Box 1848 Fort Myers, FL 33902 Office 239-997-7774 Fax 239-995-7779 Condominium living is unique. In our complex, we have 92 units, some occupied year-round and some for shorter periods of time. These families are living very close together with varying life styles. Many people here have invested in property some of which they own in common, as well as their unit which they own individually. What each of us does, in some way, effects all of us. Therefore, to provide for individual and mutual rights, property protection and value, and to help maintain comfortable, healthful, and congenial living conditions, the following rules and regulations are promulgated. A. OCCUPANCY AND USE 1. Each unit shall be used for single family residential purposes only. No more than 4 persons may reside in a 2-bedroom unit and not more than 2 persons may reside in a 1-bedroom unit. 2. A maximum of 6 persons may temporarily occupy a 2-bedroom unit and a maximum of 4 persons may temporarily occupy a 1-bedroom unit for an occasional period. All guests or tenants occupying units for periods in excess of one week, other than owners, shall register with management at or before the time of occupancy of the unit. 3. Rent sharing or the renting of rooms is prohibited. Units may only be occupied by tenants as a single-family residence. Single family means not more than two unrelated persons. 4. There shall be no restrictions as to the minimum age of children who may live in or visit the condominium. The activities and behavior of all children, when upon the condominium property, shall be regulated by an adult including physical supervision where necessary. The owners, or their representative, shall at all times have the authority to reasonably require that the resident, guest or other adult responsible for a particular child remove him/her from any common area if the child's conduct is such that they believe this action is necessary. 5. Units may not be rented for periods of less than sixty days. Maximum 6 months in any calendar year. 6. Written notice must be given to the Association by the owner of his intention to lease or sell the unit. The Association has an application which must be filled out before occupancy and must be submitted to the Manager with other required information. Occupancy of a unit by a prospective tenant, before approval, will automatically void and withdraw any further consideration of the application and further occupation of the unit by the tenant is unauthorized and prohibited. A copy of the rules and regulations must be given to and acknowledged in writing by prospective tenants. 7. No improper, offensive, hazardous or unlawful use shall be made of the property and all laws and ordinances of governmental bodies must be observed.
B. Parking Areas and Vehicles 2 1. Each unit is assigned a designated parking space and only the current resident may use the designated space. Extra spaces are provided, especially at the north side of the grounds. 2. No unauthorized parking is permitted in handicap spaces. 3. Passenger automobiles, motorcycles, van and light pickup trucks that do not exceed the size of one parking spaced may be parked in the parking areas. No commercial vehicles and no dump trucks, except while servicing units, shall be parked in the condominium property. After notification by the board of directors, such vehicles may be towed in compliance with Florida Statute 715.07. "Commercial Vehicles" means all vehicles of every kind whatsoever, which from viewing the exterior of the vehicles or any portion thereof, shows or tends to show any commercial marking, signs, displays, equipment or otherwise indicates a commercial use. 4. Boats, boat trailers, utility trailers, campers, and recreational vehicles for limited periods of time may be parked on the North side of the parking lot only after approval by the Board of Directors. Motorcycles may be used if they have a quiet muffler. Motorcycles must be parked in legitimate parking spaces (not on lanais, front porches, or grassed areas.) 5. Permission may be granted authorizing parking for a period not to exceed 7 days to the owner of a motor home or recreational vehicle if the owner is an owner of guest of a resident. Such vehicle may not be used as a residence while on the condominium property and shall be parked only on the north side of the parking lot. Motorcycles stored in/on trailers must be parked on the north side, with pre-approval of the Board of Directors, and then for not more than 7 days. 6. No one shall be permitted to operate motorized vehicles upon the condominium property which are not properly muffled or which are modified to produce loud exhaust noises. Faulty mufflers must be repaired within 10 days upon notice of management. 7. The prohibition of parking shall not apply to vehicles used for delivery or service to individual units during reasonable hours. 8. Oil and gasoline drippings from motor vehicles destroy blacktop. All residents must keep vehicles in good repair to avoid this. Any damage shall be the responsibility of the unit owner whether caused by owner, tenants or guests. 