VI. C ORDINANCE NO. O2018-50 AN ORDINANCE WAIVING FORMAL BIDDING, AUTHORIZING THE PURCHASE OF A SKID-STEER LOADER FROM ATLAS BOBCAT, LLC, AND AUTHORIZING THE DISPOSITION OF SURPLUS CITY PERSONAL PROPERTY WHEREAS, the City is a home rule municipal corporation pursuant to Article VII, Section 6(a) of the Constitution of the State of Illinois of 1970; and WHEREAS, Article VII, Section 10 of the Constitution of the State of Illinois, and the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq., authorize and encourage intergovernmental cooperation; and WHEREAS, the Public Works Department has identified the need to replace a Bobcat skid-steer loader with bucket and snow blade owned by the City ( Surplus Property ); and WHEREAS, the City has budgeted sufficient funds in the 2018-2019 fiscal year for the purchase of a new Bobcat skid-steer loader with bucket and snow blade ( Equipment ) to replace the Surplus Property; and WHEREAS, Sourcewell, formerly known as the National Joint Powers Alliance ("Sourcewell"), is a cooperative organization representing local government, educational, and notfor-profit entities throughout the country; and WHEREAS, Sourcewell operates a purchasing cooperative program, which permits government entities to purchase commodities and services according to contracts negotiated by Sourcewell, resulting in significant savings; and WHEREAS, through its purchasing cooperative program, Sourcewell sought bids for the award of a contract for the purchase of the Equipment ("Purchase Contract") and awarded the Purchase Contract to Atlas Bobcat, LLC, of Elk Grove Village, Illinois ("Vendor"); and WHEREAS, Vendor submitted a quote to the City for the purchase of the Equipment in the amount of $45,237, which reflects the terms of the Purchase Contract ( Quote ); and WHEREAS, pursuant to the Quote, Vendor will accept the Surplus Property for a trade-in value of $8,000 to be used toward the purchase of the Equipment, resulting in a total not-toexceed cost to the City for the Equipment of $37,237; and WHEREAS, the Mayor and the City Council have determined that ownership of the Surplus Property is no longer necessary or useful to, or for the best interests of, the City and desires to dispose of the Surplus Property and convey the Surplus Property to Vendor in accordance with the Quote and the Purchase Contract; and WHEREAS, in accordance with Section 1-8-4.B.6.a.3 of the Warrenville City Code ( City Code ), the Mayor and the City Council have determined that it is in the best interests of the City and the public to waive competitive bidding and purchase the Equipment from the Vendor and dispose of the Surplus Property as set forth in this Ordinance;

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF WARRENVILLE, DU PAGE COUNTY, ILLINOIS, AS FOLLOWS: SECTION 1: Recitals. The recitals listed above are incorporated in this Ordinance as if fully set forth in this Ordinance. SECTION 2: Waiver of Competitive Bidding. Pursuant to Section 1-8-4.B.6.a.3 of the City Code and the City s home rule authority, the City Council waives the requirement of competitive bidding for the procurement of the Equipment. SECTION 3: Approval of Quote and Purchase Contract. The Purchase Contract with Vendor, in the total price of $45,237 for the Equipment is hereby approved, subject to the acceptance by the Vendor of the Surplus Property as partial payment in the amount of $8,000, resulting in a total not-to-exceed cash payment of $37,237, in accordance with the Quote attached to this Ordinance as Exhibit A. SECTION 4. Authorization to Dispose of Surplus Property. Pursuant to Section 11-76- 4 of the Illinois Municipal Code, 65 ILCS 5/11-76-4, and the City s home rule authority, the City Council declares that ownership of the Surplus Property, as described in Exhibit B attached to this Ordinance, is no longer necessary or useful to, or in the best interests of, the City. The City Council authorizes the City Administrator, or his designee, to dispose of the Surplus Property by conveying the Surplus Property to Vendor as partial payment for the Equipment. SECTION 5: Execution of Required Documentation. The City Administrator, or his designee, is authorized to execute, on behalf of the City, the Purchase Contract with the Vendor for the purchase of the Equipment and all documents necessary to complete the disposition of the Surplus Property authorized pursuant to Section 4 of this Ordinance. SECTION 6: Effective Date. This Ordinance shall be in full force and effect following its passage by a two-thirds (2/3) majority affirmative vote of the members of the city council then holding office and approval in the manner provided by law.
