Planning & Zoning Commission Meeting Minutes City of Spring Valley Village Tuesday, December 6, 2016 1. The Planning & Zoning Commission meeting was called to order by Chairman Trey Hoffman at 7:00 p.m. in the Council Chambers of City Hall, 1025 Campbell Road, Houston, Texas. Planning & Zoning Members present: Trey Hoffman, Chair Charlie Calderwood Maryellen McGlothlin Louise Richman Amy Winstead City Officials present: Loren Smith, City Attorney Art Flores, Building Official 2. Approval of meeting minutes for regular meeting October 11, 2016 Ms. McGlothlin made a motion to approve the minutes. The motion was seconded by Ms. Winstead. The motion passed 5 to 0. 3. Discussion and possible action regarding amending the list of replacement and understory trees and other changes to the tree regulations Mr. Hoffman started the discussion noting that Kyle Sears had called him and wanted to know if any thought had been given to number of trees and issue of subsidence and possible droughts. Discussion and comments followed among P&Z members. Mr. Calderwood is not that concerned about protecting trees on private property. However, he wants regulations for trees on commercial property. Ms. Richman mentioned importance of trees with respect to air quality. Ms. McGlothlin noted that weather in this area is challenging for growing trees. Ms. Winstead takes to heart the tree ordinance. Trees are not being taken care of during construction. The West University arborist works two days a week for that city. His recommendation is to have a system in place for enforcement because if not, then all the work is a waste of time. West University has a manual to help take care of trees. Mr. Calderwood would like to have an arborist come to P&Z to speak about the various tree requirements. A question was posed regarding feedback from SVV City Council on budgeting for an arborist. Mr. Smith will add circumference along with diameter to the tree ordinance. Mr. Hoffman has always found it problematic with the tree formulas. Should they be expressed as a minimum or a maximum? Mr. Calderwood talked about the dilemma of large houses on the small, as compared to cities south of IH-10, lots. He asks the question, is there any room for a tree(s) on such lots. Mr. Hoffman asked Ms. Winstead to check with her tree colleagues regarding formulas, number and size of trees for new homes, remodels and house additions. Mr. Hoffman stated that some relief may be needed for cul de sac lots. If the City could get the

tree ordinance to a minimum and use such terms as 3 inch trees, then could get rid of 1 inch trees. Ms. Winstead asked Mr. Flores about enforcement of the tree ordinance to which he replied that it is difficult. Mr. Hoffman said that the City needs to be more focused on protecting the trees that the City has. He said that if a P&Z member has an idea to email him but do not copy everyone as that is a violation of the open meeting act. The P&Z members reviewed tree ordinance starting with 3.1001 Definitions Throughout, 9 diameter was replaced with 10 diameter. Ms. Winstead said the ordinance should be renamed Urban Forest Preservation and Protection and need to start ordinance with a purpose/preamble/goal such as the one West University has. She noted that the second paragraph in the definition section, Circumference or diameter of a tree could be simplified as the current verbiage is intended for multi-trunk trees. 3.1002 Ms. Winstead said that (2) (B) and (D) were okay. 3.1003 second paragraph. Delete from which are identified to end of sentence and replace with will comply with the following minimum tree protection requirements. Under section titled, Basic Tree Protection change chain link fence height requirement to six feet from four feet. The purpose of this section is for tree roots not to have the stress of construction material. In (2) (D) section, Ms. Winstead said that contractors must have water available for trees during construction. Mr. Calderwood said the last sentence makes no sense. It will be taken out. Section (3), take out Within the tree drip line. Per Ms. Winstead, the biggest issue with respect to construction around trees is disturbing the dirt. 3.1004 Per Mr. Hoffman this section gets into formulas. Ms. Winstead says that something is needed on the spacing of trees. Mr. Smith will address number of feet apart there should be if an understory tree is next to a large tree. For understory trees, the distance is eight feet apart and for big trees, it is 10 feet apart. This requirement will be repeated in Exhibit A and B. Mr. Hoffman recommends $500 per tree should a property owner be excused from providing a replacement tree. 3.1006 Mr. Smith outlined his thoughts. Diameter will be added to this section. Mr. Calderwood has concerns with part (2) due to Spring Valley Village having smaller lots as compared to Piney Point Village. Part (3), remove first sentence and first word, accordingly of next sentence. 3.1007 This section, an example, pertains to new construction. Mr. Hoffman asked about remodels and add-ons. Ms. McGlothlin feels that remodeling is a case by case situation for tree requirements. Mr. Hoffman says that once a remodel is completed then look at tree situation. 4. Discussion and possible action regarding the definition of fence or wall Mr. Smith gave background on this item. An applicant was denied a fence permit and the applicant is now growing shrubs in place of a fence. Texas law says that trees and shrubs are not fences. Mr. Smith will add to the ordinance that one cannot put a hedge anywhere where a fence is otherwise prohibited. Mr. Smith noted that P&Z is right but it is difficult to write an ordinance for just one item.

5. Report regarding City Council action on Planning and Zoning Commission matters City Council liaison Marcus Vajdos was absent. 6. Adjournment Ms. McGlothlin made a motion to adjourn.