9. Bicycles are permitted but riding is not permitted on sidewalks or lawn areas. Riding is permitted on the asphalt, but at the rider's own risk. No skateboarding or roller blading. Bicycles shall not be displayed in any common area which can be seen by other residents. Bicycles may be kept in the lanais, at the bike rack or on the first-floor stoops. (Not to be kept on the upstairs walkways.) 10. A vehicle not currently licensed (current license tag) or cannot operate on its own power shall not remain on the premises for more than twenty-four (24) hours without approval of the Board of Directors and no repair or mechanical work of vehicles shall be made on the premises. C. Buildings and Grounds 1. Pursuant to F.S. 718.111(5) Florida Statutes, the Association has the irrevocable right to access each unit during reasonable hours, when necessary for maintenance, repair, or replacement of any common element or for making emergency repairs necessary to prevent damage to the common elements or to another unit or units. Therefore, each owner must provide a key to the manager or other designee of the Board of Directors. 2. The unfinished floor surfaces of second floor units (except bathrooms, kitchen, terraces, balconies or entrance ways) shall be covered with carpeting and padding to reduce transmission
3 or noise except as noted herein. Bathrooms, kitchens, terraces, balconies and entranceway floors may be covered with cushion type vinyl. If using a flooring other than carpet on the second floor, sound control membrane must meet at least industry superior sound deadening standards or higher to limit transmission of sound and must be submitted to the board of directors before installation for approval. 3. No radio or television antenna or wiring- for any purpose may be installed on the exterior of a building without the written consent of the Board of Directors. Satellite dishes less than 1 meter may be installed inside the lanai. Trimming of any landscaping to receive a signal is not permitted. 4. No sign, advertisement, notice, object, awning, screen, or enclosure shall be exhibited, painted or affixed by any resident on any part of the condominium property visible from the exterior of the building or from the common areas without the written consent of the Board of Directors to maintain a uniform exterior appearance. 5. All window coverings visible from the exterior of the building shall be white or an off-white color and in good condition. 6. Screened lanais are an extension of the living area and as such may contain only appropriate furniture, decorations, and personal items. No items or storage that detracts from the aesthetics of the community is allowed, except such storage as may be approved by the Board of Directors. No items may be left on the window sills when visible from the exterior. Items to be stored on lanai must be stored in approved storage units, free standing unit approximately 24" x 66" x 17.8 to be placed at the rear of the long Ianai wall, with the color compatible with existing lanai color. The approved cabinet is Rubbermaid. An alternate brand of similar shape and material would be allowed after approval by the Board. 7. To prevent damage from storms and hurricanes, lanais must be cleared of all items when the unit is left vacant for a 14-day period of time. 8. All common areas may be used for designated purposes only and no articles belonging to residents may be kept thereon except for the occasional plant or furniture that may be placed outside the front entrance of first floor units. 9. No open fires, barbecue grilling, or similar cooking procedure are allowed on in any unit, on lanai or entranceway. Barbecue grilling is allowed at pool-side grills only. 10. Use of pools and pool areas are governed by special rules. Please see pool rules at the end of this booklet and signage at each pool. The Association or its representative is authorized to enforce the pool rules. 11. Use of recreational facilities and common areas must be in such a manner as to respect the rights of other residents. 12. Disposition of garbage and trash shall be only by use of receptacles approved by the Association or by use of garbage disposal units. All garbage must be disposed of in securely closed plastic bags. Trash containers at pools are for incidental pool use only. Recycling is important for our environment and also for economy of operation of the Association, so please RECYCLE. No linoleum padding, carpet padding, tile or any other contractor-generated waste. Prior to disposing of items too large for dumpsters, a phone call to SilverCrested Management must be made so a pickup can be arranged without delay. Such large items may then be placed behind the dumpsters. All recycling shall be carried out in accordance with the specific instruction attached to the back of this booklet. 13. No person may make alterations or additions to the trees, shrubs or landscaping without approval of the Board of Directors. 14. After using the BBQ, the grill shall be thoroughly cleaned for the benefit of the next user.
