Report To: From: Development Services Committee Item: Date of Report: DS-07-328 December 5, 2007 Commissioner, Development File: Date of Meeting: Services Department D4660-0001 2007 December 10, 2007 Subject: Request by Region of Durham for the transfer of a 1 Foot Reserve: South Side of Rossland Road West, East of Waverly Street North PUBLIC REPORT Ward: 4 1.0 PURPOSE The purpose of this report is to recommend that the City convey to the Region of Durham ( Region ) a 1 foot reserve located along the south side of Rossland Road West, east of Waverly Street North and described as Block A, Registered Plan No. 946. Exhibit No. 1 to this report illustrates the location of the subject 1 foot reserve. Exhibit No. 2 to this report is a copy of Reference Plan 40R-25074 that shows land recently acquired by the Region for a sight triangle and to facilitate a sidewalk relocation at the south east corner of Rossland Road West and Waverly Street North. Attachment No. 1 is a letter dated October 1, 2007 from Chris Herriott of the Region requesting a land exchange involving a portion of the 1 foot reserve. 2.0 RECOMMENDATION That the Development Services Committee recommend to City Council: 1. That, pursuant to Report DS-07-328 dated December 5, 2007 the 1 Foot Reserve, described as Block A, Registered Plan No. 946 in the City of Oshawa and shown as PIN 163040-0007, be declared potentially surplus to municipal requirements. 2. That staff be directed to advertise the disposition of the above-noted parcel. 3. That, in the event no negative written comments are received as a result of the advertisement, the subject property be declared surplus to municipal requirements and that staff be directed to proceed with the transfer of the parcel to the Region of Durham for the amount of $500.00, being the estimated cost of the advertisement, without the need for a further report, By-law 97-2000 notwithstanding. 4. That, subject to the parcel being declared surplus, the Mayor and Clerk be authorized to execute any and all documents in a form and content satisfactory to the City Solicitor to give effect to the foregoing. 98011-0612

Report to the Development Item: DS-07-328 Services Committee (Continued) - 2 - Meeting Date: December 10, 2007 3.0 EXECUTIVE SUMMARY The City owns a 1 foot reserve along the south side of Rossland Road West, east of Waverly Street North. The reserve prevents access to Rossland Road West from the lots along Berwick Crescent. The Region has asked the City to convey part of the reserve to facilitate a sidewalk relocation and sight triangle at the southeast corner of the Rossland Road/Waverly Street intersection. The entire reserve is surplus to the City s needs and should be conveyed to the Region since Rossland Road West is under the Region s jurisdiction. 4.0 INPUT FROM OTHER SOURCES The Corporate Real Estate Strategy Team (CREST) has reviewed this report and concurs with the Recommendation. 5.0 ANALYSIS The subject 1 foot reserve described as Block A, Registered Plan No. 946 was conveyed to the City in 1972 as a condition of the registration of the adjacent subdivision. The purpose of the 1 foot reserve is to prevent direct access to Rossland Road West from the abutting lots on Berwick Crescent. Rossland Road West is now under the jurisdiction of the Region. The Region has recently improved the intersection at Rossland Road West (Regional Road 28) and Waverly Street North. Improvements included the widening of Rossland Road West to accommodate left turn lanes in both directions. These improvements were completed in November 2007. Earlier this year, the City conveyed six other parcels of land adjacent to Rossland Road West to the Region in order to advance these road improvements. The Region recently acquired Parts 2 and 3, Plan 40R-25074 shown on Exhibit No. 2 from a private property owner for a sidewalk relocation and sight triangle. By letter dated October 1, 2007 (see Attachment No. 1) the Region requests that the City exchange a portion of the 1 foot reserve (Part 1, Plan 40R-25074 on Exhibit No. 2) for a new 1 foot reserve (Part 3, Plan 40R-25074 on Exhibit No. 2) that would be located south of the new sight triangle. A land exchange involving a portion of the 1 foot reserve is not necessary. Rather, it is recommended that the entire 1 foot reserve described as Block A, Registered Plan No. 946 be conveyed to the Region since Rossland Road West is under their jurisdiction. The Region controls access to the road and should own the reserve.

The Region has agreed to cover the City s advertising costs. 7.0 RESPONSE TO THE COMMUNITY STRATEGIC PLAN The Recommendation supports Goal B (A Green and Sustainable Community) of the City s Community Strategic Plan by improving transportation modes, supporting improved pedestrian and road safety and by working with the Region to reduce congestion on Regional road networks.
