MOTION: TO AUTHORIZE THE SALE OF SURPLUS COUNTY OWNED REAL PROPERTY FOR $9,000 TO MEHRAN SEPEHRI AND CAROL MILLS, MAP NO. 21-35-16-44-03000 II. AGENDA ITEM SUMMARY: Mr. Sepehri and Ms. Mills have submitted an offer of $9,000 for the subject parcel. The offer is being forwarded to the Board for acceptance or rejection. III. BACKGROUND/IMPLICATIONS OF ACTION: A. Board Action and Other History The subject property was acquired through tax foreclosure in September 2015. The property is located on Roaring Rapids Way in Oakridge. It is a 66 x 90 vacant lot in the Salmon Creek Estates subdivision. The property was offered at a Sheriff s sale on October 13, 2016 with a minimum bid of $6,000 and remained unsold at the close of the sale. B. Policy Issues ORS 275.200 provides for selling county property via a private sale if it has been offered at, and did not sell at a Sheriff s sale. A sale cannot be for less than 15% of the minimum bid for which it was offered at a Sheriff s sale.
C. Board Goals The sale of the property would be consistent with the Board s goal to return tax foreclosed property to the tax roll. D. Financial and/or Resource Considerations After program expenses are deducted, revenue from the sale of foreclosed property is disbursed to all the taxing districts in a manner similar to the disbursement of property taxes. E. Health Implications Development of the property with a dwelling will require use of local goods, services and labor. F. Analysis The subdivision in which the property is located is largely undeveloped with dwellings. Sale of the subject property may foster additional development in the subdivision. The County has foreclosed on other lots in the subdivision and previously sold two of them for $10,000. G. Alternatives/Options 1. Sell the property per the $9,000 offer. 2. Reject the offer and direct staff to negotiate different terms or to offer the property at a future auction. IV. RECOMMENDATION It is recommended that Option 1 above be pursued. V. TIMING/IMPLEMENTATION No timing issues are present. VI. FOLLOW-UP Upon the Board s approval, the Property Management Officer will proceed with closing the sale. VII. WHEREAS pursuant to Order No.16-08-23-02 the property was offered at a Sheriff s sale on October 13, 2016 with a minimum bid of $6,000 and remained unsold at the close of the sale; NOW, THEREFORE, the Board of County Commissioners of Lane County ORDERS as follows: 1. Pursuant to ORS 275.200 that the above described real property be sold to Mehran Sepehri and Carol Mills for $9,000. 2. That the Board Chair is authorized to execute a Quitclaim deed. 3.