4 15. The Association encourages unit owners to take necessary precautions during a storm. If a unit owner would like to install storm or window protections, hurricane or storm shutters must be brought to Management to be approved in advance by the board of directors before installation. Storm shutters must be removable and not impact the integrity (no drilling) of the building and may be put up within seven days of a storm and must be removed within 72 hours of the storm passing. Storm shutter installation and removal is the responsibility of the unit owner. D. Pets and Pet Owner's Responsibility 1. Usual household pets, may be kept on the premises but their size is limited to 25 pounds maximum adult size. Only one per unit (except for tropical fish) is allowed except if more are authorized by the Board of Directors. Feral animals and reptiles are forbidden and shall not be kept in any unit. The Board may refuse to allow any pet which for any reason is deemed by the Board to be undesirable. 2. If the Directors determine any pet is a nuisance to other residents, the pet shall be removed from the premises within 15 days. 3. Pets must be kept on a lease outside a unit. 4. The pet owner is responsible for clean-up and disposal of their pet's waste. 5. Pet walks are provided at the northwest and northeast sides of the property and all areas outside the perimeter fence. No curbing of pets is allowed anywhere else on the common elements. 6. Under no circumstance may a tenant or guest be permitted to keep a pet in the unit. 7. Because of the possibility of rabies, feeding or watering of free roaming or feral animals is prohibited E. General Provisions 1. No resident shall make or permit disturbing noises in the building whether made by himself/ herself, his/her family, friends, or pets, nor do or permit anything to be done that will interfere with the rights, comforts, and conveniences of other residents. 2. No resident may play or allowed to be played any musical instrument, phonograph, radio, or television set between the hours of 10:00 P.M. and the following 8:00 A.M. If the same disturbs other residents. 3. Every owner and resident shall comply with the rules and regulations herein stated, and all rules and regulations which from time to time may be adopted. 4. Each unit owner is responsible for any damages to the common elements, or to any other unit, caused by the owner, his/her family, invitees, tenants or guests. 5. No soliciting is allowed. If someone is soliciting please call the Sheriff at 656-7980 and report them as trespassers. 6. Failure of an owner or resident to comply with these rules and regulations shall be grounds for action to recover sums for damages, and/or injunctive relief. The Association has the right to levy fines as provided by Florida law. 7. These Rules and Regulations do not reflect the full responsibility of condominium ownership or residency. Refer to the Declaration of Condominium, Articles of Incorporation and By-Laws for complete information. SWIMMING POOL RULES
1. NO LIFEGUARD ON DUTY, SWIM AT YOUR OWN RISK. 2. Pool hours are dawn to dusk per Florida statute. 3. No radios, tape decks or CD s are allowed without earphones except for approved community activities. 4. No diapers in the pool. Children not toilet trained must wear approved waterproof pants over diapers. Disposable diapers are not allowed. Swim diapers only. 5. No reserved seating areas. 6. Children under 12 may not swim or use the pool unless accompanied and supervised by an adult. 7. Shower before entering the pools. Suntan lotion and sand must be removed before entering the pools. A shower is provided in the pool area. 8. Lounges or chairs are not to be removed from the pool decks. Do not drag chairs across pool decks. 9. Running, horseplay, climbing, ball or frisbee playing or other noisy activities are not permitted in or near pool areas. Parents are responsible for the behavior of their children. 10. No glass or animals in pool area (or 50 feet from unfenced pool). No food or drink in the pool or on the pool deck. 11. No smoking inside fenced area of pool.
