SSUES & By Janie Bays NSWERS What is Procuring Cause? Per the National Association of REALTORS Code of Ethics and Arbitrations Manual, Appendix I to Part Ten, procuring cause in broker to broker disputes can be readily understood as the uninterrupted series of casual events which results in the successful transaction. Or, in other words, what caused the successful transaction to come about. Successful transaction, as used in these Arbitration Guidelines, is defined as a sale that closes or a lease that is executed. Q. Do I have to put a date in the Termination of Offer section of the State Contract? A. No, if the blank is filled in the offer will expire upon, 1) the passage of a reasonable length of time, 2) the offer being countered by the other party (offeree), 3) the withdrawal of the offer by the party make the offer (the offeror), 4) the death of the offeror. For a more detailed discussion of this question, see the Issues & Answers in the March 2007 GTAR World. Q. When must an inspection report be transmitted to the Seller? A. The OREC Contract of Sale (3-2006) Section 7, C, 2 states that the Buyer within 24-hours after expiration of the time period referenced in 7A, shall deliver to Seller, in care of the Listing Broker, a copy of all written reports obtained by Buyer, if any, pertaining to the Property. Q. There is a dispute over earnest money, what should I do? A. The parties, Seller and Buyer, must first apply to the Early Settlement program in their area. If the dispute is not resolved, then the parties may choose to take each other to court or, the Broker may choose to file an interpleader suit.oklahoma Real Estate Commission Rules Subchapter13, Section 605:10-13-3, Special escrow disbursement outlines the Broker s obligations for disbursement of funds if there is a dispute. Q. What forms, pamphlets, and booklets should I be giving to Buyers and Sellers if I am using the state contract? A. Directors Actions This is a monthly feature which will report GTAR and NORES Directors actions from the previous month s Board of Directors meeting. GTAR and NORES Directors Directors approved monies in support of OAR s Habitat for Humanity House and giving the CFO the option to invest GTAR money in an ISA account. GTAR Directors A Strategic Planning Follow-Up Task Force comprised of Ron Sumner, Darryl Baskin, Kacy Bell, Carter Maxey, John Louis Hausam, David Momper, and Patty Taylor was appointed to meet quarterly or as needed with staff to follow up on progress of the Strategic Plan. Monies were approved to receive more detailed proposals from the public relation firms. Wording for the plaque to be placed in the memorial garden was approved. The 2008 GTAR Dues and Fees Schedule was approved; there was no change to the schedule from 2007. Directors approved the revision to GTAR Bylaws Article 10, Section 9 to read as follows: Section 9. Deposit. All monies received by the GTAR for any purpose shall be deposited to the credit of the GTAR in a federally insured financial institution or institutions selected by resolution of the Board of Directors. The following changes to Paragraph 20 of the Single Family Residence or Condominium Lease were approved: CONDOMINIUMS. The Tenant agrees to read and abide by the Condominium Rules and Regulations. It was approved to add the following statement to the Tenant Flood Notice form: Renters Flood Insurance: The owner s insurance does not insure the tenant against loss of personal property or injury. Renter s insurance including flood insurance is available to cover losses of property or injury caused by flooding, wind damage or other casualty loss. Please consult with an insurance professional of your choice. NORES Directors The proposed NORES Bylaws revisions were approved; they can be found online at tulsamls.net; under Member Resources, click Governing Documents, then click Proposed NORES Bylaws. Industry professionals pronounce it correctly. Directors approved the recommendation that pending listings (who have received notices from staff) which are not updated by September 24 th be assessed a $50 fine per listing. 6 October 2007

L P In By Polly Choate the NORES Rules and Regulations Following is a review of some of the rules: Section 3.12 Square Footage. (a) Primary Residence. Participants may quote Square Footage from one of the following sources: o Court House square footage o Building Permit Square Footage - Participant must have a copy of the building permit in the Participant s listing file. o Appraisal square footage - Participant must have a copy of the full appraisal or a copy of square footage measurement by a licensed or certified appraiser report in the Participant s listing file. Square footage can only be quoted in the Square Footage field or House Size (Range) fields or in the Media fields. Participants and Users shall not report square footage in any other field (including square footage of a room addition, etc.). (b) Secondary Residence. In the event the property contains a Secondary Residence, the square footage of the Secondary Residence must NOT be included in the Primary Residence fields of the listing. (Article 1, Section 3.20(f) allows square footage information for a Secondary Residence in the Public Remarks subject to the same appraisal report requirements set out in (a) above for the Primary Residence.) Mobile Home. Participants may quote dimensions of a Mobile home, if the Participant has a copy of the title, displaying the dimensions, in the Participant s listing file. The dimensions can be quoted in the Public Remarks field and must include the wording per title. Section 3.24 Listing Multiple Unit Properties. Assign Supra Keybox Tips of the Month by Polly Choate To assign the keybox to your listing, click on My Tools, then click Assign Supra Keybox. Enter the MLS number of the listing; this will auto log into the Supra site. Enter the Keybox Serial Number and Shackle Code, then click Save. To view your keybox activity, pull up the listing in MarketLinx. In the lower right corner of the Property Full Details, click the keybox icon with the sheet of paper. (When hovering over this icon, it displays: View Supra Showing Activity.) To quickly create a chart, select (highlight) the items you would like to include in the chart. For example, headings and totals on a report. Then, click F11. SFR: To limit your search to only Single Family Residential, from the search screen, use the Universal Land Use field. Select SFR from the list of choices. Tax ID #: The first 5 numbers of the tax parcel for Tulsa County represent the Subdivision. CMA: The Realist Comparables Report is not meant to eliminate the CMA in MarketLinx. MarketLinx is still your best option for creating a CMA; however, the Realist system may provide additional data for a CMA, such as FSBO information or, for the need to create a CMA in a hard to find comps area.
