resting. Therefore, excessively disturbing noises in dwellings, which interfere with the rights and comforts, or other conveniences of neighbors, will not be tolerated. Noise from televisions, stereo equipment, musical instruments, motor vehicles, and people should be kept at a minimum at all times and especially during the hours of 11:00 P.M. through 8:00 A.M. 6. CONDUCT OF CHILDREN Parents are responsible for the general conduct of their children at all times. Damage to the common areas, limited common areas, or personal property of other residents or guests by children will be the responsibility of the parent. 7. GUESTS Guest should be advised of the Rules and Regulations of the Association. Owners or tenants are responsible for their guests compliance with the Rules and Regulations.
8. SWIMMING POOL ALL RESIDENTS AND GUESTS ARE CAUTIONED THAT THEY ARE TO USE THE SWIMMING POOL AT THEIR OWN RISK. Bottles or glass objects will not be permitted at any time in the swimming pool area. All children under twelve (12) years of age must be accompanied by an adult while in the pool area. Any floats and other paraphernalia of a similar nature, except for safety swimming devices, are not permitted in the pool. Pool furniture shall remain in the pool area. No pets will be allowed in the pool area. Radios, compact disk players, or other items can be annoying to others present and are therefore not permitted in the pool area. The pool closes at 10:00 P.M. 9. PETS In no event shall pets be permitted in any of the public portions of the condominium unless carried or on a leash and under the direct supervision of the owner. The owner shall indemnify the Association and hold it harmless against any loss or liability of any kind or character whatsoever arising from or growing out of having any animal in the condominium. Cats, dogs and other pets of Owners Only are allowed to be kept in or about the property. Under special circumstances the Association may impose special conditions upon keeping of a particular pet on the property. Excessive barking of a pet or other annoyances to residents may be cause for an order by the Association to remove the pet from the property. Pets should be walked away from the immediate area of the buildings. PET OWNERS ARE RESPONSIBLE FOR CLEANING UP AFTER THEIR PETS. A $100.00 FINE WILL BE ASSESSED TO ANY OWNER NOT CLEANING UP AFTER HIS PET. 10. VEHICLE PARKING LOT REGULATIONS Association parking lots are for personal passenger vehicles only (CARS, VANS, SUV S AND PICKUP TRUCKS). All vehicles must occupy no more than one marked parking space. Trucks other than pickup trucks, buses, campers, motor homes and RV s, motorcycles, mopeds, golf carts, boats, jet skis, personal watercraft, utility trailers, and boat trailers or other similar equipment (with the exception of Association owned maintenance equipment or maintenance equipment used on behalf of the Association) shall not be parked or stored on any portion of the Association property and are considered unauthorized vehicles to be parked in designated parking lots. Owners can have motorcycles must be registered.
Vehicle owners are responsible for any damage caused by any vehicle. No car repairs unless in an emergency situation, such as dead battery, flat tire, etc. No parking in handicapped parking spaces without proper identification. Cars violating this rule are subject to immediate towing. All cars must be in running condition with current tags and inspection stickers. Vehicles will be tagged and towed at the owners expense in 24 hours. Motorists shall at all times drive carefully in conformity with conditions and circumstances, but in no event exceed the 15 miles per hour speed limit. The Association will strictly enforce this rule. Motorcycles (OWNERS ONLY, REGISTERED WITH ASSOCIATION) are responsible for noise level and protecting pavement from damage. Motorcycle owners will be responsible for any damage caused by their vehicles. As a security measure, the Association recommends that all vehicles be locked while on Association property. No trailers of any type or size are allowed on Fairways property. 11. ALTERATIONS No resident shall make alterations or additions to any of the common elements or limited common elements without prior written approval of the Board of Directors. Procedures for obtaining approval are outlined in the Master Deed of the Association. 12. EXTERIOR APPEARANCE The decks and porches shall be used only for the purposes intended and shall not be used for hanging garments or other objects, or for the cleaning of rugs or other household items. No radio or television antenna or any wiring for such purpose may be installed on the exterior of the building or upon the common elements. Prior permission must be obtained from the Board of Directors before any satellite dish may be installed. Satellite dishes must be no larger than 18 inches. To maintain a uniform and pleasing appearance to the exterior of the building, no awnings or projections shall be attached to the outside walls, decks or the screened in porches. Exterior screens on porches and windows must be kept in good repair. Christmas lights are permitted, they may be installed no
sooner than December 1 st and must be removed by January 10 th. Lights must be outdoor approved and UL safety approved. 13. HALLWAYS AND ENTRANCEWAY Hallways and entranceways are part of the common elements. There shall be no decorating or painting on hallways or entranceways to insure uniformity throughout the building. The walkways to the dwelling units shall not be obstructed or used for any stored or left in any of the passageways, railings, access areas, or routes of stairs. 14. SIGNS No signs, advertising or notices of any kind or type whatsoever, including and not limited to, For Rent, For Sale, Welcome to the Smith s, shall be permitted or displayed on the exterior of the unit. No signs, etc. shall be placed in the common areas of the Association by a homeowner or his agent. 15. REFUSE All refuse must be put in secured, heavy-duty plastic bags and placed in the trash dumpsite provided by the Association. Under no circumstances should refuse be left in hallways, stairways, or any other common area, nor should any overflow of trash discarded items such as furniture, mattresses, etc. be placed by the dumpster as these items will not be picked up by the refuse company and will attract stray animals and insects to the area. 16. RESPONSIBILITY FOR DAMAGE Members shall be liable for all DAMAGES to the building and/or common grounds caused by receiving deliveries of, moving, or removing furniture or other articles to or from the building. Homeowner shall be responsible for the actions of their family, guests and tenants. 17. VACANT UNITS To prevent damage to your own unit or adjoining dwellings, please insure that the windows and the doors to the outside are closed when leaving your condominium residence. In case of severe thunderstorms or a hurricane, each unit owner who plans to be absent from his unit for an extended period of time shall insure prior to his departure that all furniture, plants or other objects are removed from his deck. It is also recommended that washing machine hoses be shut off and the main water line coming into the unit (located by hot water tank) be shut off.
18. HAZARDS No barbecue grills of any type will be permitted on the condominium property, including but not limited to, in a dwelling unit, porch or deck. A Grill is provided in the pool area for all owners, tenants and guests. No owner shall use or permit to be brought into the dwelling unit any flammable oils or fluids such as gasoline, kerosene, or other explosives or articles deemed extra hazardous to life, limb or property. The discharge of fireworks and/or any other type of noise making or explosive device is expressly prohibited on any part of the condominium property. 19. RULES CHANGE The Directors of the Association reserve the right to change or revoke existing Rules and Regulations and to make such additional Rules and Regulations from time to time as, in their opinion, shall be necessary or desirable for the protection of the condominium property and its occupants and to promote cleanliness and good order of the property and to assure the comfort and convenience of members. 20. VIOLATIONS Violations of the foregoing Rules and Regulations are subject to a $50.00 fine, which shall be a special assessment to the unit owner housing the violator.
